AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED
CIVIL SERVICE POSITIONS IN THE POLICE DEPARTMENT BY ONE
EFFECTIVE OCTOBER 1, 2015 BY ELIMINATING ONE POSITION IN THE
CLASSIFICATION OF POLICE OFFICER, BY ADDING ONE POSITION IN
THE CLASSIFICATION OF CORPORAL[DETECTIVE, AND BY ADDING
ONE POSITION IN THE CLASSIFICATION OF SERGEANT; PROVIDING A
STATEMENT OF PURPOSE AND INTENT; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND
REPEAL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 143.021(a), Texas Local Government Code provides that a
municipality's governing body shall by ordinance (i) establish the classifications of police
officers and (ii) prescribe the number of positions in each classification; and
WHEREAS, on December 9, 2014, the City Council adopted Ordinance 21596-12-
2014, which established the Police Department's sworn personnel staffing levels effective
December 9, 2014, as follows:

WHEREAS, the adopted Fiscal Year 2015-2016 budget included funding for
additional positions and for certain existing, unfunded "overage" positions; and
WHEREAS, the City Council wishes to implement the staffing changes associated
with the adopted budget and revise the Police Department's staffing levels from those set by
Ordinance No. 21596-12-2014 to implement the following staffing effective October 1, 2015:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
SECTION 1.
That, following the formal adoption of this ordinance, the following positions shall be
the only civil service positions in each classification (rank) authorized in the City of Fort
Worth Police Department effective October 1, 2015 until modified by subsequent ordinance:

SECTION 2.
The "Mayor and Council Communication" memorandum, which is presented
contemporaneously with this ordinance, is hereby expressly incorporated herein by reference
for further clarification and explanation of the purpose and intent of the City Council in its
adoption of this ordinance as well as the Department in its implementation.
SECTION 3.
This ordinance shall be cumulative of all provisions of previous ordinances and of the
Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of
this ordinance are in direct conflict with the provisions of prior police staffing ordinances

for the Police Department and such Code, in which event conflicting provisions of such
ordinances and such code provisions are hereby repealed and this ordinance shall be
controlling.
SECTION 4.
It is hereby declared to be the intention ofthe City Council that the sections, paragraphs,
ucutcuccu, clauses and phrases of these ordinances are severable, and if any phrase,
clause, oco1cuuo, paragraph or section 0f this ordinance shall be declared unconstitutional by
the valid judgment ordecree of any court ofcompetent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sco1cocco, paragraphs and sections of
this ordinance, since the aa/nc would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section.
SECTION 5,
This ordinance shall take effect and bcio full force and effect oo October l, 2Ol5, and itiaao
ordained.

Adopt Ordinance Amending Police Department Staffing Ordinance No. 21596-12-2014, Effective October
1, 2015, to Decrease the Number of Authorized Positions in the Classification of Police Officer by One,
Increase the Number of Authorized Positions in the Classification of Corporal/Detective by One, and
Increase the Number of Authorized Positions in the Classification of Sergeant by One, Thereby Increasing
the Total Number of Authorized Civil Service Positions by One to Reflect Civil Service Staffing Changes
Included in the Fiscal Year 2016 Budget (ALL COUNCIL DISTRICTS)

RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance, which revises Police Department
civil service staffing effective October 1, 2015 to reflect civil service staffing changes included in the Fiscal
Year 2016 Budget and which decreases the number of authorized positions in the classification of Police
Officer by one, increases the number of authorized positions in the classification of C o rpo ra VIDetective by
one, and increases the number of authorized positions in the classification of Sergeant by one, thereby
increasing the total authorized civil service positions by one, from 1,588 to 1,589.

DISCUSSION:
The purpose of this Mayor and Council Communication and the attached ordinance is to revise civil
service staffing in the Police Department to reflect civil service staffing changes included in the Fiscal Year
2016 Budget, The City's adopted Fiscal Year 2016 Budget includes funding fort addition of 37
additional budgeted positions in the Police Department, 35 of which are civil service positions. The
attached ordinance includes 25 oft e newly budgeted civil service positions.
Police Officer—Positions
As of the end of Fiscal Year 2015, the Police Department's authorized strength includes 24 authorized,
unfunded positions in the classification of Police Officer., These positions, commonly referred to as
'overages,"" were added over the past 18 months so that the Department could still it all academy
graduates when actual attrition did not align with what had been projected (M&Cs G-18210 and G-
18346) As attrition caught up with projections, vacancies occurred, and the unfunded "overage" positions
have been left open.
The recently adopted Fiscal Year 2016 Budget includes fending for 22 additional Police Officer
positions. In addition, to focus more resources on improving response times, Staff is proposing that one
Detective/Corporal position identified in the weapons•range improvement I mprovement package not be created and that
an additional Police Officer position be added instead, meaning a total of 23 of the "overage" Police
Officer positions would become budgeted positions effective October 1, 2015. Adoption of the attached
ordinance would eliminate the one remaining unfunded Police Officer"overage."
The 23 new budgeted positions will provide eight Police Officer positions to staff the weapons range at the

Bob Bolen Public Safety Training Center and 15 Police Officer positions representing the first wave of
staffing for the new Sixth Patrol Division. Although all of these positions are funded and authorized as of
October 1, it is expected that many will be vacant until new academy classes graduate.
Tested-Rank Positions
Approval of the attached ordinance would add one position at the classification of Corporal/Detective to
staff the weapons range and one position at the classification of Sergeant to work in the School Security
Initiative. These positions are effective on October 1, 2015 and will be filled based on the results of civil
service promotional testing.
The adopted budget also included funding for 10 additional tested-rank positions (six Corporal/Detectives,
three Sergeants, and one Lieutenant) to provide proper span of control when the first wave of Sixth Patrol
Division is staffed. Those 10 supervisory positions are not needed until the associated Police Officer
positions get filled. Staff will bring forward an MC and ordinance to add the positions when the next
academy class nears graduation.
Approval of the attached ordinance would result in new authorized civil service staffing levels as follows:

NOTE - The position changes at issue in this M&C and ordinance do not in any way affect the civil service
positions that were added in connection with the receipt of the COPS Hiring Program Grant (M&C C-
27135).
As noted above, in addition to the civil service positions described herein, the adopted Fiscal Year 2016
Budget included funding for two new civilian positions in the Police Department. No further City Council
action is required with respect to those positions, which will be available on October 1, 2015 when the new
budget goes into effect.
