HomeMy WebLinkAboutOrdinance 7614 ORDINANCE NO. 7� AN ORDINANCE VACATING, ABANDONING AND CLOSING WEST BOYCE AVENUE, 2100 BLOCK, A WIDTH OF 60' FROM THE EAST LINE OF WARREN DRIVE TO THE WEST LINE OF FRAZIER AVENUE; WEST SPURGEON STREET, 2100-2200 BLOCKS , A WIDTH OF 60 ' FROM THE EAST LINE OF THE GULF, COLORADO AND SANTA FE RAILWAY RIGHT-OF-WAY TO THE WEST LINE OF WARREN DRIVE, AND FROM THE EAST LINE OF WARREN DRIVE TO THE WEST LINE OF FRAZIER AVENUE; FULLER STREET, 2000-2200 BLOCK; A WIDTH OF 60 ' FROM THE EAST LINE OF THE GULF, COLORADO AND SANTA FE RAILWAY TO THE WEST LINE OF WARREN DRIVE, AND FROM THE EAST LINE OF WARREN DRIVE TO THE WEST LINE OF THE ALLEY IN BLOCKS 15 AND 22 ; COVERT STREET, 2000 BLOCK, A WIDTH OF 60 ' FROM THE EAST LINE OF BLOCK 37-R TO THE WEST LINE OF THE ALLEY IN BLOCK 34; FRAZIER AVENUE, 4700-4800 AND 5000 BLOCKS, A WIDTH OF 60' FROM THE SOUTH LINE OF SPURGEON STREET TO THE NORTH LINE OF MARTIN LYDON AVENUE AND FROM THE SOUTH LINE OF YATES STREET TO THE SOUTH LINE OF COVERT STREET; AND VACATING, ABANDONING AND CLOSING THE 15' WIDE ALLEY IN BLOCK 14, FROM SPURGEON STREET TO FULLER STREET; THE 15 ' WIDE ALLEY IN BLOCK 23, FROM FULLER STREET TO MARTIN LYDON AVENUE; THE 15 ' WIDE ALLEY IN BLOCK 13, ADJACENT TO THE GULF, COLORADO AND SANTA FE RAILWAY RIGHT OF WAY FROM SPURGEON STREET TO FULLER STREET; AND THE 15 ' WIDE ALLEY IN BLOCK 24 ADJACENT TO ,THE GULF, COLORADO AND SANTA FE RAILWAY RIGHT OF WAY FROM FULLER STREET TO MARTIN LYDON AVENUE; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS : SECTION 1. That West Boyce Avenue, 2100 Block, a width of 60' from the east line of Warren Drive to the west line of Frazier Avenue; West .Spurgeon Street, 2100-2200 Blocks, a width of 60 ' from the east line of the Gulf, Colorado and Santa Fe Railway right-of-way to the west line of Warren Drive, and from the east line of Warren Drive to the west line of Frazier Avenue; Fuller Street, 2000-2200 Block, a width of 60' from the east line of the Gulf, Colorado and Santa Fe Railway to the west line of Warren Drive, and from the east line of Warren Drive to the west line of the alley in Blocks 15 and 22 ; Covert Street, 2000 Block, a width of 60' from the east line of Block 37-R to the west line of the alley in Block 34; Frazier Avenue, 4700-4800 and 5000 Blocks, a width of 60' from the south line of Spurgeon Street to the north line of Martin Lydon Avenue and from the south line of Yates Street to the south line of Covert Street, be and the same are hereby vacated, abandoned and per- manently closed as rights-of-way for street purposes; and that the 15 ' wide alley in Block 14, from Spurgeon Street to Fuller Street; the 15 'wide alley in Block 23, from Fuller Street to Martin Lydon Avenue; the 15 ' wide alley in Block 13, adjacent to the Gulf, Colorado and Santa Fe Railway right-of-way from Spurgeon Street to Fuller Street; and the 15 ' wide alley in Block 24 adjacent to the Gulf, Colorado and Santa Fe Railway right-of-way from Fuller Street to Martin Lydon Avenue, be and the same are hereby vacated, abandoned and permenantly closed as alleys. SECTION 2 . That the fee to the land in the above described vacated street rights-of-way and alleys is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved therein for any and all existing utilities . t SECTION 3 . All ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. Most property adjacent to the subject rights-of-way is owned by either the Southwest Baptist Theological Seminary of the Southwest Baptist Seminary Development Foundation. Other property owners, however, include the Atchison, Topeka & Santa Fe Railroad Company, Ms. Ruth Parker, Mr. Jack Hildebrand and wife Alfreda D. Hildebrand, and the Volunteers of America National Housing. All the owners of adjacent property have consented to a proposed replat of the subject right-of-way. Covert St. : 4700-4800 & 5000 blks Frazier Ave. (V-77-9) Existing Conditions 1) Boyce Avenue is paved with curb and gutter along the north side of the street only. 2) Spurgeon Street is an existing paved street without curb and gutter. 3) Fuller Street does not exist on the ground. 4) Frazier and Covert Streets are both unimproved within the subject segments except for approximately 200 feet on Frazier immediately south of Spurgeon Street, of which has curb and stutter. 5) Alleys -- The alleys are not paved. , Plan Commission Action The City Plan Commission has reviewed this request and recommends its approval with certain conditions. These conditions have now been satisfied. Signatures of adjacent property owners have been obtained for both the vacation request and proposed replat. This proposed replat has now been found acceptable by City Staff and necessary streets and easements have been dedicated. Recommendation It is recommended that an ordinance be adopted vacating the subject rights-of- way as requested.
