HomeMy WebLinkAboutOrdinance 6714 ORDINANCE NO. 6!7L, AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 6.2 SQUARE MILES OF LAND, WHICH TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRORATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the Municipal Office Building of Fort Worth, Texas, on the 14th day of August, 1972, which date is not more than twenty (20) days nor less than ten (10) days prior to the institution of annexation proceedings, and WHEREAS, notice of such public hearing was published in a news- paper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 2nd day of August, 1972, which date is not more than twenty (20) days nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas is in excess of 390,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 230,517 square miles on January 1, 1972; and WHEREAS, the hereinafter described territory lies within the ex- clusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approx- imately 6.2 square miles of land; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 THAT the following described land and territory, lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the boundary limits of said City, at the various points contiguous to the areas hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: FIRST TRACT BEING portions of the J. Lynch Survey, Abstract No. 942, the P. T. Welch Survey, Abstract No. 1642, the A. C. Warren Survey, Abstract No. 1686, the L. G. Tinsley Survey, Abstract No. 1523, the J. F. Redding Survey, Abstract No. 1304, the E. S. Elliott Survey, Abstract No. 476, the W. R. Reeder Survey, Abstract No. 1303, the J. Brockman Survey, Abstract No. 102, the J. H. Conner Survey, Abstract No. 285, the H. Robinson Survey, Abstract No. 1315, the H. F. Largent Survey, Abstract No. 960, the G. N. Main Survey, Abstract No. 1097, the N. Burton Survey, Abstract No. 244, the W. N. Ray Survey, Abstract No. 1353, the W. C. Trimble Survey, Abstract No. 1521, and the H. P. Tuggle Survey, Abstract No. 1513,'situated about 5 miles northeast from the Courthouse of Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth city limit line, said point for corner being 500 feet west from the center line of Interstate Highway No. I-820, which point for corner is also 2,240 feet east and 3,025 feet south from the northwest corner of the W. C. Trimble Survey, Abstract No. 1521. THENCE along and with the present Fort Worth city limit line as follows: THENCE South, along and with a line 500 feet west from and parallel to the center line of Interstate Highway No. I-820 a distance of 4,755 feet, more or less, to a point for corner 2,500 feet north from the south line of the W. N. Ray Survey, Abstract No. 1353. THENCE West, along and with a line parallel to and 2,500 feet north from the south line of the W. N. Ray Survey 700 feet to a point for corner. - 2 - THENCE South, along and with a line parallel to and 1,200 feet west from the center line of Interstate Highway No. I-820 a distance of 400 feet to a point for corner which is 300 feet north from the north line of the H. Robinson Survey, Abstract No. 1315, produced east. THENCE West, along and with the line parallel to and 300 feet north from the north line of the H. Robinson Survey produced east, approximately 1,660 feet to a point for corner in the west line of the TESCO right-of-way, as described in Volume 1955, Page 60, D.R.T.C.T. THENCE Northerly, along and with the west line of the TESCO right-of- way approximately 1 ,820 feet to a point for corner at its intersection with the center line of Randol Mill Road. THENCE Southwesterly, along and with the center line of Randol Mill Road to a point for corner at its intersection with the west line of the Boaz Estate Tract. THENCE South, along and with the west line of the Boaz Estate Tract approximately 1 ,675 to a point for corner which is 400 feet north of the north line of the E. Jones Survey, Abstract No. 841. THENCE West 1,022 feet to a point for corner in the west line of the J. Brockman Survey, Abstract No. 102 and the east line of the W. L. Tandy Survey, Abstract No. 1538. THENCE North along and with the west line of the J. Brockman Survey and continuing North to a point for corner in the south right-of-way line of Randol Mill Road. THENCE West, along and with the south right-of-way line of Randol Mill Road to a point for corner at its intersection with a line parallel to and 100 feet west of the east line of the W. J. White Survey, produced northerly. THENCE Northerly along and with a line parallel to and 100 feet west of the east line of the W. F. White Survey produced northerly, to a point for corner at its intersection with the middle of the Trinity River. THENCE Westerly along and with the middle of the Trinity River, with its meanders, to a point for corner at its intersection with the west line of the J. Brockman Survey. THENCE Southerly along and with the west line of the J. Brockman Survey to a point for corner 500 feet north from the south right-of-way line of Randol Mill Road. THENCE Southwesterly along and with a line 500 feet northwesterly from the southeasterly right-of-way line of Randol Mill Road to a point for corner at its intersection with the north line of the J. Blackwell Survey produced east. THENCE West to and along and with the north line of the J. Blackwell Survey to a point for corner 700 feet west from the northeast corner of the J. Blackwell Survey. THENCE North 400 feet to a point for corner. THENCE West 700 feet to a point for corner. - 3 - THENCE South 400 feet to a point for corner in the north line of the J. Blackwell Survey. THENCE West, along and with the north line of the J. Blackwell Survey, and along and with the north line of the J. Blackwell Survey produced west to a point for corner in the middle of the Trinity River. THENCE up the middle of the Trinity River, with its meanders, to a point for corner which is 300 feet north of the north line of the W. T. Edwards Survey produced west. THENCE West along and with a line 300 feet north of and parallel to the north line of the W. T. Edwards Survey produced west to a point in the east line of a tract of land owned by the City of Fort Worth upon which is situated the Sewage Disposal Plant. THENCE North 1,660 feet and West 46.6 feet and North 513.8 feet to a point for corner in the south right-of-way line of East First Street. THENCE West 100 feet, more or less, to a point for corner in the center line of the twenty-five (25) foot wide permanent easement for the connecting outfall main sanitary sewer between the Riverside Sewage Treatment Plant and the Village Creek Sewage Treatment Plant. THENCE along and with the center line of the said easement in a Northerly, Easterly and Southeasterly direction, with its meanders, to a point for corner at its intersection with the west right-of-way of Carson Street produced south, said point for corner being approximately five hundred (500) feet east from the west line of the W. R. Reeder Survey, Abstract No. 1303. THENCE North, to and along the west right-of-way line of Carson Street and along said line produced north to a point for corner at its intersection with the north right-of-way line of Elliott-Reeder Road. THENCE East, along and with the north right-of-way line of Elliott- Reeder Road 2,640 feet (one-half mile) to a point for corner. THENCE North 1 ,320 feet (one-quarter mile) to a point for corner. THENCE East approximately 2,400 feet to a point for corner in the center line of Big Fossil Creek. THENCE Northeasterly along and with the center line of Big Fossil Creek, with its meanders, to a point for corner at its intersection with the south line of the William Norris Survey, Abstract No. 1166. THENCE East along the south line of the William Norris Survey, Abstract No. 1166, to its southeast corner middle of Handley-Ederville Road. THENCE South along and with the middle of Handley-Ederville Road 390 feet to a point for corner. Hust Survey, Abstract No. 702. THENCE along and with the present Fort Worth city limit line as follows: THENCE South and Southwesterly along and with the westerly right- of-way line of Randol Mill-Hurst Precinct Line Road (County Road No. 3035) to a point for corner in the north right-of-way line of Randol Mill Road (County Road No. 2021). THENCE Northwesterly along and with the north right-of-way line of Randol Mill Road (County Road No. 2021) to a point for corner at its inter- section with a line 1,000 feet from the east line of the J. C. Davis Survey, Abstract No. 423. THENCE North along and with a line parallel to and 1 ,000 feet west from the east line of the J. C. Davis Survey to a point for corner 800 feet south from the north line of the J. C. Davis Survey. THENCE West, along and with a line parallel to and 800 feet south from the north line of the J. C. Hallum Survey, Abstract No. 723, situated about 10 miles northeasterly from the Courthouse of Tarrant County, Texas and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth city limit line, in the west right-of-way line of Bedford-Arlington Road (County Road No. 3094) at its intersection with the north line of the S. Davis Survey, Abstract No. 416, produced east. THENCE along and with the present Fort Worth city limit line as follows: THENCE South, along and with the west right-of-way line of Bedford- Arlington Road (County Road No. 3094) to a point for corner at its inter- section with the north line of the J. L. Hallum Survey, Abstract No. 723. THENCE West, along and with the north line of the J. L. Hallum Survey to a point for corner in the middle of the Trinity River. THENCE up the middle of the Trinity River, with its meanders, to a point for corner at its intersection with the east right-of-way line of Randol Mill-Hurst Precinct Line Road (County Road No. 3035). THENCE South, along a line parallel to and 500 feet east from the east right-of-way line of Randol Mill-Hurst Precinct Line Road (County Road No. 3035) a distance of 800 feet. THAT the foregoing-described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata share of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordi- nances, resolutions and regulations of the City of Fort Worth, Texas. - 7 - SECTION 3. THAT this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. THAT if any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispen- sable to the remaining portions of the ordinance. SECTION 5. THAT this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. These enclaves are completely surrounded by area within the city and con- sist, in large part, of areas annexed for limited purposes (Navigation Districts) in December 1963. The three enclaves are located as shown on the attached map. These areas are within the exclusive extraterritorial jurisdiction of Fort Worth for annexation purposes. There are no ordinance conflicts or boundary overlaps. Fort Worth water and sewer are available under standard developers policies. All other City services can be provided the area without undue problems. These areas are adjacent to the Trinity River and include portions which are subject to flooding. Flood Plain Zoning is available to help insure protec- tion of life and property. The Plan Commission finds that the annexation of these areas is consistent with the Council's "POLICY FOR REVIEW OF ANNEXATION AND DEANNEXATION REQUESTS." A completed "CITY COUNCIL ANNEXATION TIME TABLE" is attached. If Council begins the proceedings on July 24 the annexation can be final on September 25. Recommendation It is recommended that a public hearing on the proposed annexation be set for August 7 and the publication of the necessary notice of hearing be authorized.
