ORDINANCE NO. 16544-08-2005 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO 13896, AS AMENDED, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH, BY AMENDING ARTICLE 12 `URBAN DESIGN DISTRICTS" OF CHAPTER 4, `DISTRICT REGULATIONS" TO AMEND SECTION 4.1200B `BOUNDARIES OF URBAN DESIGN DISTRICT DOWNTOWN" TO INCREASE THE BOUNDARIES OF THE URBAN DESIGN DISTRICT TO INCLUDE FOREST PARK BOULEVARD AND THE CLEAR FORK OF THE TRINITY RIVER TO THE WEST TO AN ALIGNMENT WITH GOUNAH AND PHARR STREETS TO THE NORTH, TO THE RIGHT OF WAY LINE OF THE T&P RAILROAD TRACT ON THE EAST AND SOUTH GENERALLY ALONG THE T&P RAILROAD TRACK TO AND FOLLOWING INTERSTATE HIGHWAY 30• TO AMEND THE DOWNTOWN URBAN DESIGN STANDARDS TO ADDRESS BUILDING SETBACKS, POLE SIGNS ALONG INTERSTATE HIGHWAYS 30 AND 35, AND TO ADD THE SUNSET TERRACE RESIDENTIAL NEIGHBORHOOD AS A SPECIAL VIEW AREA, TO AMEND SECTION 4.1200, `DOWNTOWN URBAN DESIGN STANDARDS ADOPTED" TO ESTABLISH DESIGN STANDARDS FOR THE INCREASED DISTRICT BOUNDARY INCLUDED IN THE DOWNTOWN URBAN DESIGN DISTRICT PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, m December 2001 the Crty Council created the Downtown Urban Design Distract to encourage high quality pedestrian-oriented development m Downtown, adopted Sections 2 through 5 of the Downtown Urban Design Standards as part of the City's Zoning Ordinance; and established the Downtown Design Review Board to administer those design standards, and, WHEREAS, the Downtown Design Review Board recommended that the boundary of the Downtown Urban Design District be expanded to include the western area bounded by Forest Park Boulevard and the Clear Fork of the Truuty River to an alignment with Gounah and Pharr Street to the North, the T&P Railroad line to the east, and Interstate Highway 30 to the south as more specifically set out ui Exlubrt A so as to ensure appropriate urban design standards for Downtown gateways and edges; and WHEREAS, it is advisable to amend the Downtown Urban Design Standards to address builduig setbacks m peripheral areas of downtown, on-premises pole signs along the Interstate Highways 30 and 35 and to add the Sunset Terrace Residential Neighborhood as a Special View Area, and WHEREAS, Section 4 1200D of the Zoning Ordinance entitled `Downtown Urban Design Standards Adopted" requires that any revisions to the Design Standards must be considered by the Zoning Commission and approved by the Crty Council; and WHEREAS, rt is advisable to amend the Downtown Urban Design Distract boundary and the in order to allow the Downtown Design Review Board to review development projects m the west side of Downtown. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, AS FOLLOWS SECTION 1. Downtown Urban Design Standards ~ hereby amended by amending Subsection B `Boundaries of Urban Design District Downtown" of Section 4 1200 "Urban Design District Downtown of Article 12, "Urban Design Districts" Chapter 4 `Distract Regulations" to read as follows. 2 4.1200 Urban Design District Downtown B. Boundaries of Urban Design District Downtown. The Urban Design District Downtown includes all land located within the area bounded by the following: Beginning at the point of the north ROW line of Interstate 30 and the east ROW lute of Forest Park Boulevard. Northward on the East ROW lute of Forest Park Boulevard to the north ROW lute ofthe Fort Worth & Western Railroad Track; Northwestward along the north ROW lute of the Fort Worth & Western Railroad Track to the centerline of the Clear Fork of the Tn•nrnnty River• Following the centerline of the Clear Fork of the Trinity River to the centerline of the West Fork of the Trinity River to the northwest corner of Block 2, Lot 20, Gouhenant Additnon, Eastward along the northern boundary of Block 2, Lot 20, Gouhenant Additnon to the centerline of Samuels Avenue; Southward along the centerline of Samuels Avenue to the northwest corner of Block 1 N55 Lots 10 & 11 Gouhenant Additnon, Eastward along the northern boundary of Block 1 N55 Lots 10 & 11 Block 1 Lot 13 Block 1 E1/2 Lot 12, and Block 1 Lots 2-8, Gouhenant Addition to the east ROW lute of the T & P Railroad Track; Southward along the east ROW lute of the T & P Railroad Track to the northwest corner of Block 124 Lot 19R, Fort Worth Orngnnal Town Addition, Northeastward along the northern boundary of parcels fronting Belknap Street to the west ROW lute of Interstate 35 South along the west ROW lute of Interstate 35 to Lot 6, 6 Less Row Penderys Additnon, Southwestward along the southern boundary of parcels fronting Weatherford Street to the centerline ofNichols Street; Southeastward along the centerline of Nichols Street to the centerline of 2°a Street; Northeastward along the centerline of 2°d Street to the centerhne of Hampton Street; Southeastward along the centerline of Hampton Street to the western ROW lnrie of the BNSF Railroad Track; Southward along the western ROW lane of the BNSF Railroad Track to the northern ROW lane of State Hnghway 280 Southwestward along the northern ROW hne of SH 280 to the western ROW line of the T & P Railroad Track; Southward along the western ROW lane of the T & P Railroad Track to the north ROW lane of Interstate 30• then 3 Westward along the northern ROW lute of Interstate 30 to the point of beginning. The area ~ shown in Exhibit B.16. The new boundaries of the Downtown Urban Design District are expanded to include Forest Park Boulevard and Clear Fork of the Trusty River to the west, to an alignment with Gounah and Pharr Street to the North, the T&P Railroad line to the east, and Interstate Highway 30 to the south, as more particularly set out in Exhibit A attached and hereby incorporated into to this ordinance. SECTION Z. Section 4 `Building Edge" and Section 5 `Sign and Banners" of the Downtown Urban Design Standards is hereby amended as set out in Exlibrt `B" attached and hereby incorporated into the Zoning Ordinance by reference, to add language regarding building setbacks in peripheral areas of downtown, on-premises pole signs along Interstate Highways 30 and 35 and to add the Sunset Terrace Residential Neighborhood as a Special View Area. SECTION 3. The Downtown Urban Design Standards are hereby amended as set out in Exhibit `B" attached and hereby incorporated into the Zoning Ordinance by reference, to provide urban design standards for the expanded downtown business area to include the western area bounded by the Clear Fork of the Trusty River, to an alignment with Gounah and Pharr Street to the North, the T&P Railroad line to the east, and Interstate Highway 30 to the south as more particularly set out in Exlibrt A attached and hereby incorporated into to tlvs ordinance. 4 SECTION 4. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in duect conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. It ~ hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, ff any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. Any person, firm or corporation who violates, disobeys, onuts, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 7 All nghts and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending 5 „~., litigation, both civil and cnmmal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 8. The City Secretary of the City of Fort Worth, Texas, ~ hereby duetted to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013 Texas Local Government Code. This sense of urban enclosure with human scale is what distin- guishes Downtown from the vast, mostly suburban terrain of the Medoplex. Buildings should face the street with little or setback.
