BE ST ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT NORTH, I TEXAS: SECTION 1. It shall be unlawful for any grouping or assemblage of persons, moose standing, remaining or congregating upon any public street or side- Valk in the City of Fort Worth shall obstruct, prevent or interfere with the free or unobstructed use of said street or sidewalk by other persons, to fail or refuse to move on or to disperse upon being ordered to do so by any police officer of the City of Fort Worth or other peace officer. SECTION 2. It shall be unlawful for any person, grouping or assemblage of persons, whose standing, remaining or congregating upon any entrance, alcove or steps leading from a public street or sidewalk to the entrance or exit of any public or private building or structure in the City of Fort Worth shall obstruct, prevent or interfere with the free or unob- structed use of said entrance or exit, or of the street or sidevalk ad- jacent thereto, by other persons, to fail or refuse to move on or to dis- perse upon being ordered to do so by any police officer of the City of Fort Worth or other peace officer. SECTION 3. Every person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not more than Two Hundred Dollars ($200.00). SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable; and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or in- valid by the valid judgment or decree of any court of competdht ,juris- diction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same vould have been enacted by the City Coun- cil without the incorporation in this ordinance of any such unconstitu- tional or invalid phrase, clause, sentence, paragraph or section. SECTION 5. All ordinances or pants of ordinances inconsistent or conflicting with the provisions of this ordinance are hereby expressly repealed, pro- vided, hovever, that the repeal of existing ordinances by this ordinance shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby re- pealed prior to the taking effect of this ordinance, but prosecution for such offenses may be instituted and causes presently pending proceeded vith in all respects as if such prior ordinance had not been repealed. SECTION 6. The fact that the present regulations vith reference to the standing, remaining or congregating of persons upon any public street or sidewalk or in the entrance, alcove or steps of any public or private building in the City of Fort Worth are deemed inadequate creates an urgency and an emergency for the immediate preservation of the public peace, health, comfort, safety and general velfare. This ordinance shall take effect and be in full force and effect from and after the date of its passage and publication as provided by lay. APPROVED AS TOFORMAND LDCs S. G. 'h ASO&A s OFFICE OF THE CITY MANAGER Communication to Mayor and Council No. ©I-120 September 15, 1961 Honorable Mayor and Members of the City Council Res Ordinance Relating to City of Fort Worth Obstructing Public 'Streets Over Sidewalks Mrs, McKnight ahil Gentlemen= There is attached an ordinance which, if adopted, would give the City authority now lacking to prevent assemblage of persons on public streets or sidewalks in such way as to obstruct the free use of streets or sidewalks, It is felt that the ordinance would assist the Police Department in dealing with problems relating to mob action that have arisen in many other cities, or which are due to blocking of streets, sidewalks, or entrances to streets and sidewalks for any purpose.
