HomeMy WebLinkAboutOrdinance 16658-10-2005Ordinance No. ~ ~ (o S~ IU ads AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE NEW EQUIPMENT PURCHASE FUND IN THE AMOUNT OF $36,606 TO BE OBTAINED THROUGH THE CITY'S EQUIPMENT NOTE PROGRAM APPROVED ON FEBRUARY 9, 1999 (M&C G-12462) BY ORDINANCE NO 16582 FOR THE PURPOSE OF FUNDING NEW DUMP TRUCK BEDS FROM A TEXAS DEPARTMENT OF CRIMINAL JUSTICE CONTRACT FOR THE TRANSPORTATION AND PUBLIC WORKS AND WATER DEPARTMENTS; PROVIDING A SEVERABILITY CLAUSE MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH• AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the New Equipment Purchase Fund in the amount of $36,606 to be obtained through the City's Equipment Note Program approved on February 9 1999 (M&C G-12462) by Ordinance No. 16582 for the purpose of funding new dump truck beds from a Texas Department of Criminal Justice contract for the Transportation and Public Works and Water Departments. SECTION 2. That should any portion, section or part of a section of this severability clause be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the New Equipment Purchase Fund by $36 606 00 for the Transportation/Public Works Department to be obtained through the City's Equipment Note Program established on February 9 1999 (M8~C G-12462) by Ordinance No 16582 DISCUSSION The dump truck beds will be manufactured and mounted on new City-owned cab and chassis by TDC Inmates The dump truck beds will be used to carry dirt, rock and asphalt when pick up or delivery of these materials are required The V-box and Monroe spreader attachments will be used to add spreader equipment to the dump truck beds during winter storms for spreading of sand or deicing materials. These dump truck beds will replace units that can no longer be economically repaired which will be sold at auction The FY2005-06 adopted budget included funds to underwrite these replacement items as part of the citywide equipment replacement plan The City's Equipment Note Program will be used to finance the purchase of two of the dump beds for the T/PW Department. These dump beds will be installed on two new cab and chassis recently financed through the Equipment Note Program on June 7 2005 (M8~C P 10171) For the remaining two dump beds, one of the dump beds will be purchased directly from the General Fund and one will be purchased from the Water and Sewer Fund The cost of the two dump beds being financed is $36 606 00 over seven years with http.//www cfwnet.org/council~acket/Reports/mc~rmt.asp 10/21/2005 Page 2 of 2 payments from the General Fund Financing these dump beds lessens the one-year capital outlay needed in the General Fund spreading the cost over the seven-year term of the note The T/PW and Water Departments have reviewed the pricing and find the cost to be competitive Under Section. 252 022 Subsection 12(C) of the Texas Local Government Code these dump beds are exempt from the bidding process as a purchase of personal property sold by a State of Texas agency M/WBE A goal is not assigned when purchasing from an approved cooperative or public entity FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that funds are available in the current operating budgets as appropriated of the Equipment Notes Program General and Water Funds.
