AN ORDINANCE AMENDING THE CODE OF THE CTI'I' OF FORT
WORTH (198, AS AMENDED, CHAPTER 13, `FIRE PROTECTION AND
PREVENTION" ARTICLE II, `FIItE DEPARTMENT" DIVISION I
"GENERALLY" SECTION 13-23 `EXECUTIVE DEPUTY CHIEF" TO
INCREASE THE PAYMENT OF ASSIGNMENT PAY RATE FOR THE
EXECUTIVE DEPUTY CHIEF IN THE FIRE DEPARTMENT PROVIDING
THAT THIS ORDINANCE IS CUMULATIVE, AND PROVIDING AN
EFFECTIVE DATE.
BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS
SECTION 1.
That Chapter 13 "Fire Protection and Prevention" Article II, "Fire Department" Division I,
`Generally" Sec. 13-23 "Executive Deputy Chief' subsection (b), of the Code of the City of Fort
Worth (1986), ~ hereby amended to increase the assignment pay and shall read as follows:
`(b) The officer who performs the above specialized functions shall
receive the sum of five hundred ($500.00) per month as assignment pay Such
payment shall be in addition to the officer's regular pay
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City
of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of
such ordinances and such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitutional by the valid ~udgrnent or
decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any of the
remauung phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would
have been enacted by the City Council without the incorporation m this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
This ordinance shall be in full force upon adoption.

RECOMMENDATION
It is recommended that the City Council adopt the ordinances amending Chapter 13 and 27 of the Code of
the City of Fort Worth Texas (1986) providing for a increase in the payment of assignment pay for the
Deputy Chiefs who are assigned by the Chiefs of Police and Fire as the Executive Deputy Chiefs.
DISCUSSION
Section 143 042 of the Local Government Code of the Police and Fire Civil Service Act permits the City
Council to authorize assignment pay for police officers and firefighters performing specialized
functions. The amount of assignment pay must be established by ordinance and is in addition to the police
officers and firefighters' regular pay Such an ordinance may set criteria that provides for payment only to a
:police officer or firefighter on a special assignment.
On January 3 1985 (M&C G-6211) the City Council approved an ordinance establishing assignment pay
for the executive deputy chiefs of the Police and Fire Departments at a rate of $275 per month or $3 300
annually This rate has not been increased in 20 years City staff recommends that assignment pay for
the Executive Deputy Chiefs for the Police and Fire Departments be increased to $500 per month in order
to reflect the responsibilities of the position and to keep pace with current pay schedules This change will
impact two employees the Executive Deputy Fire Chief and the Executive Deputy Police Chief Both
Executive Deputies assume the responsibility of the Chief position and their respective departments in the
absence of the Fire or Police Chief
