AN ORDINANCE PROVIDING THAT PORTIONS OF THE EAST-WEST AND NORTH-SOUTH ALLEYS IN BLOCK 4, HEMPHILL HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND A PORTION OF MULKEY STREET BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of the east-west alley in Block 4, Hemphill Heights Addition to the City of Fort Worth, Tarrant County, Texas, from a line twenty (20) feet east of the east line of Lots 5 and 9, said Block 4, to the east line of said Blbck 4, be and the same is hereby closed, abandoned and permanently vacated as an alley or public thoroughfare of any kind or char- acter whatever, save and except easements are reserved for any and all existing utilities, including a ten (10) foot easement for the existing sanitary sewer, the center of which being con- centric with the centerline of the existing sanitary sewer. SECTION 2. That the north-south alley in Block 4, Hemphill Heights Addition to the City of Fort Worth, Tarrant County, Texas, from the north line of Mulkey Street to the south line of Page Street, be and the same is hereby closed, abandoned and permanently va- cated as an alley or public thoroughfare of any kind or character whatever, save and except easements are reserved for any and all existing utilities, including a ten (10) foot easement for the existing sanitary sewer, the center of which being concentric with the centerline of the existing sanitary sewer. SECTION 3. That a portion of Mulkey Street from a north-south line eight (8) feet east of the west line of Lot 17, Block 5, Winston Addition to the City of Fort Worth, Tarrant County, Texas, to the present east end of Mulkey Street, a distance of thirty (30) feet, be and the same is hereby closed, abandoned and permanent- ly vacated as a street or public thoroughfare of any kind or character whatever, save and except easements are reserved for any and all existing utilities, including a ten (10) foot ease- ment for the existing sanitary sewer, the center of which being concentric with the centerline of the existing sanitary sewer. SECTION 4. That the interest of the City of Fort Worth in the fee to the land in said portions of streets and alleys is hereby re- leased and shall revert to the adjacent owner of the fee as pro- vided by law. SECTION 5. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 6. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. City Secretary September 17, 1962 Honorable Mayor and Re: Requested Closing of Alleys Members of the City Countil and Right-of-Way City of Fort Worth Mrs. McKnight and Gentlemen: The Lone Star Gas Company has requested the closing of a portion of the alleys in Block 4, Hemphill Heights Addition, and a portion of the City- owned strip in Block 5, Winston Addition, as shown on the attached plat and described as follows: Portions of Alleys in Block 4, Hemphill Heights. The company owns all of the property adjacent to the portions of the alleys whose closing is requested, except that one side of one of the alleys is adjacent to railroad right-of-way. A 10 foot easement is to be retained by the City for the existing sanitary sewer in the alleys. In consideration for this closing, the company has dedded to the City-an additional 20 foot alley in the block, as shown on the attached plat:.- Portions of Public ht-of-Wayin Block 5 Winston Addition. The City owns a strip of land 38 feet in width along the 12 foot alley in this block. The opening of this 50 foot right-of-way for street purposes is not necessary, and the company has requested that the east 30 feet be closed by the City and deeded to the company, leaving the remaining 20 feet to serve as a public alley. The company has agreed to purchase the 30 foot strip of land from the City for $0.45 per square foot or $6,403.50, which is the fair market value of the land as established by the City. To complete the alignment of the property, it will also be necessary to close the east 30 feet of the north one-half of Mulkey Street. The company has stated that the reason for the requested closings is to permit consolidation of commercial property in connection with recon- struction of warehouses and service facilities. All interested parties including private utility companies, have been contacted and no objections have been found to the requested closings, provided an easement is re- served for the existing sanitary sewer as mentioned above. The Public Works and Planning Departmouts concur in the requested closings. The following recommendations are made: (1) That an ordinance be adopted closing a portion of the alleys in Block-4, Hemphfll Heights Addition, and the east 30 feet of Mulkey Street, as shown on the attached plat, (2) That an ordinance be adopted aftndoning a 30 foot strip M&C PW-1268 Page Two September 17, 1962 across Block 5, Winston Addition, as shown on the attached plat, and that the Mayor be authorized to execute a deed for the 30 foot strip to Lone Star Gas Company in exchange for payment of $6,304.50. /Resctfully submitte , L.
