HomeMy WebLinkAboutOrdinance 16737-12-2005 Ordinance No 1(0737--I a o~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $66,260 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AMENDMENT NO 3 TO CITY SECRETARY CONTRACT NO 29706 WITH KIMLEY-HORN AND ASSOCIATES INC FOR ADDITIONAL DESIGN MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005- 2006 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $66,260 from available funds for the purpose of funding Amendment No 3 to City Secretary Contract No 29706 with Kimley-Horn and Associates, Inc. for additional design SECTION 2 That should any portion section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 ADOPTED AND EFFECTIVE. ~Q~Q~'''~b~'o~-O,o~-®QS~ This ordinance shall take effect upon adoption Page 1 of 2 City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 12/20/2005 Ordinance No 16737 12 2005 DATE Tuesday December 20 2005 LOG NAME 30LXX3 70 REFERENCE NO *C-21208 SUBJECT Adopt Appropriation Ordinance and Authorize Execution of Amendment No 3 to Engineering Agreement with Kimley-Horn and Associates Inc for Sanitary Sewer Rehabilitation Contract LXX (70) RECOMMENDATION It is recommended that the City Council 1 Authorize the transfer of $66 260 00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $66 260 00 from available funds and 3 Authorize the City Manager to execute Amendment No 3 to City Secretary Contract No 29706 with Kimley-Horn and Associates Inc. in the amount of $66 260 00 for additional design thereby increasing the contract amount to $577,275 00 DISCUSSION On March 23 2004 (M&C C-20000) the City Council authorized the City Manager to execute an engineering agreement with Kimley-Horn and Associates, Inc. in the amount of $408 450 00 for the design of Sanitary Sewer Rehabilitation Contract LXX (70) The agreement was subsequently revised by two amendments as follows. Amendment No 1 (M&C C-20334 October 12 2004) in the amount of $62 629 50 provided for the necessary design to relocate an existing 30-inch sanitary sewer main to accommodate proposed rail line extension by Union Pacific Railroad at its Centennial rail yard facility as well as the rehabilitation of a sewer main located immediately downstream of the 30-inch sewer main Amendment No 2 (M&C C-20486 January 1 2005) in the amount of $39 935 50 provided for the necessary design to replace a severely deteriorated segment of sanitary sewer M-199R* located underneath the runway of the Naval Air Force Station (NAS) Fort Worth Joint Reserve Base Amendment No 3 will address the following After a majority of the initial design work was completed it was determined that Union Pacific had made significant changes to the existing ground topography which required resurvey and redesign of the improvements proposed within the rail yard facility http.//www.cfwnet.org/council~acket/Reports/mc~rmt.asp 12/21 /2005 Page 2 of 2 The Transportation and Public Works Department has requested that a drainage area study be conducted to determine the exact capacity of an obstructing City and TxDOT storm drain system before allowing the disconnection of the storm drain system from an existing 48-inch sanitary sewer main on University Drive Kimley-Horn and Associates Inc proposes to provide the necessary additional engineering services for a lump sum fee of $66,260 00 City staff considers this amount to be fair and reasonable Kimley-Horn and Associates Inc is in compliance with the City's M/WBE Ordinance by committing to an additional 16% M/WBE participation on this amendment.
