AN ORDINANCE VACATING A 12 FOOT WIDE BY 196 FOOT LONG
ALLEY FROM A POINT AT THE EAST RIGHT-OF WAY LINE OF PHOTO
STREET TO A POINT IN THE WEST BOUNDARY LINE OF BLOCK B OF
THE SPRING PARK ADDITION AND BEING ADJACENT TO LOTS 1 5
AND 6-10, BLOCK 9 OF THE BROOKLYN HEIGHTS ADDITION TO THE
CITY OF FORT WORTH, TARRANT COUNTY TEXAS, AS RECORDED IN
VOLUME 63, PAGE 13 OF THE PLAT RECORDS IN TARRANT COUNTY
TEXAS, PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS, REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That a 12 foot wide by 196 foot long alley from a point at the east nght-of--way lute of
Photo Street to a point in the west boundary lute of Block B of the Spring Park Addition and
being adjacent to Lots 1 5 and 6-10, Block 9 of the Brooklyn Heights Addition to the City of Fort
Worth, Tarrant County Texas, as recorded in Volume 63 Page 13 of the Plat Records in Tarrant
County Texas, containing 2352 square feet, more or less and as more specifically described in
Exhibit A `B" and `C" attached hereto and incorporated herein by reference, be and the same
is vacated and extinguished.
SECTION 2.
That existing utility easements shall be retained by the City until such tune all utilities located
in that easement are relocated at the owner's expense.
SECTION 3.
That the fee to the land in the above-described street rights-of way ~s released and shall revert
to the adjacent owner as provided by law
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating a 12-foot wide by 196 foot
long alley from a point at the east right-of-way line of Photo Street to a point in the west boundary line of
Block B of the Spring Park Addition and being adjacent to Lots 1 5 and 6-10 Block 9 of the Brooklyn
Heights Addition to the City of Fort Worth Tarrant County Texas, as recorded in Volume 63 Page 13 of the
Plat Records in Tarrant County Texas, containing 2352 square feet, more or less.
DISCUSSION
David Reeves of Grant Engineering acting on behalf of Mike Waltrip with LSP Locke St LC Mr Malcom
Gorrie with Catholic Diocese of Fort Worth and Mr Robert Pulido with Pulido s Mexican Restaurant,
owners of adjacent property has requested vacation of the above referenced alley in order to include a
portion of the property within a replat for development. The remainder is to be conveyed to the adjacent
lots and replatted at a future time
The Engineering Department, Real Property Services Division states that the purchase fee of $100 00 has
been received
Reviewing City departments and public utility companies have raised no objections to this request. The City
Plan Commission recommended approval of this request at its meeting on May 25th 2005 Any existing
utilities will be relocated at the applicant's expense
This request is located in COUNCIL DISTRICT 9
