AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 0.213 SQUARE MILES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing was held by the City Council of the City of Fort Worth, Texas wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of each tract of the territory herein- after described, and such hearing was held in the City Council Chamber in the City Hall of Fort Worth, Texas on the 5th day of February, 1968, and on that day such hearing was continued to the 19th day of February, 1968, on which date the public hearing was closed; and, WHEREAS, such public hearing beginning on the 5th day of February and closed on the 19th day of February, 1968, was held not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings , and, WHEREAS, notice of such public hearing was published on the 24th day of January, 1968, in a newspaper having general circulation in the City of Fort Worth, Texas and in the hereinafter described territory, which publication date was not more than twenty (20) nor less than ten (10) days prior to the first day of the public hearing held on the 5th day of February, 1968; and, WHEREAS, the population of the City of Fort Worth, Texas is in excess of 391 ,000 inhabitants, and, WHEREAS, the corporate area of the City of Fort Worth was 197.630 square miles on January 1 , 1968; and, WHEREAS, each tract of the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and, WHEREAS, each tract of the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and, WHEREAS, the territory hereinafter described contains approximately 0.213 square miles; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: FIRST TRACT: Being a portion of the L. G. Tinsley Survey Abstract No. 1523, and a portion of the A. C. Warren Survey Abstract No. 1686, located about 4 miles east from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a point in the present City of Fort Worth Limit Line, said point being in the south right-of-way line of East First St. and in the westerly right-of-way line, produced southwesterly, of North Haltom Road (Howard Haltom Rd.); thence northeasterly along the westerly right-of-way line of North Haltom Rd. 1750 ft. more or less to its intersection with the Fort Worth City Limit Line as estab- lished by Ordinance No. 5079; thence south along said Fort Worth City Limit Line as established by Ordinance No. 5079 to the south right-of-way line of East First St; thence west along the south right-of-way line of East First St. 1075 ft. more or less to the point of beginning, and containing 0.027 square miles. SECOND TRACT: Being a portion of the S. Elliott Survey Abstract No. 476, and a portion of the A. C. Warren Survey Abstract No. 1686, located about 5 miles east from the Court- house of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a point in the present City of Fort Worth Limit Line, said point being in the south line of the A. C. Warren Survey, in the north line of the J. Blackwell Survey and 700 feet west from the east line of the J. Blackwell Survey; thence north 400 ft. along a line parallel to and 700 ft. west from the east line of the J. Blackwell Survey, produced north, to a point for corner; thence west 700 ft. along a line parallel to and 400 ft. north from the north line of the J. Blackwell Survey to a point for corner; thence south along a line parallel to and 400 ft. west from the east line of the J. Blackwell Survey, produced north, to f1s inter- section with the north line of the J. Blackwell Survey, said point also being in the Fort Worth City Limit Line as established by Ordinance No. 4697; thence east along the north line of the J. Blackwell Survey, said line also being the City Limit Line as established by Ordinance No. 4697, to the point of beginning, and containing approximately 0.010 square miles. THIRD TRACT: Being a portion of the W. Masters Survey Abstract No. 1048, and a portion of the J. C. Davis Survey Abstract No. 423, located about 9 miles northeasterly from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a point in the present City of Fort Worth Limit Line, said point being in the north right-of-way line of Randol Mill Road, 1000 ft. west from the east line of the J. C. Davis Survey; thence north along a line parallel to and 1000 ft. west from the east line of the J.C. Davis Survey, to a point 800 ft. south from the north line of the J.C. Davis Survey; thence west along a line parallel to and 800 ft. south from the north line of the J.C. Davis and W. Masters Surveys to a point 600 ft. east from the west line of the W. Masters Survey; thence south along a line parallel to and 600 ft. east from the west line of -the W. Masters Survey to its intersection with the north right-of-way line of Randol Mill Rd; thence easterly along the north right-of-way line of Randol Mill Rd. with its meanders to the point of beginning, and containing approximately 0.176 square miles. SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional , by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences , phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. These annexations are recommended for favorable action by the City Council . The City Plan Commission has analyzed the advisability of annexing parcels of land which are partially or wholly surrounded by Fort Worth's corporate boundaries. Some of these enclaves, (islands of areas, isolated and sur- rounded by another political entity) especially those in the northeast section of the City, (vicinity of the Trinity River) resulted from the 1963 annexations under the Navigation Act. The Navigation Act permitted annexation to a maximum of 2500 feet from the centerline of the Trinity River. A number of small tracts remained outside the 2500 foot line, sandwiched between properties annexed under the Navigation Act and those annexed under regular procedures. In their analysis, it was the purpose of the City Plan Commission to eliminate these islands and problem areas. According to State Law, land annexed under the Navigation Act is not subject to zoning, building, or taxing controls by a city. Conversely, the city is not obligated to provide utilities, police, fire protection, or other services normally provided within its corporate boundaries. However, land annexed under standard procedures subject to zoning and customary city regulations is entitled to city benefits. The three areas covered by the attached recommendations for annexation are the first step in a series of study areas. Studies have been made of unin- corporated enclaves surrounded by the City, and the Plan Commission recommends the annexation of three areas in the Trinity River Valley on the east side of Fort Worth, as shown on the attached maps, and as discussed in the attached letter dated February 22, 1967, from the Chairman of the City Plan Commission. Annexation of the three areas was first considered by the City Council on March 20, 1967, but the City Council decided at that time to defer action until after the new City Council took office (14&C PZ-233). In recent months, the need for possible new annexations has been suggested by petition from residents in the Joe Louis Subdivision (which is in the Navigation area) and a larger enclave (in the County but surrounded by the City of Fort Worth) located just west of the announced site of the new American Airlines Aeronautical Training Center and the existing Stewardess College. Because preliminary staff work and City Plan Commission review of the three enclaves has been completed, it is possible at this time to initiate action on the annexation deferred by the previous City Council. The City Council may also wish to instruct the staff and the City Plan Commission regarding additional studies and possible annexations in the Trinity River Valley (East) area in order to assure orderly growth and development in that section of the City. The three enclaves are the residue unincorporated areas as a result of both regular and navigation dist annexations accomplished in 1963. Total area of the three areas is 35. acres, or about two tenths of a square mile. The attached three maps show the relative proximity of existing streets and water and sewer facilities. There are six residences and some farm buildings in the largest of the three tracts proposed for annexation, but the prevailing general uses of the three areas at this time are mining and agriculture. Recommendation In order to implement the City Plan Commission recommendation for annexation of the 6.4, 17.3, and 112.0 acre tracts in the Trinity River Valley East area, it is necessary: 1) That on January 22, 1968 the City Council adopt a resolution setting a public hearing on February 5, 1968 to consider the proposed annex- ation and ordering that notice of this hearing be published one time on either the 23rd, 24th or 25th day of January 1968, in a newspaper having general circulation in the City of Fort in the territory proposed to be annexed; and OFFICIAL RUJH, CITY SFCRFTjjj,,. DATE REFERENCE SUBJECT: Reconsideration of Annexation PAGE NUMBER of Three Areas in the Trinity 2 2 1/22/68 PZ-268 River Valle (East) of 2) That on February 5, 1968 all interested persons be given a full opportunity to be heard at the public hearing and that the public hearing be closed; and 3) That on February 19, 1968 the City Council institute annexation proceedings by the adoption of an annexation ordinance on first reading and that the City Secretary be instructed to publish the ordinance one time on either the 20th, 21st, 22nd or 23rd day of February, 1968, in the official newspaper of the City of Fort Worth; and, 4) That on March 4, 1968 the City Council adopt a resolution setting a public hearing for March 25, 1968 to consider the recommended initial zoning; and 5) That on March 25, 1968 the City• Council adopt the annexation ordinance on second and final reading; and immediately thereafter hold a public hearing on the recommended zoning for the annexed areas. 6) That the City Council direct the City Zoning Commission to give notice and hold public hearing as required by law and make its recommendation to the City Council for the original zoning classi- fication of the area to be annexed, such recommendation to be before the Council for its public hearing on March 25, 1968. Because the contemplated annexation will be final in Calendar Year 1968, taxes on the property will not begin to accrue until January 1, 1969.
