KNOW ALL MEN BY THESE PRESENTS §
COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth is a home-rule city lying and being
situated within the Counties of Tarrant and Denton, State of Texas; and
WHEREAS, the City of Justin is a general law city lying and being situated
within the County of Denton, State of Texas; and
WHEREAS, it is in the best interest of both the City of Fort Worth and the
City of Justin, that certain unincorporated areas within the extraterritorial
jurisdictions of the two cities be exchanged and that a common extraterritorial
jurisdictional boundary line between the two cities be established; and
WHEREAS, the City of Fort Worth and the City of Justin desire to fix and
establish a common boundary line and to exchange certain portions of
extraterritorial jurisdiction between the two cities;
NOW, THEREFORE, BE IT RESOLVED AND MUTUALLY AGREED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH AND THE CITY COUNCIL OF THE CITY OF JUSTIN:
SECTION 1.
THAT the establishment, determination and fixing of a mutual common
boundary line and the exchange of certain portions of extraterritorial
jurisdiction between the City of Fort Worth and the City of Justin,ara-4in'° `h

SECTION 2.
THAT the City of Fort Worth and the City of Justin do hereby agree to the
boundary alignment and exchange of extraterritorial jurisdiction as reflected on
Exhibit "A" attached hereto and described as follows:
BEGINNING at the intersection of the west line of the W.E. Patterson 63.31
acre tract, and the Extraterritorial Jurisdiction (ETJ) limits of the City of
Fort Worth, Texas, lying North 1,340 feet from the north right-of-way line of
F.M. No. 407;
THENCE along the west line of said Patterson tract, South 1,440 feet to a
point in the south line of F.M. No. 407;
THENCE along the south right-of-way line of F.M. No. 407, East 1 ,530 feet
to the northwest corner of the Margaret Robinson 43.31 acre tract, also being the
east line of the C.W. Lee 103.21 acre tract;
THENCE along the common line of said Robinson and Lee tract, South 3,530
feet to the southeast corner of said Lee tract, and continuing in all 5,370 feet
to a point in the north line of the Olen Range 82.99 acre tract, also being the
south right-of-way line of a road;
THENCE along the north line of said Range tract, East 1,300 feet to its
northeast corner, also being the northwest corner of the W.T. Cunningham 10.00
acre tract;
THENCE along the common line of said Range and Cunningham tracts, South
1,840 feet to the southwest corner of the Cunningham tract;
THENCE along the south line of said Cunningham tract, east 100 feet to the
northwest corner of the Sam Hardeman 60.00 acre tract;
THENCE along the west line of said Hardeman tract, South 1,;30" to

THENCE along the south line of said Hardeman tract East 1,960 feet to a
point in the east right-of-way line of Boss Range Road;
THENCE along the east right-of-way line of Boss Range Road, North 830 feet
to the southwest corner of the Z. Truman Wood 64.74 acre tract;
THENCE along the south line of said Wood tract, East 1 ,470 feet to its
southeast corner also being in the west line of the Howard Dudley 56.477 acre
tract;
THENCE along the west line of said Dudley tract, South 490 feet to its
southwest corner;
THENCE along the south line of said Dudley tract, East 1,120 feet to a
point in the easterly ETJ limits of the City of Justin, Texas, also being the
westerly ETJ limits of the City of North Lake, Texas.
THE City of Fort Worth and the City of Justin do hereby covenant and agree
to protect, preserve and defend the hereinabove described boundary alignment and
exchange of extraterritorial jurisdiction.
SECTION 3.
THAT the City of Fort Worth does hereby relinquish all extraterritorial
jurisdictional rights it may have in all territory lying to the east and north
of the hereinabove described line.
SECTION 4.
THAT the City of Justin does hereby relinquish all extraterritorial
jurisdictional rights it may have in all territory lying to the west and south
of the hereinabove described line.
RECORD
SECTION 5.
THAT the exchange of extraterritorial jurisdiction and the delineation of
the above described line between the City of Fort Worth and the City of Justin
are shown on Exhibit "A" , a map which is attached hereto and expressly
incorporated herein.
SECTION 6.
THAT the City of Justin agrees that at such time as it annexes territory
within the extraterritorial jurisdiction released hereunder by the City of Fort
Worth, the extraterritorial jurisdiction of the City of Justin will not be
expanded by reason of such annexations.
SECTION 7.
THAT this Joint Resolution and Agreement shall become effective and binding
upon the City of Fort Worth and the City of Justin by the adoption of same in
regular open City Council meeting of the City of Fort Worth and the City of
Justin.
SECTION 8.
THAT this Joint Resolution and Agreement, upon adoption of both cities,
shall be executed in several originals. A copy of this Joint Resolution and
Agreement shall be executed by the Mayor and attested by the City Secretary of
each city.

RECOMMENDATION:
It is recommended that the City' Council approve the attached Joint Resolution
Agreement exchanging portions of extraterritorial jurisdictions between Fort Worth and
Justin establishing an extraterritorial jurisdiction boundary line.
DISCUSSION:
Mr. Barry Hudson of Everage Consultants, acting on behalf of the City of Justin, is
requesting an exchange of portions of extraterritorial jurisdiction (ETJ) with Fort
Worth® At the present time, Fort Worth's five mile ETJ boundary and sin's one-half
mile ETJ boundary are contiguous along a series of arcs in southern Denton County. The
proposed joint resolution and agreement utilizes existing property lines and county
road rights -of-a rights-of-way to establish a more practical common boundary. As proposed, Fort
Worth would release approximately 62.02 acres of extraterritorial jurisdiction to
Justin in turn Justin would release approximately 61.57 acres of x raterrit ri

equal and all county road rights-of-way utilized as common boundary would be released
to si . This would exclude the City of Fort Worth from uur road maintenance,
traffic control , and liability responsibilities in these areas. The City Plan
Commission approved this request, as amended by the DRC, on September 25, 1991,. I
addition, the City Plan Commission recommended that no land released by Fort Worth
would utilized by Justin to extend Justin's ETJ in the future. The City of Justin
has acknowledged these recommendations and concurs.
