AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF
$1,034,485.14, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF SUPPORTING THE
FORT WORTH PUBLIC ART PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially
Funded Capital Projects Fund in the amount of$1,034,485.14, from available funds, for the purpose of supporting
the Fart Worth Public Art Program.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for
any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the
remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and
remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in direct
conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Transfer from the Fiscal Year 2015 Water and Sewer Operating Fund to the Specially Funded
Capital Projects Fund in the Amount of$1,034,485.14 to Support the Fort Worth Public Art Program and
Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer in the amount of$1,034,485.14 from the Fiscal Year 2015 Water and Sewer
Operating Fund to the Specially Funded Capital Projects Fund; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Specially Funded Capital Projects Fund in the amount of$1,034,485.14 from available funds to support
the Fort Worth Public Art Program.
DISCUSSION:
On October 2, 2001 (M&C G-13396), the City Council adopted Ordinance No. 14794 creating the Fort
Worth Public Art Program. The purpose of the Public Art Program is to:
• Create an enhanced visual environment for Fort Worth residents;
• Commemorate the City's rich cultural and ethnic diversity;
• Integrate the design work of artists into the development of the City's capital infrastructure
improvements; and
• Promote tourism and economic vitality in the City through the artistic design of public spaces.
Chapter 2, Article III, Division 2, Section 2-61 of the City Code, adopted as part of Ordinance No. 14794
(Public Art Ordinance), requires that two percent of the annual operating budget of the Water and Sewer
Fund for cash financing of capital projects be allocated to public art. The annual two percent set aside for
Fiscal Year 2015 equates to $1,034,485.14 and, upon City Council approval, will be transferred from the
Water and Sewer Operating Fund to the Specially Funded Capital Projects Fund for public art.
In accordance with the Fort Worth Public Art Master Plan (adopted by City Council on September 30,
2003, M&C G-14087) and the Long Range Public Art Plan for the Water Fund (adopted by City Council on
May 9, 2006; M&C G-15185), these funds provide for the administration of the Fort Worth Public Art
Program, conservation and maintenance of the Fort Worth Public Art Collection, and new public art
projects as recommended by the Fort Worth Art Commission (Art Commission) in the Fort Worth Public
Art Annual Work Plan and approved by City Council.
Recommended allocations in Fiscal Year 2016 from this transfer are: program administration of
$511,607.00, deposit into'the Public Art Conservation Fund of$100,000.00, and the remaining

$422,878.14 for public art projects to be recommended by the Fort Worth Art Commission in the Public Art
Program Fiscal Year 2016 Annual Work Plan.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget, as appropriated, of the Water and Sewer Fund. The fund will use savings from the Intra Fund
Transfer Account to offset the cost in the Transfer Payments Account. There is currently $29,883,943.00
appropriated in the account. As of August 17, 2015, $18,295,891.49 of those funds have been expended
and the available balance is $11,588,051.51.
