SECTION 1.
That the alley through Block 17, Fostepco Heights Addition to the City
of Fort Worth, Tarrant County, Texas, from 36th Street to 37th Street, be and

r the same is hereby vacated, closed and permanently abandoned as an alley or

public thoroughfare of any kind or character whatever.
SECTICN 2.
That the fee to the land in said alley above described is hereby re—
leased and will revert to the owner as provided by law, provided, however,
that an easement is hereby retained for the maintenance .of all presently
existing utilities within said alley.

SECTION 3.
! That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and effect
from and after the date of its passage.

1 Dear Sir:
Attached is a latter dated May 15, 1956, signed by r1r. H. C. Minton,
President of the Blue Bonnet Packing Company, Fort Worth, requesting the
j closing of the alley in Block 17 of Fostepco Heights Addition, as per plat
attached.
We have checked this request on the ground, and have found that the alley has
never been opened for public use. As a matter of fact, there are two buildings
that are built over the alley. There are no utility lines in the alley, and
the '-Blue Bonnet Packing Company has a chain link fence around both Blocks 17
and 18. The alley through Block 18, Fostepco Heights Addition and N. Pecan
Street, from 36th Street to 37th Street, were both closed by the Commissioners
Court prior to being annexed to the City of Fort Worth.

Our recommendation is that the alley through Block 17, Fostepco Heights

Addition, from 36th Street to 37th Street, be closed as requested.

Gentlemen:

Blue Bonnet Packing Co. respectfully requests the City
Council of the City of Fort Worth to enact an ordinance vacat-
ing, closing, and permanently abandoning as an alley or public
I thoroughfare of any kind or character the vaay or alley of
j approximately 15 feet in width running north and south betvaeen
the west line of Lots 1 through 12 and the east line of Lots
13 through 24 of Block 17, Fostepco Heights Addition to the
City of Fort Worth, Tarrant County, Te-7cas between 36th and 37th
Streets .

Blue Bonnet Packing Co . owns all of Lots 1 through 12 and
C 13 through 24, Block 17, Fostepco Heights Addition to the City
of Fort Worth, which are the only properties adjoining the
l alley or away requested to be closed. This alley has never been
opened on the ground, and has not been in use for many, many
years, and is presently under fence. �

The Blue Bonnet Packing Co , also owns �gJ�1k 7.8, Fostepco
Heights, and a like alley therein has been duly closed and aban-
doned, as well as North Pecan Street between Blocks 17 and 18
! from 36th Street to 37th Street.
The Blue Bonnet Packing Co . requests the City of Fort vlorth
to enact an ordinance so that; the alley described in Block 17 is
released and :gill revert to the o�jners as provided by law, save
and except that an easement be reserved for any presently exist-
; ing utilities, if any, no-vi located thereon.

ORDERED CLOSED, July 8th, 1937.
At this time came on for consideration before the court,
{ the application of Blue Bonnet Packing Company requesting the closing
of an alley in Block 18, Fostepco Heights. On motion made by
Commissioner Merrett, seconded by Commissioner Thannisch, and carried,
it is ordered that said Alley in Block 18, Fostepco Hts. be and the
same is hereby vacated and closed.

This the application of Blue Bonnet Packing Company, a
corporation, of Tarrant County, Texas, respectfully shows to the court
that it is the owner of Lots Nos. 1 to 24 inclusive in Block 18,
Fostepco Heights Addition to the City of Fort Worth, Tarrant County,
Texas, being all of said block according to the plat recorded in Book
204, page 126, Plat Records of Tarrant County, Texas.
That it is to the best. interest of this applicant and the
public that the alley running North and South through said block, East
of Lots 1 to 12 inclusive, and West of Lots 13 to 24 inclusive, be closed
and vacated, and that the dedication of same as an alley as shown on
'j said plat aforesaid be annulled and vacated and held of no further
force and effect.
Wherefore applicant prays that said alley in said block be
closed and that said plat and dedication of same as an alley be vacated
and declared of no further force and effect .

COUNTY OF TARRANT. ) ORDER OF THE COMMISSIONER COURT.

On this the 9th day of February, 1939 came on to be heard the
application of the Blue Bonnet Packing Company, a domestic corporation
herein; to close and abandon North Pecan Street, between 36th and 37th
Streets in Fostepco Addition, Tarrant County, Texas, and after said
court having heard and duly considered said application, Court makes
following findings.
j That the applicant, Blue Bonnet Packing Company herein is the fee
holder and owner of Blocks 17 and 18 in the Fostepco Heights Addition,
Tarrant County, Texas.
That it appears from the evidence that North Pecan Street inter-
rupts and separates- Blocks 17 and 18 and that it would be to the best
interest and enjoyment of the Blue Bonnet Packing Company in the use
of their property, for said street to be abandoned and closed.
Whereupon all the above matters herein having been considered by
the Commissioners Court; a motion was msde by County Commissioner,
Hightower that said North Pecan Street be closed and abandoned for the
purposes set out in the application filed by the Blue Bonnet Packing
Company which motion County Commissioner, Scott seconded; whereupon,
Judge Dave Miller announced the motion as made to the entire Commis-
sioners Court and asked for a vote thereon. The motion was put to a vote
and the entire Commissioners Court unanimously voted in favor of the
motion made.
It is therefore ordered, adjudged and decreed by the Commissioners
Court, that the said North Pecan Street between 36th and 37th Streets
in Fostepco Heights Addition in Tarrant County, Texas be and the same
is hereby closed and abandoned as a public or County thoroughfare or
highway and the said Blue Bonnet Packing Company stall have the right
to use and enjoy that portion of said street closed by reason of this
order in so far as the County or public interest in such portion of said
street is concerned.
Entered this 9th day of February, 1939.

having its domicile situated in Tarrant County, Texas, and respectfully
files this its application requesting this Hon. Court to close and
abandon North Pecan Street in said county; and for grounds therefore

4 control and ,jurisdiction of this Honorable Court .
� .'. That the Blue Bonnet Packing Company is the fee holder and
owner of Block 17 and 18, Fostepco Heights Addition, as shown by the
plat submitted herewith for the convenience of the Court. That North
Pecan Street separates said blocks above described, and that your
said applicant herein would further show said court that said North
i Pecan Street is not traveled or used excessively by any citizen or
3 citizens of Tarrant County, Texas, and that your applicant should
I have the right to use and enjoy all of its property, ,joined together,
and without the interruption of said Pecan Street.
Therefore, based upon the reason herein set forth, the Blue
Bonnet Packing Company respectfully requests this Hon. Court. to close
and abandon said North Pecan Street between 36th and 37 streets
f and deed tosaid Blue Bonnet Packing Company all the rigHy. title and
interest the County may have into that portion of said streetto be
closed.
Wherefore, your applicant, Blue Bonnet Packing Company prays the
Court that it be granted the relief as hereinabove stated and the
court execute a deed to the Blue Bonnet Packing Company to that pro-
portion of said Pecan Street. closed by reason of this application, and
all other relief to which applicants are entitled.
