AN ORDINANCE AMENDING CHAPTER 7 OF THE FORT
WORTH CITY CODE (1964) , WHICH CHAPTER REGU-
LATES ANIMALS AND FOWL AND THE KEEPING AND
LICENSING THEREOF IN THE CITY BY ADDING
DEFINITIONS; INCREASING FEES; EXEMPTING CER-
TAIN ANIMALS FROM LICENSING FEES; PROVIDING
FOR CONFINEMENT OF CERTAIN ANIMALS; FORBID-
DING HINDERANCE OF ANIMAL CONTROL PERSONNEL
IN PERFORMANCE OF THEIR DUTY; PROHIBITING
THE MAINTENANCE OF VICIOUS ANIMALS IN SUCH
A MANNER AS TO ENDANGER LIFE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES AND PROVISIONS OF
THE FORT WORTH CITY CODE IN CONFLICT HERE-
WITH; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY; AND PROVIDING AN EF-
FECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 7-17 of the Fort Worth City Code (1964)
is hereby amended, and, after having been so amended,
same shall hereafter read as follows:
"Sec . 7-17 . Poundage fees .
"The following shall be the fees charged
for poundage:
For taking up and impounding,
per head . . . . . . . . . . . .$7 .50
For taking care of animals per
day, per head. . . . . . . . . . 1 .00
For selling animals , per head 1 .00
For preparing and posting ad-
vertisement of sale . . . . . . . 1 .00
For newspaper advertisement. The
actual cost as determined from
time to time; and in the event
more than one animal is adver-
tised in the same advertisement,
the cost per head shall be di-
vided equally among the animals
sold or redeemed ."
SECTION 2 .
That Section 7-20 of Chapter 7 of the Fort Worth
City Code (1964) is hereby amended by adding the follow-
ing provisions:
"Any dog owned and used by a blind
person as a guide dog is exempt from the
license fee while so owned and used but
is not exempt from being licensed or
from any required vacination .
"Moreover , any dog owned by or in
the care of a non-resident of the City
of Fort Worth who is traveling through
the city or temporarily sojourning there-
in for a period not exceeding thirty
days is exempt from any of the provi-
sions of this Section."
SECTION 3 .
That Section 7-26 of Chapter 7 of the Fort Worth City
Code (1964) is hereby amended by adding the following
provision:
"Every female dog in season shall
be confined in a building or secure
enclosure in such a manner that such
female dog cannot come into contact
with another animal except for planned
breeding."
SECTION 4.
That Section 7-27 of Chapter 7 of the Fort Worth
City Code (1964) is hereby amended, and, after having

been so amended, same shall read as follows:
"Sec. 7-27 . Impounding dogs running at
large; redemption; receipts .
"It shall be the duty of the pound-
master or any police officer of the city
to take up any dog found running at
large, and confine such dog in the city
pound for seventy-two hours , during which
time the owner, upon satisfactory proof
to the poundmaster of ownership, may re-
deem his dog upon payment of a pound fee
of two dollars, and all other fees pro-
vided by this article. Upon payment of
such fees, the poundmaster shall issue
an official receipt for the amount
paid . Such fees shall be delivered to
the city treasurer and credited to the
general fund of the city. The pound-
master shall provide, at the cost of the
city, suitable and necessary sustenance
for all dogs so impounded .
"No person shall hinder, resist,
or oppose animal control personnel or
their representatives in the performance
of their duties under this article ."
SECTION 5.
That this ordinance shall repeal every prior ordi-
nance and provision of the Fort Worth City Code in con-
flict herewith but only insofar as the portion of such
prior ordinance or provision shall be in conflict, and
as to all other ordinances or provisions of the Fort
Worth City Code not in direct conflict herewith, this
ordinance shall be and is hereby made cumulative.
SECTION 6 .
That if any section, part of a section or provision
of any section of this ordinance shall be held to be

void, ineffective or unconstitutional by a court of com-
petent jurisdiction, the holding of such section, part
of a section or provision of any section to be void,
ineffective or unconstitutional for any cause whatsoever
shall in no way affect the validity of the remaining
sections and provisions of this ordinance, which shall
remain in full force and effect. The City Council would
not have passed any sections, parts of sections or provi-
sions of any section of this ordinance that were uncon-
stitutional, void or ineffective, if it had known that
they were unconstitutional, void or ineffective at the
time of adopting this ordinance.
SECTION 7 .
That the violation of any provision of this ordi-
nance or of the Fort Worth City Code relating to animals
and fowl shall be deemed an offense and punishable by a
fine not exceeding Two Hundred Dollars ($200) , and each
violation thereof and each day there is a failure to com-
ply with the terms of this ordinance shall be and is
hereby deemed to be a distinct and separate offense and
punishable as such.
SECTION 8 .
That this ordinance shall be in full force and ef-
fect from and after its passage and publication as re-
quired by law.

It is proposed to amend Sections 7-17, 7-20, 7-26 and 7-27 of the Fort Worth
City Code (1964) covering animals and fowl as summarized below and detailed
GRAHAM in the attached ordinance.
BRADSHAw Summary of Amendments
The Health Department in cooperation with representatives of the Tarrant County
Veterinary Association and the Humane. Society have studied the Animal Control
Ordinance in detail during the last few months. As a result of this study the
following amendments concerning animals and fowl are proposed:
Section 7-17. On December 20, 1965, (M&C G-888) , the City Council
approved an increase in pound fees from $3 per head for large
animals to $7.50. These fees have been in force since that date
but have never been made a part of the City Code.
Section 7-20. This amendment exempts blind persons from paying the license
fee for their "guide dogs" but does not exempt them from obtaining the
license or from the vaccination requirement. Also, it exempts, for a period
not exceeding thirty days, non-residents of the city, while traveling
through Fort Worth, from obtaining a license.
Section 7-26. This amendment provides for the confinement in a building
or a secured enclosure of a female dog in season to prevent it from coming
into contact with another animal except for planned breeding.
Section 7-27. This amendment provides that no person shall hinder, resist
or oppose animal control personnel, in the performance of their duties. In
addition, the pound fees stated in this section are changed from $1 to $2
as authorized in M&C G-888.
Recommendation
It is recommended that the attached proposed amendments to the City Code
concerning animals and fowl be adopted by the Cit Council.
