HomeMy WebLinkAboutOrdinance 6222 r s s ORDINANCE NO. .;L •� ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF LANG AVENUE EXTENSION AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH AUSTIN ROAD WORTH CONSTR. & C. 2gAWOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED ORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Austin Road, Worth Constr, & C. Cohen, InBor the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in .said City, to-wit: 1. LANG AVENUE EXTENSION: From the East line of Decatur Avenue to the West line of Deen Road, known and designated as Unit 8, Project No. 104-24000-104, Contract 9. 2. SCHWARTZ AVENUE: From the North line of NE 33rd Street to the South line of Maydell Avenue, known and designated as Unit 8-A, Project No. 104-24000-176. 3. DIXIE STREET: From the West line of Lot 7, Block 2, Rondell Addition to the East line of Lot 7, Block 22 Rondell. Addition, known and designated as Unit 8-B, Project No. 104-23000-104, Contract 9. 4. NE 33rd STREET: From 650 feet West of Deen Road to 670 feet West, known and designated as Unit 8-C, Project No. 104-23000-104, Contract 9. WHEREAS, by sundry proceedings heretofore passed by the City Council of the city of Fort Worth, Texas, including Crdinance No. 5874 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real ane true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5874 .9 and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT- I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. IT. The Mayor, be, and he is hereby, directed to issue and execute in the name cf the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Project Description Name: Long Avenue Extension, Unit VIII, Project Number 104-23000-104 and 104-24000-176 Contractor: Austin Road and Worth Construction Company, and C. Cohen, Inc. Contract Awarded: September 25, 1967 (M&C C-1070) Work Order Issued: October 30, 1967 (Partial Work Order for Drainage Channel) May 28, 1968 (Full Work Order) Work Order Effective: November 10, 1967 Date of Final Inspection and Approval: October 16, 1969 Working Time Bid: 200 + 15 = 215 Working Days (Change Order No. 1, M&C C-1174, March 4, 1968) Working Time Used: 213 Working Days Contract Time A partial work order was issued for this project on October 30, 1967, so that the contractor could proceed with the drainage work involved. At the time certain land parcels had not been fully acquired, and there were some utility conflicts which precluded full scale construction operations. During initial drainage construction, the contractor uncovered a 6-inch water main, which serves the Stauffer Chemical Company and which was not reflected on the drainage and paving plans. The ultimate relocation time for this water facility consumed some three months. Further, the contractor uncovered a gas and a products line (Permian) main, also not shown on the plans , and this adjustment caused a two month shut-down on the drainage project. Over the entire period in which this project was built there were many inclement days that not only delayed the construction and scheduling of the drainage and paving, but also slowed the utility relocation and/or adjustment work. Tests made during construction show that materials used were in compliance with specifications. Recommendation It is recommended that the above project be accepted as complete by the adoption of an ordinance and that final payment of $61,369.20 be authorized to Austin Road and Worth Construction Company, and Chas.
