TO PRE- PARE ESTIMATES; DIRECTING THE CITY SECRETARY TO FILE A NOTICE OF ADOPTION OF THIS ORDINANCE WITH THE COUNTY CLERK OF TARRANT COUNTY,, TEXAS; DECLAR- ING THAT THIS ORDINANCE AND ALL SUBSEQUENT PROCEEDINGS RELATING TO SAID STREET IMPROVEMENT ARE -AND SHALL BE PURSUANT TO THE ACT OF THE FIRST CALLED SESSION OF THE FORTIETH LEGISLATURE OF THE STATE OF TEXAS, -CHAPTER 106; COMMONLY KNOWN AS ARTICLE 1105b OF VERNON'S TEXAS CIVIL STATUTES AS AMENDED BY ACTS 1967, 60TH LEGISLATURE, PAGE 365, CHAPTER 176, SECTION 1, EMERGENCY EFFECTIVE MAY 12, 1967; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND EN- ROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOKS OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THIS CITY AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the ,Public Works Director for the City of Fort Worth, Texas, has prepared Plans and Specifications ,for the improvements of :the hereinafter described portions of streets, avenues and public places in the .City of Fort Worth, Texas, and same having been examined by the City Council of the .City of Fort Worth, Texas, and found to.,be in all matters and things proper, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The hereinafter described Plans and Specifications are hereby approved and adopted. II. There exists ,a public necessity for the improvement of the hereinafter described portions of streets; avenues and public places in. the City of" Fort Worth, Texas, to-wit: BRIDGE STREET, UNIT I: From Oakland Boulevard to Weiler Boulevard, known and designated as Project No. 104- 23000-131. III. Each of the above described portions of streets, avenues and public places in the City of Fort Worth-, ,Texas, shall be improved by raising, grading, and filling same and by constructing-thereon the,following, to-wit: BRIDGE STREET, UNIT I: From Oakland Boulevard to Weiler Boulevard, known and designated as Project No. 104-23000-131, a seven-inch thick reinforced ,concrete pavement on 'a six-inch thick lime .stabilized subgrade with, seven- inch high superimposed concrete curb and by widening the existing street' so that the finished roadway will be forty-four feet wide. Six=inch thick concrete drive- ways will be constructed where specified along with necessary storm drain ,appurtenances. The above, together with concrete curbs, gutters, driveways and incidentals to such improvements, on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and Specifications therefor. IV. The cost of said improvements as herein defined shall be paid for as follows, to-wit: A. The property abutting on that portion of the street, avenue or public place and the real and true owners thereof shall pay all of the cost of curbs and gutters in front of their property and not exceeding nine-tenths (9/10ths) of the estimated cost of the remainder of such improvements. B. The City of Fort Worth shall pay all of the remainder of the cost of said improvements after deducting the amounts herein specified to be paid by the abutting properties and the real and true owners thereof as set out in subsection A. The amounts payable by the abutting properties and the real and true owners thereof shall be assessed against such properties and the real and true owners there- of and shall constitute a first and prior lien upon such properties and a personal liability of the real and true owners there of and shall be payable to-wit: When the improvements- are completed and accepted by the City on a particular unit, the sums assessed against property abutting upon such completed and accepted units shall be and become payable in five (5) equal installments, due respectively on or before thirty (30) days, and one (1) , two (2), three (3), and four (4) years from the date of such completion and acceptance and the assessments against the pro- perty abutting upon the remaining units shall be and become due and payable in such installments after the date of completion and acceptance of such respective unit. The entire amount assessed against the particular parcels of property shall bear interest from the date of such completion and acceptance of the improvements on the unit upon which the particular property abuts at the rate of six (6%) percent per annum, payable annually except as to interest on the first installment, which shall be due and payable on the date said installment matures provided that any owner shall have the right to pay any and all of such installment at any time before maturity by paying principal with interest accrued to the date of payment and further provided if default be made in the payment of any installment promptly as the same matures, then at the option of the City of Fort .Worth or its assigns, the entire amount of the assessment upon which such default is made shall be and become immedi- ately due and payable; but it is specifically provided that no assessments shall in any case be made against any property or any owner thereof in excess of the special benefits to property in the enhgnced value thereof by means of said improvements in the unit upon which the particular property abuts, as ascertained at the hearing pro- vided by the law in force in the City, nor shall any assessment be made in any case until after notice of hearing as provided by law. Said assessments against the respective lots and parcels of property and owners thereof shall be evidenced by certificates of a special assessment which shall be executed in the name of the City of Fort Worth, PROVIDED, however, that acting through its duly authorized Director of Public Works, the City of Fort Worth retaining the right to authorized payment of the sums assessed against abutting property upon such completed and accepted unit in not more than forty-eight equal regular monthly installments of not less than $9.00 each, the first of such installments to become due and payable not more than 30 days after the completion and acceptance by the City of the particular unit, PROVIDED FURTHER, that the City Attorney is hereby empowered to authorize payments of said sums in lesser installments and/or over a longer period of time in cases in which the Director of Public Works has previously determined that an extreme financial hardship upon the property owner will otherwise result and PROVIDED FURTHER, that such method of payment shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of Fort Worth a lawful, valid and binding note_ and mechanic's and materialman's contract upon forms supplied by the City granting a mechanic's lien upon and conveying the said abutting property in trust to secure the payment by said owner or owners according to the terms thereof of the sums assessed against such property. V. The assessments against the respective lots and parcels of property and the owners thereof shall be evidenced by certificates of special assessment, which shall be executed in the name of the City by the Mayor of said City and the City Secretary shall attest the same and impress the corporate seal of the City thereon, and which may have attached thereto coupons in evidence of the several installments, or in evidence of any of the installments in which the assessment is payable, which certificates shall be issued to the City of. Fort Worth, shall recite the terms and time of payment, the amount of the assessment, the description of the property, and the name of the owners, as far as known, and shall contain such other recitals as may be pertinent thereto, and shall further recite substantially that atl pro- ceedings with reference to the making of such improvements have been regularly had in compliance with law, and that all prerequisites to the fixing of the assessment lien against the property described in said certificates and the personal liability of the owners thereof, have been regularly had, done and performed, and such re- citals shall be prima facia evidence of the matters so recited, and no further proof shall be required in any court, and the said certificates shall provide substantially that if default be made in the payment of any installment promptly as the same matures, then, at the option of the City of. Fort Worth, or its assigns, the entire amount of the assessment shall be and become immediately due and payable, together with reasonable attorney's fees and costs of collection, if incurred, all of which, as well as the principal and interest on the assessment, shall be a first and prior lien against the property, superior to all other liens and claims except State, County, School District, and City ad valorem taxes . No error or mistake in naming any owner or in describing any property or in any other matter or thing, shall invalidate any assessment or any certificate issued in evidence thereof, and the omission of improvements on any particular unit or in front of any property exempt by law from the .lien of special assessment for street improvements shall not in- validate any assessment levied. The certificates referred to need not contain recitals in exactly the works above provided for, but the substance thereof shall suffice, and they may contain other and additional recitals pertinent thereto. VI. Bids having been advertised for as required by Article 1105b of the re- vised Civil Statutes of Texas, as amended, and the bid of R. L.' BERTRAM CONSTRUCTION & ENGINEERING COMPANY having been found to be the lowest and best bid for the making and construction of said improvements, the contract there- fore is hereby awarded to J. L. BERTRAM CONSTRUCTION & ENGINEERING COMPANY at and for the prices stated in the Proposal of said company and as reported and recommended by the Public Works Department, which said report and recommendation is on file with the City, the City Manager, and the City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City thereon, the said contract embracing, among other things, the prices for the work. VII. To provide for the payment of the indebtedness incurred by the City of Fort Worth, Texas, by said contract, there is hereby appropriated out of available funds and current revenues of the City, an amount sufficient to pay said indebtedness so incurred. VIII. The improvements provided for herein shall be made and constructed, notice given, hearing held and assessment levied and all proceedings taken and had in accordance with and under the terms of the powers and provisions of Chapter 106 of the Acts of the First Called Session of the Fortieth Legislature of the State of Texas, now known as Article 1105b of Vernon's Texas Civil Statutes, as amended, which law has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas, and under which law these proceedings are taken and had. IX. Each unit above described shall be and constitute a separate and independent unit of improvement and the assessments herein provided for shall be made for the improvements in each unit according to the cost of the improvements in that unit and according to the benefits arising from the improvements in that unit. X. In making assessments, if the name of the owner be unknown, it shall be sufficient to so state the fact, and if any property be owned by an estate or by any firm or corporation, it shall be sufficient to so state, and it shall not be necessary to give the correct name of the owner, but the real and true owners of the property mentioned shall be liable and the assessments against the property shall be valid. XI. The Director of Public Works of the City of Fort Worth, Texas, be and he is hereby ordered and directed to file with the City Council, estimates of the cost ' of such improvements in each unit, in accordance with the terms of the powers and provisions of the Charter of the City of Fort Worth, Texas. XII. The City Secretary is directed to prepare, sign and file with the County Clerk of Tarrant County, Texas, a notice in accordance with the provisions of the Act passed at the Fifth Called Session of the Forty-first Legislature of the State of Texas, and shown as Chapter 21 of the Acts of said Session of the Legislature, said Act having been passed in the year 1930, and now known as Article 1220a of Vernon's Texas Civil Statutes. XIII. Width Street Limits Feet Feet Bridge Street Oakland Boulevard to Weiler 44 to 56 60 to 85 Boulevard Water Limits 12" Water Supply Blue Lake Drive to Weiler Main and other Boulevard water facilities in Bridge Street The 1973-75 Capital Improvements Program provides for improvements to Bridge Street from Oakland to Weiler (page A-99) as approved in the 1970 bond election. This will provide improved traffic flow and drainage facilities for Nolan High School, White Lake Hills Addition and Woodhaven Country Club Estates Addition. The new 12" water supply main will constitute auxiliary supply to both Woodhaven Country Club Estates and White Lake Hills Additions and strengthen reliability in the vicinity of these areas. The contract also includes other water main adjustments necessary for the street improvement. Existing Conditions Bridge Street is a major thoroughfare with a present traffic count of 7,679 vehicles per day. The existing street is approximately 20 feet wide, substandard grade asphalt pavement without curb and gutter. Improvements The improvements will consist of widening to a 44-foot width by construction of 7" thick reinforced concrete pavement, with 7" high concrete curb, on a 6" lime stabilized subgrade, along with necessary storm sewer appurtenances, and 6" concrete driveways. The street will be widened to 56-foot width at Nolan High School and Blue Lake Drive to provide left-turn lanes to the school and White Lake Hills Addition. The water supply main will consist of construction of approximately 3,900 feet of 12-inch and 424 feet of 8-inch water main. Due to the amount of excavation and fill necessary prior to the water line inst?ll ation, the contract is designed to be let to the overall lowest bidder. In this manner, phases of the street and storm drain construction and water main construction will be complementary to each other, resulting in an overall lower cost to the City and a shorter completion time. t REFEREN DATE NUMBER CE suB�Ecr: Award of Contract - Bridge Stree PAGE Improvements and 12" Water Supply Main 4/9/73 C-2505 and Other Facilities 2 of 5 On-Ramp from Bridge Street to Turnpike It was originally proposed that an entrance from Bridge Street to the Turnpike be accomplished. However, this contract does not provide for construction of such a connection for the reasons outlined below. As a condition of approval of such a connection, the Turnpike Authority would require that: 1) The City pay for the Turnpike Authority's Consulting Civil Engineers to report on the feasibility of the project and their consulting Traffic Engineers to study the traffic revenue implications; estimated to include a delay of approximately four (4) months and a cost of $12,000. 2) The report of the Engineers be presented to the Authority, and if approved by it, be presented to the City Council for its approval. 3) Plans and specifications be approved by the Turnpike Authority. 4) An agreement between the City and the Authority be executed embodying the proposals mentioned above. 5) The Texas Highway Department approve the plans and specifications for the construction. Due to the location of the Toll Gates, the only availabld 'location for an entranc ramp from Bridge Street onto the Turnpike would be at Blue Lake Drive. The Texas Highway Department has indicated that the location of an entrance ramp at Blue Lake Drive is too close to the exit ramp at Oakland and would need to be torn out when the Turnpike becomes a part of the State Highway System and rebuilt to meet current standards. The Dallas-Fort Worth Turnpike is projected to be paid out sometime in 1977, or possibly earlier, provided no further major capital expenditures are made. There is a study being made by the Turnpike Authority concerning the pro- posed Trinity Turnpike and its effect on the existing Dallas-Fort Worth Turnpike. If the Trinity Toll Road should be tied to the existing Toll Road, then another set of circumstances would prevail. An entrance from Bridge Street onto the Turnpike at Blue Lake Drive is estimated to cost the City approximately $100,000. If built at this time, it might have to be torn out in a matter of four years or less. Lewis & Lewis Bids Received: March 8, 1973 Working .Days Allotted: 180 Proposed Assessments and Enhancement Appraisals There are several unusual conditions attending this project as related to assessment of costs to adjacent, benefitted property. The Texas Turnpike through-lanes abut Bridge Street on the south throughout the entire length. By contractual agreement, no assessments can be levied against the Turnpike Authority. Along the north side of the project, most of the abutting property frontage is a strip of land varying from 20 feet to 50 feet in width and occupied by a 20-inch high pressure gas line owned by Old Ocean Fuel Company. The gas line is a part of the fuel supply used for generation of electricity in this area by Texas Electric Service Company. Only three other property ownerships appear along the north side of this project: (1) the Fort Worth Water Department, (2) Tommy Moore Tower Company, and (3) Woodhaven Country Club Estates. In order to obtain an independent appraisal of the enhancement of value of property resulting from the proposed paving improvement, Mr. Ross E. Jones, SRA SR/WA, was engaged to make a study. The appraisal report indicates that the proposed new street will not benefit the narrow strip of land owned by the Old Ocean Fuel Company nor will the improvements change the use of this property. Therefore, no special benefits or assessments are proposed. Assessments proposed against Woodhaven Country Club Estates are in accordance with normal City policy, and credits have been allowed where portions of the property are not accessible from Bridge Street due to the difference in grade between adjacent property and the street. The owners of this property have no objection to the proposed assessment. DATE REFERENCE SUBJECT: Award of Contract - Bridge Street PAGE NUMBER Improvements and 12" Water Supply Main 4/9/73 C-2505 and Other Facilities pp y 4 of 5 Following normal assessment policies, the proposed assessment for the Tommy Moore Tower Company property is $7,352.40 for pavement and curb plus $272.80 for driveway, for a total of $7,625.20. In keeping with standard procedure, Mr. Moore was notified of the proposed assessment following receipt of bids. Due to his objection to the proposed assessment, the appraiser was asked to review this property also. The appraisal report indicates that the Tommy Moore Tower Company property will be enhanced in value by an amount of $25,000. Project Cost and Financing Based on the low. bid, $15,144.70 will be assessed against abutting property owners, to be provided by a bond fund transfer from Revolving Fund Unspecified. Total construction, inspection engineering and administrative salaries and miscellaneous costs to the City for street and storm drain improvements will be approximately $589,226.09, for which sufficient funds are available in Project Account No. 104-23000-131. Cost to the City for Water Facilities is $109,795.68 to be provided for by a bond fund transfer from Major Mains Unspecified Projects. CITY OF FORT WORTH PUBLIC WORKS DEPARTMENT ENGINEERING DIVISION BRIDGE STREET IMPROVEMENTS AND 12B1 WATER SUPPLY MAIN AND OTHER WATER FACILITIES - PROJECT NO. 104-23000-131 AND 109-14000-4302 On Monday, March 19, 1973, at 7:30 P.M., a Neighborhood Meeting was conducted by the Engineering Division of the Public Works Department in the Public Works Conference Room, for the street and water facilities improvements on Bridge Street from Oakland Boulevard to Weiler Boulevard, Procedures concerning proposed improvements, type of improvements, owner participation in cost, credits to owners and methods of payment were explained by Odell Schmidt to the five persons in attendance. After the above explanation, the meeting was opened for questions. Mr. Garrett Morris and Mr. Dean Conlin, representing Woodhaven Country Club Estates, stated that they had no further questions and were satisfied with the proposed assessments. Mr. John B. Honts, an attorney, representing Mr. and Mrs. Tommy Moore, owners of Tract 1F, E. Jones Survey, stated that his clients had no idea that there would be an assessment. He was informed that almost all street improvement in the City of Fort Worth is accomplished on an assessment basis. Mr. Honts then stated that their appraiser stated that the property would-not be enhanced ._as a result of the proposed improvements. He was informed that the City Council will- not accept verbal statements of another person at the Benefit Hearing, but requires a written report from the appraiser and' in most cases in the past, the appraiser has been present at the hearing. Mrs. Tommy Moore, who was also present, stated that at the time they ALve the City the Construction Easements, the Land Office informed them that their drive- ways would be constructed at no expense to them. Mrs. Moore°s attention was called to M & C L-4215, 1/22/73, whereby the City obtainedthe easements for a total consideration of $13,500.00 and that in a conference with the Land Office prior to this meeting, no,mention was made of open agreements. Several general items were discussed and the meeting was adjourned. FORT"WORTH, TEXAS March 19, 1973 TO THE HONORABLE CITY COUNCIL OF THE CITY OF FORT WORTS, TEXAS. Gentlemen and Mrs. Rimmer; In accordance with the proceedings of your Honorable Body, I have prepared estimates of the cost of street improvements as shown below; Estimates of the total cost of improvements on a portion of BRIDGE STREET and portions of sundry other streets, avenues and public places in the City of Fort Worth, Texas, and estimated amounts per front foot to be assessed against abutting property and the owners thereof, on each portion of street, avenue and public place are as follows, to-wit; PROJECT NO. 104-23000-131, BRIDGE STREET, UNIT 1, FROM OAKLAND BOULEVARD TO WEILER BOULEVARD, to be improved by widening existing street to forty-four feet and by constructing thereon a seven-inch thick reinforced-concrete pavement on a six-inch thick lime stabilized sub$rade with seven-inch high super-imposed concrete curb.
