ORDINANCE NO.
AN ORDINANCE GRANTING J. L. LANCASTER AND PEARL
Wight, Receivers of the Texas & Pacific Railway
Company, their .aesigne_and eucceesora, tea right
and privilege to.construct and maintain a water
pipe line along Railroad Avenue, beginning at a
point where Railroad Avenue intersects the South
boundary line of the property and right-of-way
of the Texas & Pacific Railway Company and 30
feet distant from the North line of said Rail-
road Avenue, and extending East along said Rail-
road Avenue and 30 feet distant from the North
line of said Railroad Avenue, to a point where
said Railroad Avenue intersects the West line
of Jennin?s Avenue; thence in a northeasterly
direction across said Jennings Avenue to a
point approximately near the East line of Jennings
Avenue and 6 feet from the North line of said
Railroad Avenue; thence East along the North line
of said Railroad Avenue and 6 feet distant there-
from, to a'point approximately 175 feet from the
intersection of the East line of Jones street if
extended,with the North line of Railroad Avenue,
tnence North 6 feet on Railroad Avenue to the
intersection with the North line of said Avenue.
andproviding for an annual rental of 160.00.
BE IT ORDAIN ID BY THE BOARD OF COMMISSIONERS OF THE CITY OF
FORT WORTH, TEXAS:
Section l: Whereas, J. L. Lancaster and Pearl Wight,
Receivers of the Texas & Pacific Railway Company, for themselves
as such Receivers and in behalf of the Texas & Pacific Railway
Company, their and its successors and assigns, desire and pro-
pose to build and construct a certain water pipe line from its
water reservoir on the Clear Fork of Trinity Fiver, west of
the City Limits of Fort Worth for the purpose of bringing and
supplying water to a water tank proposed to be erected by them
on the property of the Texas & Pacific Railway Company in the
City of Fort Worth, Texas, as shown by map and profile attached;
and
Whereas, in order to reach said w4.ter tank with a pipe
line, it will be necessary to construct same partly upon Rail-
road Avenue;
Now, Therefore; Be it Ordained: That the said J. L. Lan-
caster and Pearl Wight, Receivers of the Texas & Pacific Rail-
way Company, forthemselves as Receivers and for the Texas &
Pacific Railway Company, the-area- it-8 assigns e-n�eucceseors,
are hereby granted the right to build, construct, maintain and
use within the City of Fort Worth, in Tarrant County, Texas, a
certain pipe line along and under the surface of Railroad Avenue
as follows:
Beginning 'at a point where Railroad Avenue intersects the
South boundary line of the right-of-way and property of the
Texas & Pacific Railway Company and 30 feet at right angles from
the North line of said Railroad Avenue; thence East, parallel
with the North boundary line of Railroad Avenue, 30 feet dis-
tant therefrom, to an intersection with `he West line of Jen-
nings Avenue; thence northeasterly to a point approximately
near the East line of said Jennings Avenue and 6 feet distant
from the North line of said Railroad Avenue; thence easterly,
parallel with the North line of Railroad Avenue and 6 feet dis-
tant therefrom, to a point approximately 175 feet East of an
intersection with the East line of Jones Street' if produced
North, and a point 6 feet distant from the North line of Rail-
road Avenue; thence northwesterly 6 feet to an intersection
with the North line of said Railroad Avenue.

Section 2: The said J. L. Lancaster and Pearl Wight,
Receivers of the Texas & Pacific Railway Company, in construct-
ing, maintaining -and operating said water Aips line for them-
selves as such Receivers and for the Texas & Pacific Railway
Company, their - and its successors and assigns, shall construct

of said. street as may be designated by the Engineer of 'the
City of Fort Worth, Texas, and such construction and mainten-
ance shall be under the supervision of the City Engineer and
the Board of Commissioners of the City of Fort Worth, Texas,
and subject to their approval. And it is further provided
that they, the Receivers aforesaid, their successors and
assigns, shall at all times keep said water pipe line in such
t' condition that it shall in no way interfere with the proper
use of Railroad Avenue.
Section 3: It is further expressly provided that said
water pipe line shall be used by the said Lancaster and Wight
!r as Receivers of the Texas & Pacific Railway Company, their
successors and assigns, only and solely for the purpose of
conveying for the private purposes of said Receivers and the
Texas & Pacific Railway Company, it and their successors and
assigns, water to the said water tank, and that no w4ter con-
veyed through said pipe shall at any time ever be used for
sale to any other railroad or Receivers thereof, or any other
person whatsoever.

said water ,pipe line, the said -Receivers are by the acceptance
If this ordinance, obligated and bound to hold the City of Fort
Worth harmless from any claims for damages or any causes of
action which may be brought or maintained against the City of
Fort Worth, caused in any manner by reason of the construction
or maintenance of same, and their successors and assigns shall
likewise be obligated whenever they use and avail themselves
of the privileges of this franchise.
Section 5: This ordinance is enacted and ordained
with the distinct understanding and agreement that the said
J. J. Lancaster and Pearl 'sight, receiv._rs of the Texas &
Pacific Railway Company, for themselves as such receivers, and
in behalf of the Texas & Pacific Railway Company, their and its
successors and assigns, shall pay to the Cit- of Fort forth
annually, the sum of X100.00 for the privileges herein granted
them, and the first payment of same shall become due and payable
upon the completion of the work herein contemplated, and a like
payment annually thereafter.

FORT NORTH. TEXAS,
NOW COMES, J. L. Lancaster and Pearl
Wight, Receivers of the Texas & Pacific Railway Company,
and show the Commissioners that in making various im-
provements and in the conduct of its business in the
City of Fort Worth, Texas, it proposes to erect a water
tank 'on its property in said City, the water from which
is to be .used for railway purposes only. In ander to
supply said tank with water from its water reservoir at
the Trinity River, it will be necessary to lay a certain
pipe line which they propose to bring on the right of
way of the Texas & Pacific Railway to Railroad Avenue.
They find it impracticable to continue this pipe line
along the right of way on this latter point to the point
of construction of the water tank on account of the large
number of tracks intervening, and they herewith present a
form of an Ordinance granting them, their'�- successors-and
assigns the privilege to lay said pipe along Railroad
Avenue as therein provided.
We, therefore, pray that this franchise be
granted with all proper restrictions and limitations
which, in the judgment of the Commissioners they may thinly
necessary.
