HomeMy WebLinkAboutOrdinance 16459-05-2005CITY OF FOREST HILL ORDINANCE NO 200551 CITY OF FORT WORTH ORDINANCE NO ] p ~,0~ JOINT ORDINANCE AND BOUNDARY AGREEMENT WHEREAS the City of Forest Hill is a home rule city located m Tarrant County Texas, WHEREAS the City of Fort Worth is a home rule city located m Tarrant, Wise, and Denton Counties, Texas, WHEREAS the City of Fort Worth and the City of Forest Hill share a common boundary WHEREAS, m 2005 the City of Fort Worth purchased land for the construction of a new adequate and safe road to serve as the entrance to the City of Fort Worth s Southeast Landfill, WHEREAS, the purchased land is within the city hmrts of City of Forest Hill, Tarrant County yWHEREAS, the City of Fort Worth has requested that the City of Forest Hill adjust the boundary between the cities so that no portion of the land used by the City of Fort Worth for the construction and use as the Southeast Landfill road will be located partly in Forest Hill and partly in Fort Worth, WHEREAS, on May 3 2005 the Forest Hill City Council authorized rt City Manager to execute Forest Hill City Contract No 200536 the boundary adjustment requested by Fort Worth with regard to the Southeast Landfill road (among other actions) through the execution of a Memorandum of Understanding with the City of Fort Worth ("MOU") and in accordance the terms of the MOU WHEREAS, on May 10 2005 the Fort Worth City Council authorized by M&C C 20730 the conveyance of approximately 4 72 acres of land currently within the city limits of Fort i.. ~t ~ I ~i 1. (~ u u~, V ~. 7 ~~ ~~, ~~~U~U p ~~ ~o Worth to the City of Forest Hill in exchange for the vacation of Glen Court by the City of Forest Hill through the execution the MOU and m accordance the terms of the MOU WHEREAS, on May 18 2005 the City of Forest Hill and the City of Fort Worth fully executed the MOU known as Fort Worth City Secretary Contract No 31839 and Forest Hill City Contract No.200536 whereby each party agreed to disannex certain land described m Section 3 of the MOU to release its extra-territorial Jurisdiction ("ETJ") m such land, and to work cooperatively to execute all necessary documents m a timely manner WHEREAS, the City of Fort Worth and the City of Forest Hill have agreed that the boundary adjustments and property exchange would insure that the constructed Southeast Landfill Road is entirely within one city and clarify public safety responses, WHEREAS, the City of Forest Hill and the City of Fort Worth agree to adJust their boundary lines on Wichita Street, Lon Stephenson Drive, and Anglin Drive to better provide for the health and safety of their citizens, WHEREAS Section 43 031 of the Texas Local Government Code authorizes adJacent municipalities to make mutually agreeable changes in their boundaries of areas that are less than 1 000 feet m width, WHEREAS the areas described in the MOU and this ordinance that are subJect to the boundary adjustments are each less than 1 000 feet m width, NOW THEREFORE, BE IT ORDAINED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE CITY OF FOREST HILL AND THE CITY COUNCIL OF THE CITY OF FORT WORTH. olut nd ndary Adj 2 Of 7 ty of th ty of 11 "i r~~v~J~IU ~~, °~`IU`~~~~ ~~L;~, SECTION 1 Pursuant to Section 43 031 of the Texas Local Government Code, the City of Forest Hill and the City of Fort Worth hereby agree that the boundary between the cities will be adjusted as set out herein so that no part of the Southeast Landfill Road will be located partly in Fort Worth and partly in Forest Hill and so that no part of Wichita Street, Lon Stephenson Drive and Anglin Drive as described in the Section 4 of the MOU will be located partly in Fort Worth and partly m Forest Hill Such boundary adjustments and conveyances shall be as shown in Exhibit Al and Exhibit A2 SECTION 2. In accordance with the terms of this Joint Ordinance and Boundary Agreement and the terms of the MOU the City of Fort Worth hereby disannexes and discontinues approximately 4 72 acres as described in Exhibit `B of this Joint Ordinance and Boundary Agreement to the City of Forest Hill The City of Forest Hill hereby annexes approximately 4 72 acres into its corporate limits as reflected and described m Exhibit `B attached and incorporated herein. The conveyance document transferring title to the property from the City of Fort Worth to the City of Forest Hill is attached as Exhibit `C" SECTION 3 In accordance with the terms of this Joint Ordinance and Boundary Agreement, the City of Forest Hill hereby disannexes and discontinues approximately 5 58 acres as described m Exhibits `D1 `D2" `D3 `D4 `DS" `D6" and `D7" of this Joint Ordinance and Boundary olut nd ndary Adj 3 of 7 ty of th ty of 11 Agreement to the City of Fort Worth. The City of Fort Worth hereby accepts and annexes approximately 5 58 acres into its corporate hmrts as reflected m described m Exhibits `D1 `D2" `D3 `D4 `DS" `D6" and `D7" attached and incorporated herein. The entire Southeast Landfill Road shall be entirely within the city limits of Fort Worth as shown in Exhibit `D8" SECTION 4 In accordance with the terms of the MOU the City of Fort Worth and the City of Forest Hill desire to clarify and acknowledge the boundary lines of the named roads between the City of Fort Worth and the City of Forest Hill as described below and shown on Exhibit Al and A2" 1 The boundary line of Forest Hill s city hmrt shall be the easternmost edge of the right of way of Anglin Drive from its intersection with the northern right-of way of Freeman Drive to its intersection with the southern right-of way of Lon Stephenson Drive 2 The boundary line of Forest Hill s city limit shall be the southernmost edge of the right-of way of Lon Stephenson Drive from its intersection with the eastern right-of way of Forest Hill Drive to its intersection with the eastern right-of way of Anglin Drive 3 The boundary line of Forest Hill s city limit shall be the western most edge of the right-of way of Wichita Street from the southern right-of way of Forest Hill Circle to a location located north of the northern right-of way of Alta Mesa Boulevard East. The City of Forest Hill acknowledges the existence of water lines currently owned and maintained by the City of Fort Worth under the surface of such roads, and the continued rights of the City of Fort Worth to maintain and operate such lines. olut nd ndary Adj 4 of 7 ty of th ty f 11 SECTION 5. This ordinance shall be cumulative of all provisions of ordinances of the City of Forest Hill and the City of Fort Worth, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 6. It is hereby declared to be the intention of the City Councils of Forest Hill and Fort Worth that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7 The City of Forest Hill and the City of Fort Worth do hereby covenant and agree to protect, preserve and defend the herein described boundary adjustment. SECTION 8. SECTION 10. DISCUSSION The City of Fort Worth owns and operates the Southeast Landfill which accepts municipal solid waste for disposal The entrance to the Southeast Landfi{I is currently located along Dick Price Road which lies within the jurisdiction of the City of Kennedale Access to the Southeast Landfill on Dick Price Road is not well suited to meet the Texas Commission on Environmental Quality ("TCEQ") mandate that access be safe and adequate and therefore it is in the best interests of the City to gain ownership of other access to the Southeast Landfill in order to fulfill TCEQ's requirements On May 10 2005 by M&C C-20731 the City Council authorized the assignment of three separate earnest money contracts from its trustee Michael Ball, to acquire land currently located within Forest Hill's city limits from three private land owners in order to construct a new road to serve as adequate access to the Southeast Landfill. On May 18 and 19 2005 the City closed on the purchases of the private land from the three land. owners. Although M&C C-20731 authorized the purchase of approximately 6.29 acres of land only 5 562 acres were actually necessary for the construction of the Southeast Landfill Road and therefore only 5 562 acres were purchased by the City This 5 562 acre parcel is unimproved and uninhabited Also on May 10 2005 by M&C C-20730 the City Council authorized the City Manager to execute a Memorandum of Understanding ("MOU") with the City of Forest Hill to adjust their corporate boundary lines, whereby Fort Worth will release from its city limits and its exclusive Extra-Territorial Jurisdiction ("ETJ") certain land described in the MOU to be relinquished to become a part of the city limits of Forest Hill and Forest Hill will release from its city limits and its exclusive ETJ certain land described in the MOU to be relinquished to Fort Worth and to become a part of the city limits of Fort Worth The MOU was fully executed on May 18 2005 as City Secretary Contract No 31839 In order to satisfy the obligations of the City as described in the MOU and to begin the construction of the Southeast Landfill Road the execution of the Joint Ordinance and Boundary Adjustment is necessary Additionally the City Council authorized the conveyance of 4 72 acres of land owned by the City of Fort Worth and currently located within the city limits of Fort Worth to Forest Hill This conveyance was made in Logname• 12FORESTHILL Page 1 of 2 exchange for the vacation by Forest Hill of Glenn Court, which is within the 5 562 acres described above The boundary adjustment would move the 4 72 acre parcel of land into the city limits of Forest Hill This 4 72 acre parcel is likewise unimproved and uninhabited This boundary adjustment also recognizes the boundary lines of certain named roads between the City of Fort Worth and the City of Forest Hill as described in Section 4 of the Joint Ordinance and Boundary Adjustment and shown in exhibits Al and A2 This clarification of boundary lines allows the City of Forest Hill to better address health and safety concerns and responses to its citizens. Section 43 031 of the Texas Local Government Code authorizes adjacent municipalities to make mutually agreeable changes in their boundaries of areas that are less than 1 000 feet in width Approval of the Joint Ordinance and Boundary Agreement will result in movement of approximately 5 562 acres from Forest Hill's municipal jurisdiction to Fort Worth's municipal jurisdiction Additionally Fort Worth would allow 4 72 acres presently located in the City of Fort Worth to be transferred to the municipal jurisdiction of the City of Forest Hill Both of these parcels are less than 1 000 feet in width The property would be located in COUNCIL DISTRICT 8 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on city funds.
