AN ORDINANCE PROHIBITING THE PARKING OF A VEHICIE ON THE STREETS OF THE CITY OF FORT WORTH FOR LONGER THAN TWO (2) HOURS; MAKING THE OWNER OF THE VSSICIE PRIMA FACIE RESPONSIBIE FOR VIOLATIONS; DEFINING TERNS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT HERSAIITH; PROVIDING A PENALTY FOR THE VIOLATION HEREOF; AND PROVIDING THE EFFECTIVE DATE HEREOF. WHEREAS, serious oongestions of traffic, automobile collisions and personal injuries resulting therefrom are iminent in the City of Pbrt Worth and its suburbs on account of the hazards created by the parking of large vehicles on the streets of the City of Fort Worth, and immediate regulation is required for the greater protection of the public in general to minimize and eliminate said hazards; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT WORTH: SECTION I. The following definitions are hereby adopted and declared for the construction of this ordinance: a. The word "street" shall mean and embrace every way or place of whatever nature open to the use of the public, as a matter of right, for purposes of vehicular traffic, and shall include the parkways adjacent to the traveled portion of such ways; said word "street" shall be construed as including all the traveled way and all the adjacent parkways, extending from private property line to private property line. b. The word "vehicle" shad mean all trailers, buses, trucks, vans, and other types of trackless conveyances, which area 1. More than 20 feet in length from bumper tip to bumper tip; or 2. More than 7 feet in width at their widest point; or 3. More than 7 feet in height at their highest point. c. The word "Park" shall mean the stopping of a vehicle, whether occupied or not, upon a street, as defined above, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading or in obedience to traffic signs or signals. SECTION II. It shall be unlawful for the driver or owner of any vehicle to park said vehicle or permit the same to be parked, stand or remain motionless for a period in excess of two (2).hours on any street within the corporate limits of the City of lbrt worth. SECTION III. If any vehicle is found upon a street or highway in violation of the provisions of this ordinance and the identity of the driver cannot be determined, the owner or the person in whose name such vehicle is held shall be held prima facie responsible for such violation. SECTION IP. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Fort worth affecting traffic on its streets and shall not operate to repeal or affect any such ordinance or ordinances, except in so far as the provisions of such ordinance or ordinances are in conflict with the provisions of this ordinance, in which instance or instances such conflicting provisions shall be and are hereby repealed. SECTION V. Any person violating any of the provisions of this ordinance shall, upon conviction thereof, be fined in any sum not to exceed Two Hundred and no/lOO Dollars ($200.00), and each violation thereof shall be and is hereby declared to be a distinct and separate offense and punishable as such. SECTION VI. This ordinance shall take effect, and be in full force and effect, from and after its passage and publication as provided by law. APPROVED AS TO FORK: Q&Z -°Q Assistant City Attorney
