AN ORDINANCE AMENDING CHAPTER XIV OF THE
CODE OF THE CITY OF FORT WORTH, BY PRO-
VIDING FOR THE ISSUANCE ON A RECIPROCAL
BASIS OF ELECTRICIAN'S LICENSES TO APPLI-
CANTS BOTH HOLDING LICENSES ISSUED BY
ANOTHER CITY FOLLOWING THE PASSING BY
SUCH APPLICANTS OF WRITTEN EXAMINATIONS
EQUIVALENT TO THE WRITTEN EXAMINATIONS
REQUIRED BY CHAPTER XIV FOR THE GRADE
OF LICENSE SOUGHT AND SATISFYING LICEN-
SING REQUIREMENTS OF CHAPTER XIV, EXCEPT
THE REQUIREMENT OF TAKING A WRITTEN EXA-
MINATION THEREUNDER; PROVIDING A SEVERA-
BILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF OTHER PROVISIONS OF THE
CITY CODE; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; PROVIDING A PENALTY;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 14-41, Chapter XIV, of the Code of
the City of Fort Worth. be and the same is hereby
amended to read as follows:
"Sec. 14-41.
"Every person desiring to engage in any
business or perform any work for which a li-
cense is required under the provisions of this
chapter shall appear before the electrical
board and pass an examination as to his quali-
fications and competency for the grade of li-
cense desired by him as required by the provi-
sions of this chapter. It is provided, however,
that in lieu of taking the written examination
required by this chapter with regard to the
grade of license sought, an applicant who satis-
fies all other licensing requirements in this
chapter and who holds a valid electrician's
license or certificate of registration
issued to him by another city may comply
with Section 14-50.1 hereof and be is-
sued a license under this chapter with-
out taking such written examination."
SECTION 2.
That Chapter XIV of the Code of the City of Fort
Worth. be. and the same is hereby amended by adding
thereto Section 14-50.1 reading as follows:
"Sec. 14-50.1.
"This section provides a procedure
whereby the holder of an electrician's
license or certificate of registration
issued by another city upon his having
made a passing grade on a written exami-
nation may be issued an electrician's
license on a reciprocal basis under this
chapter without having to take and pass
the written examination provided by
this chapter for such license. A person
holding a valid electrician's license
or certificate of registration issued
by another city may apply for a master
electrician's license or a journeyman
electrician's license under this chapter
by filing a written application therefor
with the secretary of the electrical
board and by submitting therewith evi-
dence that he holds such valid license
or certificate and that same was issued
following his having made a passing
grade on a written examination conducted
by the licensing or certifying city. If
the applicant shall have satisfied all
licensing requirements of this chapter
save and except that of taking a written
examination hereunder, and if the elec-
trical board shall have received evidence
satisfactory to it that (a) both the writ-
ten examination previously taken and
passed by the applicant and the procedures

relating to such examination are rea-
sonably equivalent to the written exa-
mination for the grade of license
sought under and the examination pro-
cedures required by this chapter, and
(b) the applicant's performance no the
written examination would have consti-
tuted e passing grade under the provi-
sions of this chapter had such examina-
tion been administered bereuuder, then the
electrical board shall certify to the chief
electrical inspector that the applicant may
receive the license sought without taking
the written examination required by this
chapter. nDno such certification and the
payment of the fee prescribed in this
chapter for such license, and the filing
of a bond in cases where a bond is required
the applicant shall be issued a license of
the grade for which be has been certified,
which license shall be signed by the chief
electrician. It is provided, however, that
a license abaII not be issued under this
section unless the other city from which
the applicant holds a valid license or
certificate permits holders of electrician's
licenses issued under this chapter to re-
ceive equivalent licenses from such city on
a reciprocal basis and without an additional
written examination."

That if any section, subsection, seoteuce, cIause 'or
phrase of this ordinance is for any reason held to be
unconstitutional, such holding shall not affect the va-
lidity of the remaining portions of this ordinance, and
all of the remainder of this ordinance not so held to be
unconstitutional shall continue to be in full force and
effect'

That this ordinance shall be and is hereby declared
to be cumulative of the pconiaiuoe of the code of the
City of port wortb' and amendments thereto, regulating
the performance of electrical work for which a license
is required and the granting of electrician's licenses,
except in those instances where the provisions of this
ordinance are in direct conflict with such mode' in
which instances said conflicting provisions of such
Code are hereby repealed.

That any person, firm' association of persons,
company or corporation or their agents, servants or
employees who violate' diauupy, omit, neglect or refuse
to comply with any provision of this ordinance shall be
punished by a fine of not exceeding two hundred dollars
($200,00) , and each day that o violation exists is
hereby declared to be a distinct and separate offense
and punishable such; provided, bowever, if the maxi-
mum penalty provided by this ordinance for any such of-
fense is greater than the maximum penalty provided for
the same or a similar offense under the laws of the
state, tbnu the maximum penalty for violation as pro-
vided by state statute shall be the maximum penalty

under this ordinance, all as provided for in Section
1-5 of Chapter I of the Code of the City of Fort
Worth.
SECTION 6.
That this ordinance shall become effective and
be in full force and effect from and after its pas-
sage and publication as required by law, and it is
so ordained.

It is proposed that the City of Fort Worth enter into reciprocity agreements
with other cities in the area to automatically license upon request electri-
cians wanting to work in Fort Worth who have been licensed in other cities
under equivalent tests.
Licensing of Electricians in Fort Worth
Under Chapter XIV of the Fort Worth Code, all electricians desiring to do
electrical work in Fort Worth must be licensed by the City of Fort iib rth.
Electrician licenses are given by the Fort Worth Electrical Board to appli-
cants who have passed an examination supervised by the Board.
Proliferation of Licensing Agencies
All of the larger cities in the Fort Worth metropolitan area have electrical
ordinances similar to the Fort Worth ordinance. Each of these cities has an
electric board that meets frequently to give tests for issuing various grades
of electrical licenses to applicants who wish to work in them. A license
issued in one city cannot be used in another city.
Reciprocal Testing Program
In order to simplify licensing of electricians who wish to work in Fort Worth,
it is proposed that Chapter XIV of the Fort Worth City Code be amended to
permit electricians holding valid licenses granted by other cities to obtain
a license to work in Fort Worth if his license were granted as the result of
passing an examination equivalent to that required by the City of Fort Worth.
The Fort Worth Electrical Board will determine equivalency of the examinations
and authorize issuance of a Fort Worth license.
The ordinance, as amended, does not change the right of the Fort Worth Electri-
cal Board to accept or reject an applicant but allows it to reciprocate in the
testing procedure with a city that has a test deemed equal to Fort Worth.
Practices of other Cities
Most of the major cities of Dallas County and a few cities in eastern Tarrant
County have reciprocal agreements.
Recommendation
It is recommended that the City Council adopt ordinants@ that has been
