AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
WEST PETER SMITH STREET
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
WEST PETER SMITH STREET From Forest Park Boulevard to Fifteen Avenue,
known and designated as Project No. 104-35000-
361, a seven-inch chick reinforced concrete
pavement on a six-inch thick lime stabilized
subgrade with seven-inch high superimposed
concrete curb on a forty foot roadway. Six-inch
thickconcrete driveways will be constructed
where specif:_ed.

together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewers/ and drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefore has been made and
entered into with Texas B:i_tuli.thic Company ;
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:

The estimated cost of improvements is $ 100.510.13 the estimated amount
per front foot to be assessed against abutting property and the owners thereof for superim-
posedconcrete curb 666ftd-t-t his $ 1.33 ; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 35.42
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ 1.70 per square foot; the total
estimated amount per front foot to be as against abutting property and the owners
thereof is $ 36.75 , plus the cost incurred for concrete driveway construction
where specified.

III.
A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or claiming any iRerest in any such property. Such hearing shall be
given and held on the 77 rr}- day of February , 19 75 , at 9:30 A.M?
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice ,of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May- 12, 1967. Such notice shall be by advertisement inserted
at least three (3) times in a newspaper published in the pity of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before
the date of said hearing. Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United States Mail at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names of such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to ,such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be ,improved is listed as "unknown" on the then current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown,' no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the_
properties to be assessed, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses determined as aforesaid of the respective owners and those peri
sons owning or claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy ,of the notice of hearing and shall further certify
the date or dates on which said notice was mailed. A copy of each notice shall be
attached to such' certificate. The certificate of the City Secretary will be con-
clusive evidence of the facts therein recited.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

City Council action is requested on Project No. 104-35000-361, as described
below.
Project Description

Initiation of Project
In August, 1969, the City Water Department requested West Peter Smith Street
be opened across the levee and Frisco tracks to give access from 15th Avenue
to Forest Park Boulevard. Preliminary plans were prepared and presented to
Tarrant County Water Control and Improvement District No. 1, the U. S. Army
Corps of Engineers, and the Railroad Company. Strong opposition was encountered
from each of the above and no agreement was reached as to grades across the
levee.
By letter addressed to the Mayor and Council on October 6, 1972, Holiday
Lincoln Mercury, Inc. , requested West Peter Smith Street be extended across
the levee to Forest Park Boulevard to facilitate access to their property east
of the levee. The Holiday Lincoln Mercury property east of the levee consists
of an entire block bounded by West Peter Smith, 15th Avenue, West Broadway
and the levee, which has recently been developed.
As a result of the above referenced request, renewed efforts were initiated
by the Public Works Department with the Water Control Board, Corps of Engineers
and the Frisco Railroad Company to reach an agreement as to the street crossing
over the levee and railroad tracks. Plans have been approved and agreements
reached with the above agencies and other City departments.
Improvements
This section of West Peter Smith will be improved with industrial grade concrete
pavement with superimposed curbs and concrete driveway approaches. Also
included are required storm drain facilities to serve the immediate areas east
and west of the levee of the-Clear Fork of the Trinity River.
Railroad Agreement
It will be necessary for the City to enter into an agreement with the St. Louis
San Francisco Railway Company for improvements to the railroad crossing. It is
proposed that:

a) The Railroad Company agree to, at its own expense, install and
maintain a 64-foot full depth timber crossing on its main
track and spur line.
b) The Railroad Company agree to install and pay one-third of the
cost to install automatic grade crossing protection devices at
the crossing location. Estimated City cost is $20,000.
c) The Railroad Company agree to adjust the grade of its spur track
to meet the grade of West Peter Smith Street, the cost of which
will be reimbursed by the City. Estimated cost of this work is
$4,000.

Proposed Assessments and Enhancement Appraisal
Adjacent to this section of West Peter Smith Street are several unusual condi-
tions as related to assessment cost to adjacent benefitted property; the zoning
and use of properties is mixed, plus the grade differential of the proposed
street relative to the adjacent property. Consequently, an independent land
appraiser has been retained to appraise the adjacent properties as to enhance-
ment resulting from the proposed street improvement. Results of the appraisal
will be presented at the Benefit Hearing.
Project Cost and Financing
Based on the low bid and standard policy, approximately $11,807.71 will be
assessed against abutting property owners, which will be provided for by a
Bond Fund Transfer from the Revolving Fund Unspecified. Cost to the City for
construction, engineering, administration and miscellaneous costs is approxi-
mately $96,394. Estimated right-of-way cost is $9,900. The estimated cost to
the City for installing the railroad crossing protection devices is $20,000,
plus $4,000 for adjusting the spur track, making the total project cost to the
City, $1.30,294, to be provided for by a bond fund transfer from the appropriate
unspecified account.

On Monday, December 30, 1974, a Neighborhood Meeting was conducted by th'E;
Engineering Division of the Public Works Department for the Assessment Pav-
ing on Peter Smith Street.
Mr. Albert J. Hopkins, owner of Lot B, Block 30, Edward Heirs Addition, As
the only property owner present.
Mr. Schmidt explained to him the procedures concerning proposed improvements,
owner participation in costs, and methods of payment.
Mr. Schmidt also explained the guidelines of State Statute 1105B as pertains
to assessments and enhancement of abutting properties and that in this case
an Independent Land Appraiser would be retained to appraise the adjacent
properties in order to determine the enhancement of properties as a result
of the street improvement.
Mr. Hopkins said that he was not objecting to the improvements but that the
cost was too high. He said he felt that Holiday Lincoln Mercury would he
benefited far more than he.
After a short general discussion the meeting was adjourned.
