AN ORDINANCE AMENDING SECTION 37-25(c) , SECTION 37-25(d)
AND SECTION 37-26(a) , OF CHAPTER 37 OF THE CODE OF THE
CITY OF FORT WORTH (1964) , AS AMENDED, BY REVISING CERTAIN
WASTEWATER RATES AND CHARGES; MAKING THIS ORDINANCE CUMU-
LATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND
PROVISIONS OF THE CODE OF THE CITY OF FORT WORTH IN CON-
FLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 37-25(c) of Chapter 37 of the Code of the City of
Fort Worth (1964) , as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:
" (c) The following schedule of rates per month or
fraction thereof shall be the basis for determining
charges to all customers for rendering sanitary sewerage
service, where the sewage produced by such customer is a
normal strength wastewater (two hundred ten (210) mg/l
B. O. D. and two hundred forty (240) mg/l suspended solids)
and where such customer is located within the city:
"RATES FOR SEWERAGE SERVICE ONLY
" (1) A monthly service charge shall be charged
to all customers in the amount of two dollars
and eighty cents ( $2. 80).
" (2) A monthly volume charge shall also be
charged to all customers in the amount of four
hundred eleven thousandths of a dollar ( $0. 411)
per one hundred (100) cubic feet of water used,
or wastewater produced, as more specifically set
forth hereinafter.
"The monthly volume charges for residential class
customers will be based on the individual customer' s
average monthly water use during the preceding winter
quarter months of December, January and February, but in
no event shall the volume used to compute this monthly
charge exceed one thousand five hundred (1, 500) cubic
feet. The volumes used to compute these charges are based
on the amount of water used by the residential class cus-
tomer as measured by a meter. Where no preceding winter
quarter average is available from records, the director
shall estimate a volume to be used for this monthly volume
charge, such estimated volume not to exceed one thousand
five hundred (1, 500) cubic feet.
"The monthly charges to commercial and industrial
class customers will be based on total water use as meas-
ured by appropriate meters, with the provision that if a
customer can show, to the satisfaction of the director of
the waterworks department, that a significant portion of
the metered water usage does not enter the sanitary
sewers, the customer will be charged for only that volume
entering the sewers, as determined by a method approved by
the director. "
SECTION 2.
That Section 37-25(d) of Chapter 37 of the Code of the City of
Fort Worth (1964) , as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:
" (d) The director of the waterworks department shall
establish a monitored group class, consisting of those
customers whose wastewater strength is, in his judgment,
abnormally high or low, and charges to customers in this
class shall be computed in accord with the following
five-part rate schedule:
"MONITORED GROUP
Customer monthly service charge $2. 80
Volume charge, per 100 cubic feet 0. 266
B. O. D. strength charge, per pound 0. 0631
of B. O. D.
Suspended solids strength charge, per 0. 0413
pound of suspended solids
Monitoring charge Total cost to city
"The monitoring charge shall consist of all cost for
personnel, material, and equipment used to collect and
analyze samples from the customer wastewater to determine
the strength of the wastewater produced.
"This schedule shall replace all other charges previ-
ously made for industrial waste strength. "
SECTION 3.
That "Schedule B" of Section 37-26(a) , Connection Charge, of
Chapter 37 of the Fort Worth City Code (1964) , as amended, be and
the same is hereby amended and, after having been so amended,
"Schedule B" shall hereafter read and be as follows:

SECTION 4.
That this ordinance shall repeal every prior ordinance and pro-
vision of the Fort Worth City Code in conflict herewith but only
insofar as any portion of such prior ordinance or provision shall be
in conflict, and as to all other ordinances or provisions of the
Fort Worth City Code not in direct conflict herewith, this ordinance
shall be and is hereby made cumulative.
SECTION 5.
That all rights or remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of Chapter 37 or of
any amendments thereto, of the Fort Worth City Code (1964) , as
amended, which have accrued at the time of the effective date of
this ordinance; and as to such accrued violations, the Court shall
have all of the powers that existed prior to the effective date of
this ordinance.
SECTION 6.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this Ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this Ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this Ordinance, since the same would have been enacted by the City
Council without the incorporation in this Ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 7.
That this Ordinance shall become effective and be in full force
and effect from and after its passage, provided, however, that the
increased rates specified herein shall apply to customer utility

statements sent by the City of Fort Worth on or after October 1,
1982, and it is so ordained.

On July 15, 1980 (M&C G-4521), the City Council was informed of the results of
a wastewater rate study performed by Black and Veatch Consulting Engineers. At
that time, the City Council approved the wastewater rate schedule for 1980-81
and was informed that an additional increase would be reviewed in June, 1981.
The study recommended a rate increase of 13 percent for the 1981-82 fiscal year
based on proajections made at the time of the study.
Updated information related to the cost of providing wastewater collection and
treatment indicated that the consultant's projection could be revised downward
and subsequently a 5 percent rate increase was approved for 1981-82. The cost
of operation and maintenance related to wastewater treatment have continued to
increase as illustrated in the following tabulation:

Proposed Rate Adjustments
The estimated costs for sanitary sewer operations for 1982-83 are shown in the
following schedule. The effect on revenue of a 5 percent rate increase for
1982-83 is also shown.

The proposed retail rates for wastewater service to residential, commercial and
industrial customers generating a normal strength waste (210 mg/1 BOD and 240

The service rates consist of a monthly service charge, a monthly volume charge
and a schedule of minimum charges varying with the size of the water meter.
Monthly wastewater charges for residential class customers will continue to be
based on the individual customer's average rate of water use during the
preceding winter months of December, January and February, with the maximum
monthly charge not to exceed the charge for 1,500 cubic feet.
The residential class average winter use per customer over the past four years
is approximately 1,260 cubic feet (9,450 gallons) per month. The residential
class average sewer volume related to the 1,260 cubic feet water use is
approximately 760 cubic feet per month. The proposed rate increase would have
the following effect on the residential class average billing:

Monitored Wastewater Customers
There are industrial and commercial customers whose wastewater has signifi-
cantly high quantities of BOD and Suspended Solids which are costly to treat.
In order to recover costs associated with high strength wastewater, these
customers are monitored periodically by sampling their wastewater flows to
determine BOD, Suspended Solids and volume. The customers are then charged for
wastewater service in accordance with the following schedule:

Recommendation
It is recommended that:
1. That the retail and monitored industrial waste service rates as outlined
above be approved as the rates to be charged all customers of the Fort
Worth Water Utility Department, and,
2. That the City Council adopt the ordinance adopting the rate schedule
outlined above with an effective date of billing on and after October 1,
1982.
