AN ORDINANCE INCREASING THE ESTIMATED RECEfPTS AND APPRAPRIATfANS
IN THE SEVIIER CAPITAL PRAJECTS IN THE AMOUNT AF $538,9fi3.00, FRAM
AVAILABLE FUNDS, FAR THE PURPASE AF FUNDING SANfTARY SEINER
REHABILITATION CONTRACT LX X60}, PART 3; PRAVfDING FAR A SEVERABILITY
CLAUSE; MAKING THIS ARDfNANCE CUMULATIVE 4F PRfAR ARDINANCES AND
REPEALING ALL PRIAR ORDINANCES IN CANFLICT HEREV1JfTH; AND PRAVfDING
AN EFFECTIVE DATE.
BE IT 4RDAfNED BY THE CITY CAUNCIL AF THE CITY 4F FART INARTH, TEXAS:
SECTfAN 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 and
in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in
the Sewer Capital Projects Fund in the amount of $538,963.00, from available funds, for the purpose of
funding Sanitary Sewer Contract Rehabilitation Contract LX X60}, Part 3.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ardinance No.18809 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repeated.
SECTION 4.
This ordinance shall take effect upon adoption.

Street and Adopt Appropriation ordinance
REC~MMENDATI4N:
It is recommended that the City Council:
1. Authorize the transfer of $538,963.00 from the Water and Sewer Operating Fund to the Sewer Capital
Projects Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $538,963.00; and
3. Authorize the City Manager to execute a contract with RKM Utility Services, Inc., in the amount of
$487,463.00 for Sanitary Sewer Rehabilitation Contract LX, Part 3.
D~SCUSS~4N:
On February 24, 2004, (M&C C-19973) the City Council authorized an Engineering Agreement with CH2M
Hill, Inc., for Sanitary Sewer Rehabilitation Contract LX (60) (Project 01006).
This project, Part 3, consists of the replacement of the severely deteriorated sanitary sewer mains located
on the following streets:

The project was advertised for bid on May 14, 2009, and May 21, 2009, in the Fort Worth_ Star-Telegram.

MIwBE - RIM Utility Services, Inc., is in compliance with the City's MIwBE ordinance by committing to
29 percent MIVVBE participation. The City's goal on this project is 18 percent.
Funding in the amount of $27,000.00 is required for associated construction survey, project management,
material testing and inspection and $24,500.00 is provided for project contingencies.
The overall project is located in ALL COUNCIL DISTRICTS. However, this particular project Part 3, is
located in COUNCIL DISTRICT 5.
FISCAL INF~RMATIDN !CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendation
and the adoption of the attached appropriation ordinance, funds will be available in the current capital
budget, as appropriated, of the Sewer Capital Projects Fund.
