HomeMy WebLinkAboutOrdinance 16457-05-2005ORDINANCE NO. r~~~ AN ORDINANCE VACATING AND EXTINGUISHING A 150 FOOT PORTION OF A 16 FOOT WIDE ALLEY SITUATED IN BLOCK 60 OF THE FACTORY PLACE ADDITION A5 RECORDED BY THE PLAT FILED IN VOLUME 204-A, PAGE 101, DEED RECORDS, TARRANT COUNTY TEXAS AND CONTAINING APPROXIMATELY 2,400 SQUARE FEET MORE OR LESS; PROVIDING- FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That an approximately 150 foot portion of a 16 foot wide alley contauung approxunately 2,400 square feet, and being adjacent to Lots 1 2, 3 8, 9 and 10, of Block 60 of the Factory Place Addition, as recorded by the plat filed m Volume 204-A, Page 101 Deed Records, Tarrant County Texas and containuig approxmately 2,400 square feet, more or less, and as more specifically descnbed in Attachment A attached hereto and uicorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated alley is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. All existing utility easement be shall be retained by the City until such time all utihties located ui that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. A ,~ ~, - City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 5/31/2005 Ord #16457-05-2005 DATE Tuesday May 31 2005 LOG NAME 06VA-04-029 REFERENCE NO PZ-2596 SUBJECT Adoption of Ordinance Vacating a 150 Foot Portion of a 16 Foot Wide Alley Situated in Block 60 of the Factory Place Addition RECOMMENDATION It is recommended that the City Council adopt the attached ordinance vacating a 150 foot portion of a 16 foot wide alley containing approximately 2 400 square feet and being adjacent to Lots 1 2 3 and 8 9 10 of Block 60 of the Factory Place Addition as recorded by the plat filed in Volume 204-A, Page 101 Deed Records City of Fort Worth Tarrant County Texas. DISCUSSION Paul Krause of Dunaway and Associates acting on behalf of Christ Chapel Bible Church has requested vacation of the above referenced alley in order to provide an expanded building site The Engineering Department, Real Property Management Division states that the purchase fee of $720 00 has been received The City Plan Commission recommended approval of this request at its meeting on June 23 2004 Owner will relocate any existing utilities at owner's expense An acceptable replat has been received (see FS-04-320 attached) This request is located in COUNCIL DISTRICT 7 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
