AN ORDINANCE AMENDING ORDINANCE NO. 4374, ORDINANCE NO. y39p AND THE CONTRACT HERETOFORE ENTERED INTO BETWEEN THE CITY OF FORT WORTH,TEXAS AND TEXAS BITULITHIC COMPANY RELATING TO STREET IMPROVEMENTS ON A PORTION OF MEADOWBROOK DRIVE AND A PORTION OF OAKHILL ROAD IN SAID CITY, DIRECT- ING THE CITY SECRETARY TO FILE WITH THE COUNTY CLERK OF TARRANT COUNTY A NOTICE OF ASSESSMENT LIEN AS SAME AFFECTS THE IMPROVEMENT OF THE PORTION OF OAKHILL ROAD AS CORRECT- LY REDESCRIBED IN THIS ORDINANCE, AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THIS CITY. WHEREAS, by Ordinance No. 4374, passed and approved by the City Council of the City of Fort Worth, Texas, the City Council determined the necessity for and ordered the improvement of the following described portion of Oakhill Road: OAK HILL ROAD: from the north line of Meadowbrook Drive to 300' north of Yolanda Drive; and, WHEREAS, by Ordinance No. V194 , passed and approved by the City Council of the City of Fort Worth, Texas, which approved the Report of the Public Works Director and awarded the contract for the improvement of a portion of Meadowbrook Drive and a portion of Oakhill Road, the portion of Oakhill Road was described in the same manner as said portion of Oakhill Road was described in Ordinance No. 4374; and, WHEREAS, the contractawarded to Texas Bitulithic Company by the City of Fort Worth, Texas, for the construction of certain street improvements on a portion of Meadowbrook Drive and a portion of Oakhill Road, described the portion of Oakhill Road to be improved in the same manner as said portion of Oakhill Road was described in Ordinance No. 4374; and, WHEREAS, each of the descriptions contained in ordinance No. 4374, Ordinance No. and the contract with Texas Bitulithic Company relating to the portion of Oakhill Road to be improved, is erroneous; and, WHEREAS, it is necessary to amend Ordinance No. 4374, ordinance No. .4 90 and the contract with Texas Bitulithic Company so as to properly describe the portion of Oakhill Road to be improved; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OFFICIAL RECORD FORT WORTH, TEXAS, THAT: CITY SECRETARY Section 1. FT. WORTH, TEX. ordinance No. 4374, ordinance No. *&90 and the - 1 - contract with Texas Bitulithic Company for the construction of certain street improvements on a portion of Meadowbrock Drive and a portion of Oakhill Road be, and the same are hereby, amended so that the portion of Oakhill Road therein described shall be deleted therefrom and the following described portion of Oakhill Road substituted therefor, to wit: OAKHILL ROAD: from the northerly line of Meadowbrook Drive to the southerly line of Lot 1, Block 1, Brentwood Hills Addition, known and designated as unit No. 2, and all of the terms and provisions of said Ordinance No. 4374, Ordinance No. V390 and the contract with Texas Bitulithic Company for the construction of certain street improvements on a portion of Meadowbrook Drive and a portion of Oakhill Road, shall apply with equal force and effect to the portion of Oakhill Road next above described the same as if said portion of Oakhill Road to be improved had been properly described in said Ordinance No. 4374, Ordinance No. ya?9,0 and the contract with Texas Bitulithic Company in the first instance. All other portions of each of said ordinances and said contract as it was originally written, are hereby ratified, approved and confirmed. Section 2. The City Secretary is hereby directed to cause to be prepared a notice of the enactment of this ordinance and to file said notice with the County Clerk of Tarrant County, Texas among the Mortgage Records of said County. Section 3. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate ordinance records of this City. Section 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage. PASSED AND APPROVED This / day of _A- ,v:2 5, 1961. The contractor has completed the preliminary assess- ment procedures and requests a date be set for the benefit hearing. On the basis of the contract, it is estimated that the city's portion of the cost will be $40,483.00 and the property owner's share will be $53,891 .20. The total estimated cost of improvements on Meadowbrook Drive is $43,484.50 and the anticipated cost of the Oakhill Road improvements is $51,250.50. Meadowbrook Drive and Oakhill Road in'this area are narrow, high county road sections and represent a traffic hazard in their present condition. ese streets were not constructed to handle the present traffic volume or the anticipated traffic increase. During the past three and one-half years, there have been eleven traffic accidents, one of which resulted in a fatality, within the limits of the proposed project. The widening and paving of these streets will eliminate the hazardous condition which now ill sts. A petition .requesting the paving was submitted by the Eastern'Hill Dad's Club, signed by 580 residents of the area. These streets serve both the residents of this area and the Eastern Hills Elementary And High Schools. Howev-er, only three property owners abutting the project signed the petition and it is anticipated that there will be opposition to this project presented by the abutting property owners: It is therefore recommended that the following ordinances be adopted in the following sequence: I . Ordinance amending Ordinances 4374 and 4390 to clarify the limits to be paved; 2. Ordinance approving the estimates of cost and amounts to< be assessed and setting September 48, 1961 as the date for,,the benefit hearing.
