AMENDMENT No.3 TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and RJN Group, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 41722, (the CONTRACT) which was authorized by M&C C-24754 on the 1st day of March, 2011 in the amount of $259,550 . 00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in the amount of $43,788. 75 which was authorized administratively on June 5, 2012, Amendment No. 2 in the amount of $27,263. 00 which was administratively authorized on November 26, 2013; and WHEREAS, the CONTRACT, involves engineering services for the following project: Sanitary Sewer Rehabilitation, Contract LXXXIV (84) ; and WHEREAS, it has become necessary to execute Amendment No.3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated September 21, 2015, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $22,450.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $353,091.75 cf-IVED OCT 12 2015 OFFICIAL RECORD 0yFFORT WORTH CITY SECRETARY FT: WORTH, TX Page -1- 3. This amendment request primarily addresses cost issues associated with the recent decision to use TWD13 funding for the construction of this project by the City which was not included in our original scope of work. Also, the use of TWDB funding resulted in changing the prior construction method directive of the rehabilitative lining (CIDP) of the existing L-4252, L-4203, L-4135 and L-4136 6-inch sewer lines back to a pipe enlargement construction method so that 8-inch sanitary sewers would be installed per State regulations. This amendment addresses the following Group 33 tasks and items in more specific terms: 1) Final Design Plan Revisions changing from the CIPP rehabilitation design of the existing L-4252, L-4203, L-4135 and L-4136 6-inch sewer lines to 8-inch pipe enlargement of those sewers due to the decision to utilize TWDB funding for the construction of is project. These changes resulted in issuing nine (9) new plan sheets impacting the Final Design Task (Subtasks: 4.2G) for a total amount of$15,600.00 being requested. 2) Updating final cost estimates reflecting the construction method design changes made to L-4252,L-4203,L-4135 and L-4136 sewer lines. These design changes resulted in revising the final cost estimate impacting the Final Design Task (Subtask: 4.3) for a total amount of $395.00 being requested. 3) This amendment item addresses impacts to Project Specifications, Bidding and SDC services and the addition of TWDB permitting (approvals) for this project due to the decision to utilize TWDB funding for the construction of is project. These changes resulted in specification and bid proposal revisions and extra coordination and reporting tasks associated with using TWDB funding for construction which impacts Final Design Task (Subtasks: 4.4) for a total amount of$6,390.00 being requested.
