COUNTY OF TARRANT $
WHEREAS, the City of Fort Worth (City) and TranSystems
Corporation Consultants, (Engineer) made and entered into City
Secretary Contract No. 28436, (the Contract) which was authorized
by the City Council by M&C C-19457 on the 4th day of February
2002, and subsequently revised by two previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Berry Street
Streetscape Project from Waits Avenue to Forest Park Blvd.
WHEREAS, it has become necessary to execute Amendment No. 3
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated December 10, 2003, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $20, 285 . 00 .

Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $307, 631.20.
3 .
All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Change in Scope —Additional Fee
Dear Mr. Domenech,
As per the Cities request to expand the scope of the project, we are requesting
an additional fee of $20,285.00 dollars. TranSystems is preparing this
amendment for additional fee to the original contract. The additional work is
outlined below:
1. Sidewalk reconstruction for the south sidewalk of Berry Street between
McCart and Forest Park that is a continuation of the current design for the
project limits.
2. Lighting and Electrical design for the south side of Berry Street between
McCart and Forest Park that is a continuation of the current design for the
project limits.
3. Hardscape design for the south sidewalk of Berry Street between McCart
and Forest Park that is a continuation of the current design including
planting areas, sidewalk pavers design crosswalks, signage and
wayfinding.
4. Landscape design for the south sidewalk of Berry Street between McCart
and Forest Park that is a continuation of the current design.
Original Contract Fee $262,376.00

Executed Amendment No. 2 (SUE) $ 18,370.20

RE: DESIGN FEE AMENDMENT NO. 3, BERRY STREET STREETSCAPE
PROJECT FROM WAITS AVENUE TO FOREST PARK, DOE NO. 4227,

The proposed amendment will allow TranSystems Corporation Consultants to provide addi-
tional engineering services on the project as requested by the City.
During the course of design, the City requested that TranSystems Corporation Consultants
augment the limits of the project to include the south side of Berry Street between McCart
and Forest Park. The original limits included the northern portion of Berry Street but ex-
cluded the southern segment due to budgetary limitations.
Amendment No. 1 provided compensation for the services of a professional geotechnical en-
gineering firm to carry out subsurface testing and make recommendations to aid in the design
of the new pavement on Berry Street, in compliance with the Texas Department of Transpor-
tation.
Amendment No. 2 allowed TranSystems to hire a sub-surface utility contractor to determine
the exact location of underground utilities in order to avoid costly delays and additional costs
associated with encountering conflicts during the construction phase.
TranSystems Corporation Consultants has requested a fee of $20,285.00 for the additional
services to be provided thereby increasing the contract fee from $287,346.20 to $307,631.20.
I believe this fee is fair and reasonable for the additional services to be provided.
Please authorize this additional design fee by your signatures on the attached contract
amendment form.
