HomeMy WebLinkAboutOrdinance 21909-09-2015 ORDINANCE NO. 21909-09-2015 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $286,495.70, SUBJECT TO RECEIPT OF GRANT AWARDS FROM THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE FISCAL YEAR 2016 COMPREHENSIVE SELECTIVE TRAFFIC ENFORCEMENT PROGRAM AND FISCAL YEAR 2016 COMMERCIAL MOTOR VEHICLE SELECTIVE TRAFFIC ENFORCEMENT PROGRAM, FOR THE PURPOSE OF IMPLEMENTING INCREASED ENFORCEMENT OF TRAFFIC SAFETY RELATED LAWS AND INCREASING PUBLIC EDUCATION ABOUT TRAFFIC SAFETY ISSUES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $286,495.70, subject to receipt of grant awards from the Texas Department of Transportation for the Fiscal Year 2016 Comprehensive Selective Traffic Enforcement Program and Fiscal Year 2016 Commercial Motor Vehicle Selective Traffic Enforcement Program, for the purpose of implementing increased enforcement of traffic safety related laws and increasing public education about traffic safety issues. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2015, and ending September 30, 2016, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the acceptance of two grants from the Texas Department of Transportation for the Fiscal Year 2016 Comprehensive Selective Traffic Enforcement Program in the Amount of$171,233.16 and the Fiscal Year 2016 Commercial Motor Vehicle Selective Traffic Enforcement Program in the Amount of $57,896.47; 2. Authorize the execution of related Grant Agreements with the Texas Department of Transportation; 3. Authorize a transfer in the amount of$57,366.07 from the Justice Asset Forfeiture Fund to the Grants Fund for the City's grant match requirement; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$286,495.70. DISCUSSION: The Texas Department of Transportation (TxDOT), Selective Traffic Enforcement Program (STEP) grants are aimed at reducing the number of motor vehicle crashes, injuries, and fatalities. The STEP grants will pay for the overtime hours of the officers participating in the program. A local match of at least 20 percent is required to participate in the program. The City of Fort Worth was awarded the Comprehensive and Commercial Motor Vehicle STEP grants, under which the Fort Worth Police Department will implement increased enforcement of traffic safety related laws and increased public education about traffic safety issues. The Comprehensive STEP grant activities include enforcement of speed, seatbelt, DWI, and intersection traffic control laws. The total proposed program amount, including $42,832.00 in match funds, is $214,065.16. Funds in the amount of$193,226.13 are budgeted for overtime and associated fringe benefits for an estimated 2,910 enforcement hours. An additional amount of$16,781.91 is budgeted for 273 overtime hours and fringe benefits for administering the grant. Funds in the amount of$1,307.12 are budgeted for 20 hours of overtime, along with associated fringe benefits to work public information and Logname: 35TXDOT2016 ACCEPT AWARD Page 1 of 2 education events. The amount of$2,750.00 is budgeted for public information and education materials. The Commercial Motor Vehicle STEP grant activities include enforcement related to commercial motor vehicles. The total proposed program amount, including $14,534.07 in match funds, is $72,430.54. Funds in the amount of$62,879.52 are budgeted for overtime and fringe benefits for approximately 928 enforcement hours. An additional amount of$6,725.53 is budgeted for 80 overtime hours and fringe benefits for administering the grant. Funds in the amount of$1,325.49 are budgeted for 20 hours of overtime, along with associated fringe benefits to work public information and education events, while the amount of$1,500.00 is budgeted for public information and education materials. Staff intends to use accrued Justice Asset Forfeiture Funds as the source of the match funds. The funds have been included in the Fiscal Year 2016 Budget of the Justice Asset Forfeiture Fund. Justice Asset Forfeiture Funds cannot be used for fringe benefits. Justice Asset Forfeiture Funds and the TxDOT grant funds cannot be used for indirect costs. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, and receipt of the grant, funds will be available in the Fiscal Year 2016 Operating Budget, as appropriated, of the Grants Fund.
