AN ORDINANCE DECLARING CERTAIN FINDINGS PROVIDING FOR
THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF
FORT WORTH PROVIDING FOR THE ANNEXATION OF
APPROXIMATELY 1 71 ACRE TRACT OF LAND SITUATED IN THE
E H ELKINS SURVEY ABSTRACT NO 487 AND THE H
ROBERTSON SURVEY ABSTRACT NO 1259 AND BEING THAT
CERTAIN PORTION OF WAGLEY ROBERTSON ROAD (COUNTY ROAD
PROJECT NO 4108) (CASE NO AX 05 025) WHICH SAID
TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT
CORPORATE BOUNDARY LIMITS OF FORT WORTH TEXAS
PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO
RATA PART OF TAXES PROVIDING THAT THE INHABITANTS
THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE
CITIZENS OF FORT WORTH TEXAS PROVIDING THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT
HEREWITH PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT
CONFLICT PROVIDING FOR SEVERABILITY AND NAMING AN
EFFECTIVE DATE
WHEREAS a public hearing before the City Council of the City of
Fort Worth Texas wherein all interested persons were provided an
opportunity to be heard on the proposed annexation of the territory
hereinafter described was held in the City Council Chambers in the
Municipal Office Building of Fort Worth Texas on the 20th day of
September 2005 and
WHEREAS a second public hearing before the City Council of the
City of Fort Worth Texas wherein all interested persons were
provided an opportunity to be heard on the proposed annexation of
the territory hereinafter described was held in the City Council
Chambers in the Municipal Office Building of Fort Worth Texas on
the 4th day of October 2005 and
WHEREAS notice of the first such public hearing was published in
a newspaper having general circulation in the City of Fort Worth
Texas and in the hereinafter described territory on the 9th day
of September 2005 and posted on the City of Fort Worth s Internet
web site on the 9th day of September 2005 and
WHEREAS notice of the second such public hearing was published
in a newspaper having general circulation in the City of Fort
Worth Texas and in the hereinafter described territory on the
23rd day of September 2005 and posted on the City of Fort Worth s
Internet web site on the 23rd day of September 2005 and
WHEREAS prior to the posting and publication of the notices of
public hearings a Service Plan providing for the extension of
municipal services into the hereinafter described territory was

prepared for inspection by and explanation to the inhabitants of
the area to be annexed and
WHEREAS the population of the City of Fort Worth Texas is in
excess of 100 000 inhabitants and
WHEREAS the hereinafter described territory lies within the
exclusive extraterritorial jurisdiction of the City of Fort Worth
Texas and
WHEREAS the hereinafter described territory lies adjacent to and
adjoins the City of Fort Worth Texas and
WHEREAS the hereinafter described territory contains
Approximately 1 71 acres of land (0 002 square miles) of land more
or less
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH TEXAS
SECTION 1
That the following described land and territory lying adjacent
to and adjoining the City of Fort Worth Texas is hereby added to
and annexed to the City of Fort Worth Texas and said territory
hereinafter described shall hereafter be included within the
boundary limits of the City of Fort Worth Texas and the present
corporate boundary limits of said City at the various points
contiguous to the area hereinafter described are altered and
amended so as to include said area within the corporate limits of
the City of Fort Worth Texas to wit
BEGINNING at the northeast corner of that certain 1st Tract
conveyed to Todd Group Ltd recorded in Volume 10768 page
1290 of the Tarrant County Deed Records iri said road said
point being by description 3893 33 feet southerly along the
east line of said Hibbins Survey and the west line of the said
Robertson Survey from the northeast corner of said Hibbins
Survey
THENCE north 89 degrees 59 minutes 20 seconds East in said road
24 5 feet to a point in said east line of road as described in
said Ordinance No 6390

line of road as described in Ordinance No 6390 3034 78 feet
THENCE North 88 degrees 57 minutes West in said road 24 5 feet to
the northeast corner of that certain Tract D described in deed
to Texas Electric Service Company recorded in Volume 6937
Page 1547 of said Deed Records in the common line between
said Elkins and Thomas Surveys and in the east line of said
Todd Group 1st Tract
THENCE North 0 degrees 49 minutes 20 seconds East with said east
line of Todd Group 1st Tract and with said common between
Elkins and Thomas Surveys and continuing with the common
survey line between said Robertson and Hibbins Surveys in all
3034 33 feet to the PLACE OF BEGINNING and containing 1 71
acres

That the above described territory is shown on Map Exhibit A
which is attached hereto and expressly incorporated herein by
reference for the purpose of illustrating and depicting the
location of the hereinabove described territory
SECTION 3
That the above described territory hereby annexed shall be
part of the City of Fort Worth Texas and the property so added
hereby shall bear its pro rata part of the taxes levied by the City
of Fort Worth Texas and the inhabitants thereof shall be entitled
to all of the rights and privileges of all the citizens in
accordance with the Service Plan and shall be bound by the acts
ordinances resolutions and regulations of the City of Fort Worth
Texas

SECTION 4
That the Service Plan attached hereto as Exhibit X was made
available at the public hearings for inspection by and explanation
to the inhabitants of the area to be annexed and is approved and
incorporated into this ordinance for all purposes
SECTION 5
That this ordinance shall and does amend every prior ordinance
in conflict herewith but as to all other ordinances or sections of
ordinances not in direct conflict this ordinance shall be and the
same is hereby made cumulative
SECTION 6
That it is hereby declared to be the intent of the City
Council that the sections paragraphs sentences clauses and
phrases of this ordinance are severable and if any phrase clause
sentence paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction such unconstitutionality shall not affect
any of the remaining phrases clauses sentences paragraphs and
sections of this ordinance since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any unconstitutional phrase clause sentence paragraph or
section
SECTION 7
That should this ordinance for any reason be ineffective as to
any part or parts of the area hereby annexed to the City of Fort
Worth the ineffectiveness of this ordinance as to any such part or
parts shall not affect the effectiveness of this ordinance as to
the remainder of such area The City Council hereby declares it to
be its purpose to annex to the City of Fort Worth every part of the
area described in Section 1 of this ordinance regardless of
whether any part of such described area is hereby not effectively
annexed to the City Provided further that if there is included
within the description of territory set out in Section 1 of this
ordinance to be annexed to the City of Fort Worth any area which is
presently part of and included within the limits of the City of
Fort Worth or which is presently part of and included within the
limits of any other city town or village or which is not within
the City of Fort Worth s jurisdiction to annex the same is hereby
excluded and excepted from the territory to be annexed hereby as
fully as if such excluded and excepted area were expressly
described herein

That this ordinance shall take effect upon adoption

1 PROGRAM FOR SERVICES TO BE PROVIDED ON THE EFFECTIVE DATE OF THE
ANNEXATION
The City will provide the following ervices the Annexation Area the effective date of the ation, nless
otherwise oted.
A. Police Protection
The Fort Worth Police Department will provide protection nd law nforcement ervices the Annexation
Area ommencing the effective date of ation. The ervices will dude:
Normal patrols nd esponses to calls for ervice
Handling of offense nd ident eports
Special units, ch traffic nforcement, criminal stigations, otics law nforcement,
gang uppression, and crime sponse team deployment when equired.
These services provided itywide basis. The will initially be ombined with sting Police
Reporting Area (PRA), Q210 The will be Neighborhood Policing District 3 Beat C13
B. Fire Protection
Fire protection ervices will be provided by sting personnel nd equipment of the Fort Worth Fire
Department. These ervices will be provided based upon ilable water ad nd street nditions, nd
distances from sting fire stations. Services will be provided to the ation ommencing the
effective date of the ation. These ervices dude:

These ervices provided itywide basis. All Fort Worth firefighters ertified by the T
Commission Fire Protection.
On the date of anon, the first sponding fire ervices will ome from Fire Station 401ocated at 8510
Spring Street. The red sponding fire ompany will be from Fire Station 31 located at 4209 Longstraw
Drive. The Fire Department stimates the spouse time to be 10.5 red 12.8 minutes, spectively
C. Emergency Medical Services
Emergency medical ervices by sting personnel red equipment of the Fort Worth Fire Department will
be provided to the anon ommencing on the effective date of the annexation. The Fort Worth
Fire Department erves the first sponder lafe threatening medical emergencies part of the
MedStar system. All Fort Worth Fire Department personnel ertified Emergency Medical
T chmcian basic level higher All ngmes, trucks, red its any Automatic External
Defibrillators for with heart attack ctims.
Advanced Life Support response provided by MedStar greater than 9 minutes to the proposed anon
rea with potential of at least 30-minute transport time to the Barest trauma nter
D Solid Waste Collection
Solid waste ollection shall be provided to the Annexation Area rdance with sting City
rdinances red policies ommencing the effective date of the anon. Private solid waste ervice
providers nder retract with the City will provide ervices. Persons ng the ervices of privately
owned olid waste management ervice provider other than the City' retracted ervice provider may
continue to use uch services until the cored ary of the xation.
Private service providers at the discretion of the stomer may provide solid waste ollection services for
businesses and multi-family dwelling complexes having three more its.
E. Operation and Maintenance of Water and Wastewater Facilities
The anon Area located the CCN of the City of Fort Worth. The City will provide water and
ewer ervice to the Annexation Area, at the developer' st, rdance with the `Installation Policy of
Community Facilities"
F Operation and Maintenance of Roads and Streets Including_Street Lighting
The following ervices will be provided the Annexation Area ommencing the effective date of the
xation, mess otherwise noted.
The T sportation and Public W rks Department will ume maintenance of public streets which
the City has jurisdiction. These ervices dude emergency pavement epair red epair maintenance of
public streets eded basis. Public streets will be cluded the City' preventive maintenance
program, Preventive maintenance projects prioritized Citywide basis red cheduled based a

Streetlights stalled improved public streets shall be maintained by the City of Fort Worth

Worth.

G Operation and Maintenance of Parks, Playgrounds, and Swimming Pools
Residents of this property may utilize all sting parks nd community ervice facilities throughout the
City beginning with the effective date of the annexation. Existing parks, playgrounds, swimming pools
nd other reational nd community facilities within the Annexation Area that re private facilities will
be affected by the ation.
Existing parks, playgrounds, swimming pools and other ational nd ommunity facilities within this
property shall, upon deeding to nd cceptance by the City nd appropriations for maintenance nd
operations, be operated by the City of Fort Worth, but of otherwise.
H. Operation and Maintenance of Any Other Publicly Owned Facility, Building or Service.
In the vent the City acquires ny other facilities, buildings ervices ary for municipal ervices
located the Annexation Area, the appropriate City department will provide maintenance services.
2. PROGRAM FOR PROVIDING ADDITIONAL SERVICES
In addition to the ervices identified above, the following ervices will be provided the Annexation Area the
effective date of the annexation, nless otherwise oted.
A. The idents of the Annexation Area will library ervices from the Fort Worth Public Library
ommencing on the effective date of the ation.
B. The City will provide general municipal administration nd administrative ervices.
C. The Transportation and Public W rks Department will provide drainage maintenance services the
Annexation Area at urgent itywide ervice levels. The City will ume maintenance for all public
drainage channels within dedicated public drainage ements.
The Transportation and Public W rks Department will provide the following ervices.
Storm ewer maintenance;
Watershed development ew nd inspection.
The Environmental Management Department will provide the following ervices.
Emergency spills nd pollution omplaint spouse;
Storm ewer discharge pollution prevention Water quality sments for eks.
The Department of Engineering will provide nformation elating to flood plains.
D Enforcement of the City's ode nd nmental health rdinances nd egulations, ncluding but of
limited to weed and brush rdinances, junked nd abandoned vehicle rdinances, food handlers rdinances
nd imal ntrol rdinances, will be provided within the Annexation Area the effective date of the
ation. Complaints of rdinance egulation olations within the will be swered nd
stigated by sting personnel within the appropriate department beginning the effective date of the
ation.
E. The City's building, plumbing, mechanical, elecMcal, nd all other onstruction odes will be nforced
within the Annexation Area beginning with the effective date of the ation.
F The City's ing, ubdivision, ign, manufactured housing, dunk yard nd other rdinances shall be
nforced the Annexation Area beginning the effective date of the annexation.

G All spection services furnished by the City of Fort Worth, but of mentioned above, will be provided to
the Annexation Area beginning the effective date of the ation.
PROGRAM FOR PROVIDING FULL MUNICIPAL SERVICES WITHIN 2 1/2 YEARS
In addition to the ervices listed above, the City will provide full municipal ervices to the Annexation Area
ommensurate with the levels of ervices provided other parts of the City ept if differences topography land
use, nd population density nshtute sufficient basis for providing different levels of ervice, later than two
nd one-half (2 %2) years after the effective date of the ation. If full municipal services nnot be ably
provided within the aforementioned time period, the City will propose chedule for providing id ervices within
period of four and ne-half (4-''/2) years after the effective date of the ation, nd/or upon ommencement of
development of subdivision within this property whichever later

A. Police Protection. No capital improvements ecessary at this time to provide police protection to the
Annexation Area. N ed for onstruction of ew facilities will be ed periodically based population
growth, predicted growth, nd al] olume.
B. Fire Protection. Existing fire stations will not meet the un ent esponse time goal. Consideration should
be given to structing new stations and staffing ew facilities prior to final decision to omplete
ation. Fire Station 38, when opened mid-2006, at the intersection of Park V ista nd State Highway
170, will improve our response times to this area. Based the travel distance to the proposed ation
rea, consideration must be given to staffing those ew stations with at ]east two fire ompanies.
C. Solid Waste Collection. No apita] improvements necessary at this time to provide olid waste
ollection ervices to the Annexation Area.
D Water and Wastewater. As development of ubdivisions ommences within this property the property
owner rdance with provisions of the City' Subdivision Ordinance, Policy for Installation of
Community Facilities nd other applicable policies, rdinances, nd egulations will xtend water nd
ewer mains. City participation the sts for ng these xtensions shall be rdance with
applicable City policies, rdinances, nd egulations.

streetlights when the oadway widened to four lane dwided arterial street.
H. Parks. Playgrounds. and Swimming Pools. Capital improvements ch parkland cquis~tion nd
development of facilities will be dictated by future land of the goals stablished by the Parks,
Recreation nd Open Space Master Plan and appropriation of ources. Should additional idential
development parkland dedication, ~ghborhood park development nd ighborhood park
nfrastructure payment lieu thereof will be equired rdance with the Park Policy of the
Subdivision Ordinance.
Other Publicly Owned Facilities, Building or Services. Additional Services. In genera], other City
functions nd services, nd the additional ervices described above be provided for the Annexation
Area by ng fisting apital improvements. Additional apital improvements re not ary to
provide City ervices.
5. IMPACT FEE5
Notwithstanding ny other provision of this ervice plan, landowner within the Annexation Area will not be
equired to fund apital improvements ary to provide municipal ervices manner istent with
Chapter 395 of the Local Government Code governing impact fees, unless otherwise agreed to by the landowner

RECOMMENDATION
It is recommended that the City Council institute and approve the annexation of approximately 1 71 acres of
land located south of Bonds .Ranch Road and north of Bailey Boswell Road the existing right-of-way of
County Road 4108 in Tarrant County
DISCUSSION
On September 6 2005 (M & C PZ 2611) the City Council approved the timetable for annexing the above
referenced property into the City of Fort Worth Public hearings concerning the annexation request were
held as required by state law on September 20 and October 4 2005
The subject property is situated within the exclusive extraterritorial jurisdiction of the City of Fort Worth The
eastern boundary of this property is contiguous with the City of Fort Worth
OPERATIONAL IMPACT -The Police Department has estimated an impact of $153 00 due to anticipated
calls for service to the proposed annexation area. The Transportation and Public Works Department has
estimated an initial cost of $2,000 in startup costs for pavement markings and signs and an annual routine
maintenance cost of $2,100
LOCATION -The subject property is located south of Bonds Ranch Road and north of Bailey Boswell
Road the existing right of way of County Road 4108 in Tarrant County
If annexed this property will become a part of COUNCIL DISTRICT 7
