HomeMy WebLinkAboutOrdinance 18893-11-2009Grdinance No. 18893-11-2009 AN GRDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPRGPRIATIGNS IN THE ENVIRGNMENTAL MANAGEMENT PRGJECT FUND IN THE AMGUNT GF $440,000.00, FROM AVAILABLE FUNDS FGR ENVIRGNMENTAL AND ENGINEERING CGNSULTING SERVICES; PRGVIDING FGR A SEVERABILITY CLAUSE; MAKING THIS GRDINANCE CUMULATIVE GF PRIGR GRDINANCES AND REPEALING ALL PRIGR ORDINANCES IN CGNFLICT HEREVIIITH; AND PRGVIDING AN EFFECTIVE DATE. BE IT GRDAINED BY THE CITY CGUNCIL GF THE CITY CF FORT WGRTH, TEXAS: SECTIGN 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2014 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Management Project Fund in the amount of $400,000.00, from available funds, for environmental and engineering consulting services. SECTIGN 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTIGN 3, That this ordinance shall be cumulative of Grdinance No.18809and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTIGN 4. This ordinance shall take effect upon adoption. Authorize the transfer of $400,000.00 from the Environmental Management Operating Fund to the Environmental Management Project Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund in the amount of $400,000.00 from available funds; and 3. Authorize the City Manager to execute a contract with Enercon Services, Inc., for environmental and engineering consulting services not to exceed $400,000.00. The contract services will be performed on an as-needed basis for a period of one year with two one year renewal options. DISCUSSION: The City's compliance with state and federal environmental regulations for the Clean Air Act, Clean Water Act, hazardous waste issues, the City's petroleum storage tank remediation program and other environmental projects requires that the various projects be completed in a timely manner. To facilitate the City's compliance, the services of an environmental and engineering consulting firm are required. The City has contracted for environmental and engineering services since 1989. fiver the years, services have included oversight of various site cleanupslclosures, upgrade and replacement of City-owned underground storage tanks, groundwater monitoring at contaminated sites, site assessments, corrective action plans, reviews of various structural storm waterlflood control devices, spill prevention control and countermeasures plan preparation, review and certification, remediation system design, air modeling, air sampling and coordination with the State to develop clean-up strategies. Projects planned for the coming year include Voluntary Cleanup Program (VCP) site assessments, monitoring and reporting to the Texas Commission on Environmental Quality at two actives sites, Texas Risk Reduction Program (TRRP) and former Leaking Petroleum Storage Tank (LPST) site assessments, monitoring and reporting to the TCEQ at four active sites, professional consulting on the State Highway 121 T and Trinity River Vision projects and other projects as they arise during the course of business. The qualifications packages were evaluated based on apre-determined combination of qualitative and quantitative point} measures. These measures included, but were not limited to, experience, qualifications, legal history and work history. Based on the total point distribution of the measures, two firms were selected to make oral presentations. City staff recommends the contract be awarded to Enercon Services, Inc., because of their broad experience and innovative approach to solving environmental issues. Their experience includes: . Extensive knowledge of the Texas Risk Reduction Program ~TRRP}and Petroleum Storage Tank PST} rules and regulations; . Numerous Voluntary Cleanup Program ~VCP}and Innocent OwnerlOperator Program ~IOP} site applications, assessments, monitoring efforts andlor closures; . Phase l ESA work on commercial, industrial, residential and undeveloped lands; . Phase ll ESA work including soil, water and air sampling for a range of contaminants including, but not limited to, volatile organic compounds, hydrocarbons, metals, pesticides, herbicides, etc.; • Spill Prevention Control and Countermeasure NSPCC} Plan and Stormwater Pollution Prevention Plan ~SWPPP}development and implementation; . National Environmental Protection Act ~NEPA} Categorical Exclusion and Environmental Assessment work including report preparation, submittal and approval with the applicable federal agency; and . Air pollution experience including emissions source testing and calculation for compliance with and development of, air permit information. RENEWAL OPTIONS -This contract may be renewed for up to two successive one year terms at the City's option. Renewal may be effective by notice in writing by the City Manager, or his designee, to the contractor within 30 days of the expiration of the prior term. This action does not require specific City Council approval, provided that the City Council has appropriated sufficient funds to satisfy the City's obligations during the renewal term. Enercon Services, Inc., is in compliance with the City's MIWBE Ordinance by committing to 15 percent MIVIIBE participation. The City's goal on this project is 15 percent.
