AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SOLID WASTE FUND IN THE AMOUNT OF
$100 000 AND DECREASING THE UNRESERVED RETAINED EARNINGS BY
THE SAME AMOUNT FOR THE PURPOSE OF TRANSFERRING SAID FUNDS
TO THE SOLID WASTE CAPITAL IMPROVEMENTS FUND FOR TWO CITIZEN
DROP OFF STATIONS MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-
2006 in the Budget of the City Manager there shall also be increased estimated receipts and
appropriations in the Solid Waste Fund in the amount of $100 000 and decreasing the unreserved
retained earnings by the same amount, for the purpose of transferring said funds to the Solid Waste
Capital Improvements Fund for two Citizen Drop Off Stations
SECTION 2
That should any portion section or part of a section of this ordinance be declared invalid
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 16582 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and. appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect upon adoption

for the Design and Construction of Two Citizen Drop Off Stations and Adopt Appropriation

RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached appropriation ordinance increasing appropriations in the Solid Waste Fund by
$100 000 and decreasing unreserved retained earnings by the same amount;
2. Authorize the transfer of $100 000 from the Solid Waste Fund to the Solid Waste Capital Improvements
Fund
3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Solid
Waste Capital Improvements Fund by $100 000 from available funds, and
4 Authorize the execution of Change Order No 3 to Design-Build Agreement with AUI Contractors, L.P in
the amount of $110 458 00
DISCUSSION
On May 11 2004 (M8~C C-20010) the City Council approved the execution of a Design-Build with AUI
Contractors, L.P for two Citizen Drop Off Stations for a total cost not to exceed $1 500 000 The actual
contract award was $1 493 166 00 Construction of the Drop Off Station at Brennan has been completed
and it opened to the public on September 19 2005
The second site at 5150 Martin Luther King Jr Freeway is under construction Authorization of this
change order will allow the following modifications.
1 Upgrade roadway from the service road to the gatehouse and around the roll-off bin area from road
base to 7-inch concrete paving at a cost of $86 758 00 This user-requested revision will provide a more
durable longer lasting road surface
2. Increase design fees by $23 700 for a site drainage study Texas Department of Transportation
(TxDOT) permit documents gatehouse design revision and additional Value Engineering to offset the rise
in material costs since late 2004

AUI Contractors, L.P is in compliance with the City's M/WBE Ordinance by committing to 39% M/WBE
participation for Change Order No 3 The City's M/WBE goal is 13% for Change Order No 3
These projects are located in COUNCIL DISTRICTS 2 and 5 but will serve all the Council Districts.

The Finance Director certifies that, upon approval of the above recommendation funds will be available in
