HomeMy WebLinkAboutOrdinance 3222 ORDINANCE N0. 3222 Ali ORDINANCE DECLARING A WATER FA41ERGENCY, PROVIDING FOR THE REGULLTION OF THE USE OF WATER FOR THE PURPOSE OF IRRIGATING LAWNS, GARDENS AND SHRUBS; AUTHORIZING THE TURNING OFF OF WATER FOR NONCO1,MIANCE i"ITH THIS ORDI- NANCE; PROVIDING A PENALTY FOR VIOLATION HEREOF; PROVID- ING THAT THIS ORDINANCE SHALL BE APPLICABLL TO ALL RESI- DENTIAL CONSUMERS CONNECTED WITH THE WATER MAINS OF THE CITY OF FORT WORTH, INCLUDING THE, RESIDENTIAL CONSIRM S CONNECTED WITH THE WATER NAINS OUTSIDE THE CORPORATE LIIviITS OF THE CITY OF FORT WORTH AND/OR USING WATER FURNISHED BY THE WATER WORKS OF THE CITY OF FORT WORTH; PROVIDING A RE- PEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PRO- VIDING AN EFFECTIVE DATE. 'vT[IMAS, it has become necessary and desirable, for water con- servation purposes, to curtail and restrict the watering of lawns, gardens and shrubs of all residential consumers connected with the City Water Works system and mains of the City of Fort Worth within the corporate limits of the City of Fort Worth, including those residential consumers connected with the water mains of the City of Fort Worth outside the corporate limits of said City and/or using water furnished by the City lister Works; and, WHEREAS, low pressures have been reported from high areas in the east, south and west sections of the city, and such sections have been found to be without water during certain periods of the year, and particularly during the summer months; and, WHEREAS, the succeeding provisions of this ordinance, after inves- tigation by the City Council of the City of Fort Worth, have been found to be reasonable rules and regulations for the use of water by residential consumers connected with the water mains of the City of Fort Worth and using water furnish- ed by the Water Works of said City; NOVI, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT VTORTH, TEXAS: SECTION 1• There is hereby declared to be a water emergency in the City of Fort Ilorth necessitating conservation regulations, SECTION 2, The use of water for the irrigation of lawns, gardens and shrubs by residen- tial consumers connected with the water mains of the City of Fort Worth and using water furnished by the Water Works of the City of Fort Worth, including residen- tial consumers connected with the water mains of the City of Fort Worth and/or using water furnished by the Plater Works of the City of Fort Worth situated outside of the corporate limits of said City, is hereby regulated as follows: A. All residential consumers using water furnished by the Water Works of the City of Fort Worth residing on or occupying property bearing even-numbered street addresses are prohibited from watering and irrigating lawns, gardens and shrubs except upon even-numbered days of the month. B. All residential consumers using water furnished by the Water Works of the City of Fort Worth residing on or occupying property bearing odd-numbered street addresses are prohibited from watering and irrigating la,aw,, gardens and shrubs except upon odd-numbered _ days of the month. SECTION 3, The Director of the Fort 2dorth `later Works is hereby authorised to out off the water of any residential consumer failing to comply with paragraphs °w° or 19311 hereinabove set out. SECTION 4. A violation of any of the above rules and regulations as set out in the pre- ceding sections, or a doing or causing to be done by any residential consumer, per- son or persons, firm or association, of any of the things or acts forbidden or made unlawful in any of the preceding sections, shall be deemed to constitute violation under the terms of this ordinance and an offense, and shall be punishable as such, and for each and every violation of the terms of this ordinance, the person, firm, association or corporation shall, upon conviction thereof in the Corporation Court, be fined not less than Twenty-five Dollars (;25.00) nor more than Two .Hundred Dollars 0200.00), and each violation and each day there is a failure to comply with the terms of this ordinance shall constitute a separate offense. SECTION 5. All of the provisions of this ordinance shall be applicable to and enforce- able against all residential consumers connected with the water mains of the City of Fort Worth and/or using water furnished to them, either directly or indirectly, by the '-later Works of the City of Fort Worth, whether residing or situated within or without the corporate limits of said City, and each residential consumer shall be charged with knowledge of the provisions of this ordinance by applying for and accepting water from the ;dater Works of the City of Fort Worth and is deemed to have accepted the provisions hereof. SECTION 6. All ordinances of the City of Fort Uarth or parte thereof in cordu iot herewith are hereby expressly repealed. -2- SECTION 7. If any provision, section, subsection, sentence, clause or phrase of this ordinance, or the application of same to any person or set of circumstances, is for any reason held to be unconstitutional, void or invalid, or for any reason unenforceable, the validity of the remaining portions of this ordinance or their application to other persons or sets of circumstances shall not be affected there- by, it being the intent of the City Council of the City of Fort Worth, in adopting this ordinance, that no portion hereof, or provision or regulation contained herein, shall become inoperative or fail by reason of any unconstitutionality or invalidity of any other portion, provision or regulation, and to this end all provisions of this ordinance are declared to be severable, SECTION B. This ordinance shall take effect and be in full force and effect from and after the date of its passage and publication as required by law, APPROVED AS TO FORM: /s/SLG.
