AN ORDINANCE APPROVING THE REPORT OF THE DEPARTN.ENT OF PUBLIC WORKS: AWARDING THE CONTRACT FOR THE IM- PROVEMENT OF A PORTION OF WEST TENTH STREET IN THE CITY OF FORT WORTH, TEXAS, AIM AUTHORIZING ITS EXE- CUTION: MAKING APPROPRIATION FOR THE INDEBTEDTYESS INCURRED THEREBY: AND DIRECTL7G THE CITY ZYGINEER TO PREPARE ESQ TIMATES. WHEREAS, on the 24th day of November, 1948, by Ordinance passed and approved by the City Council of the City of Fort Worth being Ordinance No. 2614, the City determined the necessity for and ordered the improvement of a portion of West Tenth Street, to wit: WEST TENTH STREET from the easterly line of Penn Street to the west- erly line of Cherry Street, save and except the intersection of Henderson Street. WHEREAS, subsequent to the passage and approval of said ordinance, plans and specifications for said improvements were submitted by the City Engineer and said plans and specifications were approved and adopted by the City Council; and, WHEREAS, notice to bidders was given as required by the City Charter; and, WHEREAS, the Bid of Brown and Root, Incorporated, was found to be the lowest and best Bid for the making and construction of said improvements, to-wit, excavating present street, placing thereon a two inch compacted gra- vel foundation course, and paving with 6 inches of reinforced concrete base and 1i inches of Asphaltic Concrete Surface with combined concrete curb and gutter, together with incidentals and appurtenances, all as provided by said Plans and Specifications; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the work of making and constructing such improvements and contract therefor is hereby awarded to Brown & Root, Incorporated, at and for the prices stated in the proposal of the said company and as reported and recommended by the Department of Public Works. The Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City thereon, the said Con- tract embracing therein, among other things, the prices for the work. e ra, Z SECTION 2. That to provide for the pabmeat of the indebtedness incurred by the City of Fort Worth, by said contract, there is hereby appropriated out of available funds which have been set aside for said purpose, an amount sufficient to pay said indebtedness so incurred. SECTION 3. That the City Engineer of the City of Fort Worth be and he is here-- by ordered and directed to file with the City Council estimates of the costs of such improvements in accordance with the terms of the powers and provisions of Chapter 106 of the acts of the First called Session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernonts Civil Statutes of the State of Texas Annotated, which law has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth. APPROVED AS TO FORM: CITY ATTOMUZ TO THE CITY COUNCIL OF THE CITY OF FORT WORTH, TIMAS: Referring to the Report of the Department of Public Works in connection with Bids for the improvements of West Tenth Street, from the easterly line of Penn Street to the westerly line of Cherry Street, save and except the intersection of Henderson Street, in the City of Fort Worth, Texas, and to the proposed contract therefor, it appears that the amount which the City will pay in connection with such Contract and improvements is the sum of Fifty—Five Thou— sand Dollars ($55,000.00). I do hereby certlfy to the City Council of the City of Fort Worth that the money required for such Contract and expenditures which will be incurred thereby is in the treasury to the credit of the Street Improvement Fand and not appropriated for any other purpose.
