AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE SEINER CAPITAL PROJECTS IN THE AMOUNT OF $123,444.00, FROM
AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING SANITARY SEWER
REHABILITATION CONTRACT M-1-I-1, PART 2; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FART WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2049-2414 and
in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in
the Sewer Capital Projects Fund in the amount of $123,444.00, from available funds, for the purpose of
funding Sanitary Sewer Contract Rehabilitation Contract M-1-I-1, Part 2.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No.18809 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize a Contract in the Amount of $662,444.00 with Conatser Construction TX, LP, for Sanitary Sewer
Rehabilitation Contract M-1-I-1, Part 2, from Shamrock Avenue to Northeast Seventh Street and Adopt
Appropriation Ordinance
REC~MMENDATIQN:
It is recommended that the City Council;
1. Authorize the transfer of $123,444.00 from the Vvater and Sewer Operating Fund to the Sewer Capital
Projects Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $123,444.00 from available funds; and
3. Authorize the City Manager to execute a contract with Conatser Construction TX, LP, in the amount of
$662,444.00 for Sanitary Sewer Rehabilitation Contract M-1-I-1, Part 2.

4n July 21, 2001, ~M&C C-18456 Council authorized the City Manager to execute an Engineering
Agreement with Dunaway Associates, L.P., for Sanitary Sewer Main 1-I-1 Condition Assessment and
Drainage Area Evaluation Study.
This project, Part 2, consists of the rehabilitation of a sanitary sewer main from Shamrock Avenue to
Northeast Seventh Street.
The project was advertised for bid on July 30, 2009, and August 6, 2009, in the Fort Worth.Star-Tele ream.
4n August 20, 2009, the following bids were received:

MIvvBE -Conatser Construction TX, LP, is in compliance with the City's MIUVBE ordinance by committing
to 25 percent MIWBE participation. The City's goal on this project is 24 percent.
In addition to the contract cost, $36,000.00 is required for construction staking, project management,
material testing and inspection and $25,000.00 is provided for project contingencies.

The project is located in COUNCIL DISTRICT 2.
FISCAL INF~RMATIDN I CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations,
and adoption of the attached appropriation ordinance, funds will be available in the current capital budget,
as appropriated, of the Sewer Capital Projects Fund.
