C0I1.0ANT FOR TFE CONSTRUCTION OF SAID INlPROVEI=TTS FULLY 001,PLFTED ArD PERFOR1EM; DIRECTING THE ISSTJVTCE, ELUTION AFT DMIVERT OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSDZF7S LEVITM AFTER GIVIr_G EFFECT TO SUNDRY CREDITS 7MIN AUTHORIZED A"D ALLO1M AGAINIST SOME OF SAID ASSESS2M TS; DI?F,CTIrG TPE CITY SECFETARY TO EUGROSS A"D ENROLL THIS ORDITrAYCE BT COPYIN?G THE CAPTION OF SAIIE IN T73 MINUTE BOOB OF TRE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE CO14PLETE ORDINANdCE IN APPROPRIATE ORBINAT_TCE RE- CORDS OF SAID CITY; AIfD PRCVIDING AN EFFECTIVE DATE. tsHXREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Worth Construction Company for the making and construction of certain street improvements on the hereinafter described portions of streets in said City, to-wit: 1. Ellis Avenue From the northerly line of 20th Street to the southerly line of 23rd Street known and designated as Unit No. 1. 2. Ellis Avenue From the northerly line of 25th Street to the southerly line of 28th Street known and designated as Unit No. 2. 3. Tventy-Sixth Street From the easterly line of Clinton Avenue to the westerly line of North blain Street known and designated as Unit No. 3. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 4559, a portion of the cost of said improvements was levied and assessed against the respective properties abut- ting on each of the above described portions of streets, ^venues and public places and against the real and true owners thereof; and, 117B'PYAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instPnces, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4559, and, WEERW, the street improvements hereinabove mentioned have been com- pleted upon each of the portions of streets, avenues and public places hereinabove des- cribed, and have been inspected and found to be in complete accordance with the contract therefor; Nola, THEREFORE. EE IT ORDAINED BT THE CITY COUNCIL OF TTTE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and pub- lic places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the s-Decial assessments levied against abbutting property and the owners thereof for such improvements, and the City Secrets- is directed to attest same end impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The -1- certificates shall be numbered, shall describe the property against which the assess- ment has been levied, shall, where known, state the npme or names of the true owners of the respective parcels of property assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descrivtior_s to be shown on the respective certificates, together with the n.-mes of the owners of said property, the principal amount of the assessment, the respective credits, if any, which are hereby Authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount of which each certificate is to be issued after giving effect to such credit, if any, ere hereby enumerated and itemized as follows: III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector for Collection. IP. The City Secretary is hereby directed to engross and enroll this ordinQnce by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City.
