Ordinance No f~~.~_~ - ~O ~l.~S" AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $719,200 SUBJECT TO RECEIPT OF THE ECONOMIC DEVELOPMENT INITIATIVE SPECIAL PROJECT GRANT FROM THE U S DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR THE PURPOSE OF FUNDING A CONTRACT WITH THE TARRANT REGIONAL WATER DISTRICT FOR THE TRINITY RIVER VISION URBAN WATERFRONT PROJECT MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $719,200 subject to receipt of the Economic Development Initiative Special Project grant from the U S Department of Housing and Urban Development, for the purpose of funding a contract with Tarrant Regional Water District for the Trinity River Vision Urban Waterfront project. SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction such decision opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shalt be cumulative of Ordinance No 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVED AS TO FORM AND LEGALITY G~~ Assistant City Attor ey ADOPTED AND EFFECTIVE. ©C~ ~s~!- ~.~~~ City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 10!4/2005 Ordinance No. 16631 10-2005 DATE Tuesday October 04 2005 LOG NAME 22TRV EDI FY05 REFERENCE NO G-14949 SUBJECT Authorization to Apply for and Accept an Economic Development Initiative Special Project Grant from the U S Department of Housing and Urban Development for the Trinity River Vision Urban Waterfront Project; Execute Related Grant Agreement with HUD Adopt Appropriations Ordinance and Authorize Execution of a Contract with the Tarrant Regional Water District RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to apply for and accept an Economic Development Initiative (EDI) Special Project grant in the amount of $719,200 from the U S Department of Housing and Urban Development (HUD) for the Trinity River Vision Urban Waterfront project; 2. Authorize the City Manager to execute a Grant Agreement with the U S Department of Housing and Urban Development, upon award of the grant; 3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $719,200 upon receipt of the grant; and 4 Authorize the City Manager to execute a contract with the Tarrant Regional Water District (TRWD) as the subgrantee in an amount not to exceed $719,200 contingent upon the award and receipt of the grant. DISCUSSION During the FY 2005 federal appropriations process the City received an EDI Special Projects grant from HUD in the amount of $719,200 The grant (B-05-SP TX-0650) referenced in the Conference Report (H R. 108-792) accompanying the Consolidated Appropriations Act of 2005 (PL 108-447) specifies $719,200 for construction of the Trinity River Vision project. The grant is proposed for land acquisition to facilitate the development of the Trinity River Vision Urban Waterfront project. On June 3 2003 the City Council adopted the Trinity River Vision Master Plan as a guide for future development along the Trinity River and its major tributaries TRWD in cooperation with Streams and Valleys Inc. the U S Army Corps of Engineers and the City of Fort Worth led the effort to prepare the master plan The master plan recommends altering the flow of the Trinity River at the confluence of the Clear and West Forks near Downtown The purpose of this project is to reduce central city flooding threats especially in the `sump areas" that still remain in the 100-year floodplain The proposed improvements will also control the flow of the Trinity River so as to allow greater public access to the river and to create an urban waterfront. The City Council the Tarrant County Commissioners Court, the TRWD board and Streams and Valleys Inc have endorsed the urban waterfront concept.
