HomeMy WebLinkAboutOrdinance 16450-05-2005ORDINANCE NO ~ ~~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $5,000,000.00 SUBJECT TO RECEIPT OF A GRANT FROM U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) FOR THE PURPOSE OF FUNDING A LEAD HAZARD REDUCTION DEMONSTRATION PROGRAM, PROVIDING FOR A SEVERABLILITY CLAUSE, MAKING THIS ORDINANCE CUMULATNE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTNE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Yeaz 2005/06 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $ 5,000,000.00, subject to receipt of grant from U.S. Department of Housing and Urban Development for the purpose of funding a Lead Hazard Reduction Demonstration Program. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shalt be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect froin and after the date of its passage, and it is so ordained. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by up to $5 000 000 subject to receipt of the grant; 3 Certify that the activities to be funded with the grant are consistent with the City's Consolidated Plan and 4 Authorize the City Manager to enter into agreements or amend such agreements with the Tarrant County Public Health Department, the Fort Worth Housing Authority the City of Denton area non-profit housing organizations and other entities as may be necessary and appropriate within the scope of the program and in compliance with applicable laws and regulations. DISCUSSION The U S Department of Housing and Urban Development has issued a Notice of Funding Availability for competitive grant funds under several programs, including the Lead Hazard Reduction Demonstration Grant program The Housing Department is eligible to apply for up to $4 000 000 under this program to expand the number of potentially hazardous housing units that can be made lead-safe The department previously implemented a similar program (Area Lead Education Reduction and Training -ALERT) for which additional grant funds are also being sought. Treatment of lead-based paint in conjunction with housing rehabilitation activity is important to public health because lead-based paint in older deteriorated housing stock has been found to be the primary cause of elevated blood lead levels among small children Elevated blood lead levels (EBLL) in children under 6 years of age are a particular public health concern as EBLLs can have significant negative impacts on cognitive and behavioral development, with consequent long-term effects on productivity and future. earnings Children at highest risk for having high blood levels are those living in housing built before 1946 from low income and minority households. Analysis of data on the locations of EBLL children in Fort Worth provided by the Tarrant County Health Department, indicated that a significant portion of these children reside in the south southeast and northside sectors of Central City Fort Worth According to the Texas Department of State Health Services, 136 children were found to have unacceptably high levels of Logname OSLEAD DEMO Page 1 of 2 blood lead of a total of 5085 children tested in 2003 Lead was a primary component of house paint through 1950 and was not banned for use in household paints until 1978 Crumbling or flaking lead-based paint is a source of lead dust, which can be ingested by small children through their frequent hand-to-mouth activity Housing is generally made lead-safe through use of interim controls acost-effective treatment consisting of encapsulation of lead-paint surfaces and replacement of components such as doors and windows which have friction surfaces that can create lead dust. The average cost of treating homes in .Fort Worth has been approximately $8500 per unit. The Housing Department was able to clear a total. of 313 housing units with previous years ALERT grant funding Because HUD has implemented requirements for treatment of lead-based paint in older housing units receiving HUD-funded rehabilitation services the per-unit-cost of such rehabilitation has consequently increased Also analysis of address data for EBLL children and review of data regarding the age of housing stock in the Central City indicates that there is extensive need for additional lead hazard reduction activities. In addition to the full integration of lead hazard control activities into the City's housing rehabilitation programs (Weatherization Emergency Repair Cowtown Brushup and Home Improvement) funds are needed to expand the lead hazard reduction effort to Fort Worth s over 17 000 pre-1940 housing units, many of which may be deteriorated and 31 % of which are occupied by renters. Lead Hazard Reduction Demonstration Grant funds must be targeted toward the direct costs of lead hazard control with only 10% allowed for administrative costs. Included in the total is a 25% 'in-kind" match requirement. This match will be met with funds from the Emergency Repair Weatherization and Cowtown Brush-up programs as well as from program partners.
