HomeMy WebLinkAboutOrdinance 21943-09-2015 ORDINANCE NO. 21943-09-2015 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TRANSPORTATION IMPACT FUND IN THE AMOUNT OF $1,484,309.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF ACQUIRING RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENTS FOR THE PARK VISTA ROAD IMIPROVEMENT PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Transportation Impact Fund in the amount of$1,484,309.00, from available funds, for the purpose of acquiring right-of-way and temporary construction easements for the Park Vista Road improvement project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the acquisition of fee simple interest in 5.3186 acres and temporary construction easements in 0.1775 acres of land located at 4228 and 4232 Keller Hicks [lood. FortVVorth.Texaa. from Victor F. Driskill and Sharon G. Driskill; 3. Find that the total purchase price in the amount of$1,440,809.00 is just compensation; and 4. Authorize the City Manager orhis designee to accept the conveyanue, pay purchase price o0ount, record the appropriate instruments and pay oedmabad closing costs Up to $43.500.00. DISCUSSION: Rig must be acquired for the proposed construction of Park Vista Boulevard from Keller Hicks Road to Ray VVhib* Road as described in the Economic Development Program Aonaernant approved by the City Council on March 4. 2014 (K8&C-20897). This is a developer funded project. However, the City is providing funding for right-of-way from Transportation Impact Fee funding. Right-of-way costs are estimated to be approximately $4.000.000.00 for the entire project and funds will be appropriated as pmroa|a are acquired. This K8oyo[ and Council Communication (yW&C) action authorizes acquisition of fee simple interest in 5.3180 acres and temporary construction easements in 0.1775 acres of land for the Park Vista Road Improvement project. The fee simple acquisition pursuant to this K8&C is required for the Park Vista Road Improvement Project and is located on properties at 4228 PCm||e[ Hicks Road and 4282 Keller Hicks Road. After the ooquiGiUon, the fee 8i0p|a property located at 4232 Keller Hicks Road will be significantly amo||er, of an irregular and narrow shape and will have limited occaae to utilities; thereby, damaging and diminishing the value of the remaining property. The improvements located within the acquisition area include asphalt paving. |ondeoeping, and fencing. The property owners submitted a counter-offer significantly higher than the l.oguomc: 2]R(]\VE7270-23l0-04 Pagel of3 appraised amount, which Staff rejected. The City and landowner have agreed to the negotiated amount of $1,440,809.00 as just compensation for the land and improvements. The real estate taxes will be pro-rated with the seller being responsible for taxes up to the closing date. The City will pay closing costs up to $43,500.00. Upon City Council approval, Staff will proceed with acquiring the fee simple and easement interests in the property except for the mineral estate. The deeds to the City will contain a surface waiver for the exploration of the mineral estate.
