AN ORDINANCE MAKING CERTAIN FINDINGS: PROVIDING FOR THE EXTENSION
OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND
THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 21.4 ACRES OF
LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT
BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT
THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES;
PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES
OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR
ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE
AND NAMING AN EFFECTIVE DATE.
WHEREAS, a public hearing before the City Council of the City of Fort
Worth, Texas, wherein all interested persons were provided with an opportunity
to be heard on the proposed annexation of the territory hereinafter described,
was held at the City Council Chamber in the City Hall of Fort Worth, Texas,
on the 7th day of October, 1968, which date is not more than twenty (20) nor
less than ten (10) days prior to the institution of annexation proceedings;
and
WHEREAS, notice of such public hearing was published in a newspaper
having general circulation in the City of Fort Worth, Texas, and in the here-
inafter described territory on the 25th day of September, 1968, which date is
not more than twenty (20) nor less than ten (10) days prior to the date of such
public hearing; and,
WHEREAS, the population of the City of Fort Worth, Texas, is in excess of
400,000 inhabitants; and
WHEREAS, the corporate area of the City of Fort Worth, Texas, was 197,630
square miles on January 1, 1968, and
WHEREAS, the hereinafter described territory lies within the extraterri-
torial jurisdiction of the City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory lies adjacent to and adjoins
the City of Fort Worth, Texas; and
WHEREAS, the territory hereinafter described contains approximately
21.4 acres;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
The following described land and territory lying adjacent to and adjoin-
ing the City of Fort Worth, Texas, is hereby added to and annexed to the
City of Fort Worth, Texas, and said territory hereinafter described shall
hereafter be included within the boundary limits of the City of Fort Worth,
Texas, and the present boundary limits of said City, at the various points
contiguous to the area hereinafter described, are altered and amended so as
to include said area within the corporate limits of the City of Fort Worth,
Texas, to wit:
Being a portion of Block 5 and a portion of Block 10 of the Shelby
County School Land Survey situated about 9 miles Southerly from the
Courthouse of Tarrant County, Texas, and being more particularly
described as follows:
BEGINNING at a point for corner in the south line of Block 5 of the
Shelby County School Land Survey a distance of 1075 feet North 89
degrees - 47 minutes East from the southwest corner of said Block 5;
such point for corner also being in a former common city limit line
of the City of Fort Worth and the City of Everman as said common city
limit line existed on September 9, 1968.
THENCE North no degrees - 17 minutes West along the said former common
city limit line a distance of 1163.2 feet to a point for corner at the
intersection of said line with the proposed northerly right of way
line of a public street to be known as "Mallick Parkway."
THENCE along said proposed northerly right of way line of Mallick
Parkway, Southeasterly along a curve to the right with a radius of
2082 feet a distance of 427.5 feet to a point for the end of said
curve.
THENCE, continuing along said proposed northerly right of way line,
South 49 degrees East a distance of 357.7 feet to the beginning of
a curve to the left with a radius of 2782.79 feet.
THENCE, continuing along said proposed right of way line, Southeasterly
along a curve to the left with a radius of 2782.79 feet a distance of
1362.2 feet to a point for the end of said curve.

THENCE, continuing along said proposed right of way line: South 77
degrees - 15 minutes East 314.2 feet more or less, to a point for
corner at the intersection of said proposed right of way line with
the hereinabove described former common city limit line of Fort Worth
and Everman, said point for corner also being in the south line of
Block 10 of the Shelby County School Land Survey.
THENCE South 89 degrees - 47 minutes West along the said former common
city limit line of Fort Worth and Everman, in the south lines of
Block 10 and Block 5 of the Shelby County School Land Survey, a
distance of 2124.8 feet to the place of beginning and containing
approximately 21.4 acres of land.
SECTION 2.
The above described territory and the area annexed shall be a part of
the City of Fort Worth, Texas, and the property so added hereby shall bear
its pro rata part of the taxes levied by the City of Fort Worth, Texas, and
the inhabitants thereof shall be entitled to all of the rights and privileges
of all the citizens and shall be bound by the acts, ordinances, resolutions
and regulations of the City of Fort Worth, Texas.
SECTION 3.
That this ordinance shall and does hereby amend every prior ordinance in
conflict herewith, but as to all other ordinances or sections of ordinances
not in direct conflict herewith this ordinance shall be and is hereby made
cumulative.
SECTION 4.
If any section, subsection, clause, sentence, phrase, or word of this
ordinance is for any reason held void or unconstitutional , by a court of
competent jurisdiction, such invalidity shall not affect the validity of
the remaining sections, subsections, clauses, sentences, phrases, or words
except as the same are inseparable from and indispensable to the remaining
portions of the ordinance.

SECTION 5.
This ordinance shall be in full force and effect from and after the
date of its passage on first reading and publication and its passage on
second reading as provided for in Section 40 of Chapter XXVIII of the
Charter of the City of Fort Worth and it is so ordained.

REED The City Council on September 9, 1968, approved a re-alignment of the common
boundary of Fort Worth and Everman to coincide with the north line of Mallick
Parkway (PZ-295) .
As the first step in implementation of the re-alignment, the Council adopted
Ordinance No. 5998, discontinuing 5.8 acres of land from the city limits of
Fort Worth and relinquishing all of Fort Worth's extraterritorial jurisdic-
tional rights, thereby making the 5.8 acres subject to annexation by
Everman.
On September 10, 1968, the Everman City Council adopted its Ordinance No.
140 discontinuing 21.4 acres of land from the city limits of Everman and
relinquishing all of its extraterritorial jurisdictional rights in the area
discontinued, thereby making the 21.4 acres subject to annexation by Fort
Worth.
The two areas involved are shown on the attached map.
A copy of a timetable showing the sequence and timing of the necessary
additional steps is attached.
Recommendation
It is recommended that the City Council adopt a resolution setting October 7,
1968, at 9:30 a.m. as the date and time for the public hearing, and authorize
and direct the City Secretary to publish the notice as required by state law.
