ORDINANCE NO. -7,514 AN ORDINANCE VACATING, ABANDONING AND CLOSING THE UTILITY EASEMENT IN LOT 1-R, BLOCK 6-R, DIAMOND HEIGHTS INDUSTRIAL ADDITION, A WIDTH OF 5' COMMENCING 15' EAST OF THE WEST LOT LINE OF FORMER LOT 4-R, BLOCK 6, HERTZ-DIAMOND HEIGHTS INDUSTRIAL ADDITION, AS RECORDED IN VOLUME 388-98, PAGE 25, TARRANT COUNTY PLAT RECORDS, AND CON- TINUING EASTWARD ALONG THE NORTH LINE AND CON- TINUING SOUTHWARD ALONG THE EAST LINE OF SAID FORMER LOT 4-R TO THE NORTH LINE OF BERNER STREET; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING THAT THIS ORDINANCE SHALL BE- COME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the utility easement in Lot 1-R, Block 6-R, Diamond Heights Industrial Addition, a width of 5' commencing 15' east of the west lot line of former Lot 4-R, Block 6, Hertz-Diamond Heights Industrial Addition, as recorded in Volume 388-98, Page 25, Tarrant County Plat Records, and continuing eastward along the north line and continuing southward along the east line of said former Lot 4-R to the north line of Berner Street be and the same is hereby vacated, abandoned and permanently closed as an easement for public utilities. SECTION 2. That the fee to the land in the above described utility easement is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved therein for any and all existing utilities including the 25' gas pipeline easement as recorded in Volume 2705, Page 598 and the 25' aerial access easement as recorded in Volume 388-98, Page 25, Tarrant County Plat Records. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. APPROVED AS TO FORM AND LEGALITY: City Attorney ADOPTED: 7 19-71 EFFECTIVE: FILE; MTERRE U.NE ROBINSON City of Fort Worth, Texas BAILIFF KIMBRU Mayor and Council Communication &-~M PAIGE REED "hilt REFERENCE SUBJECT: Easement Vacation: Diamond PAGE waeEs NUMBER Heights Industrial Addition, Block 6-R, 1 of PZ-779 1 `��7/77 Lot 1-R Mr. Joe Drummond, representing Cummins Sales and Service, Inc., has requested the City vacate a utility easement in Lot 1-R, Block 6-R, Diamond Heights Industrial Addition, a width of 5 ft. commencing 15 ft. east of the west lot line of former Lot 4-R, Block 6, Hertz-Diamond Heights Industrial Addition as recorded in Vol. 388-90, Page 25, Tarrant County Plat Records, and continuing eastward along the north line and continuing southward along the east line of said former Lot 4-R to the north line of Berner Street; however, the 25 ft. gas pipeline easement as recorded in Vol. 2705, Page 598 and a 25 ft. aerial access easement as recorded in Vol. 388-98, Page 25, Tarrant County Plat Records, shall be retained. See map attached. The subject easement, acquired by dedication, is unimproved. Reviewing City Departments and private utility companies have no objections to the requested vacation. Recommendation It is recommended that an ordinance be adopted vacating the subject easement as requested.
