The purpose of the Pre-Council Conference held prior to a regular City
Council Meeting is to allow the Mayor and Councilmembers to discuss infor-
mally items on the agenda and to secure information from the City Manager
and the staff. Although the meeting is open to the public, citizens are
requested to reserve comments and questions for the subsequent Council
meeting so they will be a part of the public record.

ITEMS
1. Judge Pat Ferchill spoke to Council with respect to a new source of funding
for drug treatment. Judge Ferchill began by informing Council of the passage of
the Drug Dependent Act on September 1, 1985. This Act, according to Judge
Ferchill, allows for Probate Court #2 to order drug/alcohol addicted adolescents
to residential/outpatient treatment services. This process may be done through
two means: 1) initiated by a parent who comes to the Probate Office with a
certified form from a doctor stating that the individual is indeed an alcoholic/
drug addict and 2) initiated by a District Attorney who files a complaint
stating that the person is an alcoholic/drug addict. Judge Ferchill wanted
Council to be aware of the fact that there is only one public facility, Vernon
Treatment Facility, in the entire State of Texas that treats drug/alcohol
addicted persons. There are private facilities but the cost is estimated at
ranging from S350 to S400 per day, which is extremely substantial. Judge
Ferchill stated that he is aware of the tight budget with which Council is faced
with at this present time but recommended to Council that as a long range plan
for such a facility, they should consider the feasibility of earmarking or
dedicating municipal fined revenue collected from alcohol or drug related
offenses. This recommendation, according to Judge Ferchill, will allow for
funds to be available when such plans are ready for action and would avoid
having to result to the usage of general funds. Judge Ferchill mentioned that
Tarrant County has already taken the first step by earmarking ten percent (10%)
of all revenue confiscated from drug/alcohol related offenses.
Councilman Williams raised a question about what would happen to an individual
who commits a crime (murder) while being under the influence of drugs/alcohol.
Judge Ferchill answered by saying that because a crime was committed, the
individual would be turned over to Criminal Court.
2. Bruce McClendon, Planning Director, addressed Council with a Growth
Management Update. Mr. McClendon stated that the term "Growth Management" was
an inappropriate term to use and found preference in using the term "Growth
Performance Management" because performance shows that something is being agreed
upon objectively. Mr. McClendon mentioned that he and his planning staff are
working to develop a growth management system which will be used to: 1)minimize
fiscal consequences; 2) encourage full utilization of utilities, streets and
community facilities; 3) maintain or improve levels of community s

infrastructure to determine how the City can grow without causing the City an
enormous amount of revenue. Mr. McClendon stated that a good Growth Management
Plan depends on some form of incentive. He went further to say that areas that
are not targeted for growth will have to bear the burden of financing their own
growth.
Councilman Lancaster stated for thought, the possibility of using the cost-
sharing approach with developers as opposed to consumer financing. Mayor
Bolen stated that the development of the fiscal Impact Model may be of great
assistance to Mr. McClendon in determining the technical implications and
aspects of growth.
3. M&C C-9840 - Design of Fire Station Nos. 24 and 33 and M&C P-1943 -
tabulation of bids for purchase of equipment, materials and services. Chief
McMillen, Fire Department, showed a film on the advantages of having the 135
Foot Ladder Fire Truck. Chief McMillen said that the 135 foot ladder would be
more efficient because not only can it be extended upward but outward as well.
The purchase of this piece of equipment is stated as being at a cost of less
than S100,000. There are only two companies that build this ladder; however,
there are other companies that make even larger ladders.
4. Emil Moncivais, Assistant Planning Director spoke to Council on the proposed
Conservation District Ordinance. Mr. Moncivais said that the ordinance would
make provisions for development standards (e.g, . building height), building
treatment (e.g. . architectural design, colors) and landscaping. It was
discussed by Council that an application for this purpose maybe submitted by
persons showning at least 51% of total lot ownership or 66 2/3 ownership of land
per block. Councilman Gilley questioned how this process could be undone.
Wayne Olson, Planning Department, suggested the such an action could be
initiated by Council with Council waivering the application fee if they feel
that it is necessary.
5. Assistant City Manager Ramon Guajardo spoke very briefly of his progress on
the proposed Charitable Solicitations Ordinance.
6. Other Issues - Mr. Charles Boswell discussed at the earlier part of the
meeting, the list of changes that had been made to the budget. One of several
changes mentioned was the addendum of one aide and one secretary for City
Council. Mr. Boswell stated that the list of changes from the original budget
showed a reduction of approximately $300,000. He also mentioned that the bulk
of the saving would be from bond funded projects.
