HomeMy WebLinkAboutOrdinance 16560-08-2005Ordinance No ~~J`"(o D-O~-a.pQS AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $1,211,068.25 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH CLEBURNE UTILITY CONSTRUCTION INC FOR SANITARY SEWER REHABILITATION CONTRACT LV (55), UNIT 2; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $1,211 068.25 from available funds for the purpose of funding a contract with Cleburne Utility Construction, Inc. for Sanitary Sewer Rehabilitation Contract LV (55), Unit 2 SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction such decision opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 ADOPTED AND EFFECTIVE. ,5 ~ ~3O ~Q~ This ordinance shall take effect-upon adoption City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 8/30/2005 Ordinance No 16560-08-2005 DATE Tuesday August 30 2005 LOG NAME 30LV CUC REFERENCE NO *C-20928 SUBJECT Adopt Appropriation Ordinance and Authorize Execution of Contract with Cleburne Utility Construction Inc for Sanitary Sewer Rehabilitation Contract LV (55) Unit 2 RECOMMENDATION It is recommended that the City Council 1 Authorize the transfer of $1 211 068 25 from the Water & Sewer Operating Fund to the Sewer Capital Project Fund 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $1 211 068 25 from available funds and 3 Authorize the City Manager to execute a contract with Cleburne Utility Construction Inc. in the amount of $1 101 068 25 for Sanitary Sewer Rehabilitation Contract LV (55) Unit 2. DISCUSSION On April 16 2002, (M&C C-19049) the City Council authorized the City Manager to execute an engineering agreement with Dunaway Associates, Inc. for the preparation of plans and specifications for Sanitary Sewer Replacement Contract LV (55) Unit 2. In order to expedite construction the project was divided into two units. Unit I was authorized by the City Council on June 14 2005 (M&C C-20787) and construction will commence in early August. This project, Unit 2 consists primarily of the replacement of the following sanitary sewer mains L 1381 Beginning from the East Lowden Street/Mississippi Street intersection westerly 200 feet along East Lowden Street, northerly 310 feet to Glen Garden Drive, northerly 250 feet along Glen Garden Drive northerly 170 feet and westerly 1 800 feet in the alley located between Glen Garden Drive and Cantey Street to the east right-of-way line of I H 35W M-17 Beginning from a point located 350 feet north of Mississippi Avenue/Baker Street intersection easterly 525 feet, southerly 105 feet, easterly 760 feet, southerly 485 feet and easterly 590 feet to the upstream end of the Unit 1 project.
