BE IT ORDAINED BY THE CITY CGUNCIL 4F THE CITY GF FGRT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010, there shall also be increased appropriations in the State Highway 121T Southwest Parkway Fund in the amount of $140,286.54, from available funds, for the purpose of funding pavement and drainage construction on Edwards Ranch Road, Phase II. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.18809and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. A SECTION 4. This ordinance shall take effect upon adoption. Lacy Company, Ltd., for Pavement and Drainage Construction on Edwards Ranch Road, Phase Ii; Accept $144,286.54 from Edwards Geren Limited for Developer's Cost Share and Adopt Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Authorize acceptance of funds from Edwards Geren Limited in the amount of $144,286.54 for developer's cost share of Change Order; 2. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the State Highway 121 T Southwest Parkway Fund by $144,286.54 from available funds; and 3. Authorize Change Order No.1 in the amount of $229,463.48 to City Secretary Contract No. 38612 with L.H. Lacy Company, Ltd., thereby revising the to#al cost to $4,161,232.11. DISCUSSION: The 2004 Capital Improvement Program included funds for the City of Fort Worth's (City) share of costs for the State Highway 121 (Southwest Parkway) project. Subsequent funding was included in the 2007 Critical Capital Projects approved by Council in December 2006. On December 1, 2444, ~M&C C-20431, as amended on April 26, 2445, M&C C-24685} the City authorized an Infrastructure Development Agreement Agreement}with Edwards Geren Limited EGL}, City Secretary Contract No. 31149, under which the City will fund and construct certain infrastructure related to the development of Southwest Parkway. These infrastructure improvements provide for water, sewer, paving and drainage improvements on the Edwards Ranch development. As part of the Agreement with EGL, the City escrowed funds for the design and construction of the identified improvements to ensure adequate funding was available. On May 12, 2449, ~M&C C-23494} City Council authorized the award of a contract to L.H. Lacy Company, Ltd., for Edwards Ranch Road, Phase II, paving and drainage improvements. Change Order No. 1 includes quantity adjustments for paving and storm drainage. A portion of the storm drainage design was revised to enhance the future adjacent development by EGL and satisfy Tarrant Regional Water District permitting requirements at the outfall to the Trinity River. The pavement design has been modified to ensure continuity with the future State Highway 121. Additionally, unsuitable roadway material was discovered during construction which must be removed and replaced with acceptable fill material. EGL will deposit $140,286.54 into the escrow account for the project. Accordingly, after the execution of this change order with L.H. Lacy Company, Ltd., the City will withdraw the sum of $140,286.54 for the construction of the improvements associated with this change order. The net effect of the proposed change order is as follows: original Contract Amount Change order No.1 Revised Contract Amount $3,931,169.09 229 463.08 $4,161,232.17 L.H. Lacy Company, Ltd., is in compliance with the City's MMJBE Ordinance by committing 11 percent MIVVBE participation on this Change Order No.1.The City's goal on this Change order is 10 percent. This project is located in COUNCIL DISTRICT 3, Mapsco 14V,14Z, l5S and 15W.
