AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE GRANTS FUND IN THE AMOUNT OF $132,950 SUBJECT TO EXECUTION OF A
CONTRACT WITH THE U S EQUAL EMPLOYMENT OPPORTUNITY COMMISSION
FOR THE PURPOSE OF FUNDING FAIR EMPLOYMENT OPPORTUNITY ACTIVITIES
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS
SECTION 1
That in addition to~those amounts allocated to the various City departments for Fiscal Year 2005-2006
and in the Budget of the City Manager there shall also be increased estimated receipts and
appropriations in the Grants Fund in the amount of $132,950 subject to execution of a contract with the
U S Equal Employment Opportunity Commission for the purpose of funding Fair Employment Opportunity
activities.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance which said remaining
provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be incorporated into the ordinance of the municipal government of the City of Fort
Worth for the ensuing Fiscal Year beginning October 1 2005 and ending September 30 2006 and all other
ordinances and appropriations amending the same except in those instances where the provisions of this
ordinance are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect upon adoption

Process Employment Discrimination Cases for Fiscal Year 2005-2006 Adopt Appropriation
Ordinance and Authorize an Interfund Loan
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to execute a contract with the U S Equal Employment Opportunity
Commission (EEOC) in an amount up to $132,950
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in an amount up to $132 950' and
3 Authorize anon-interest bearing interfund loan from the General Fund to the Grants Fund in the
amount of $55 000 for interim financing for this grant, pending contract execution to ensure a smooth
transition from one grant funding period to another
DISCUSSION
In January 1977 the EEOC recognized the Community Relations Department (CRD) as a local deferral
agency and a Fair Employment Practice (FEP) Agency in accordance with Section 706 (c) of the U S
Equal Employment Opportunity Act of 1972, Title VII of the Civil Rights Act of 1964 as amended Pursuant
to this section the EEOC prior to asserting jurisdiction over employment discrimination charges defers
such charges for resolution to a local or state agency having authority to enforce a local or state fair
employment law similar to Title VII the Age Discrimination in Employment Act and the Americans with
Disabilities Act.
On July 26 2005 the Fort Worth Human Relations Commission voted to recommend acceptance of the
2005 Fair Employment Practices Agency Contract with the U S Equal Employment Opportunity
Commission as follows.
a. $125 000 for resolution of 250 charges of alleged discrimination at a cost of $500 per case
b $6 750 for deferral of 135 non-jurisdictional charges of discrimination at a cost of $50 per case and
c. $1,200 for partial reimbursement of expenses relating to mandatory training at an EEOC sponsored
annual conference
Upon review of the CRD submittal and receipt by EEOC of the congressional appropriation for funding of
FEP agencies, the finalized contracts will be forwarded to the City Manager for signatures. Historically this
occurs late in the second quarter of the fiscal year

Upon execution of this contract, 50% of funds are usually paid late in the second quarter and the remaining
50% are paid upon certification of contract completion by EEOC The interfund loan will provide program
funding until payments are received
FISCAL INFORMATION/CERTIFICATION
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance funds will be available in the FY2005-06 operating budget, as
appropriated of the Grants Fund After the contract is executed interim financing will be returned to the
General Fund
