V r OR ALTERATION OF ELECTRICAL EQUIPMENT; PROVIDING INSPECTION FEI F1. WOM111, TEX. FOR PATS AND FIXING THEIR AMOUNTS; PROVIDING FOR APPLICATION FOR PERMIT BY TELEPHONE; PROVIDING AN INSPECTION FEE; PROVIDING FOR REVOCATION AND SUSPENSION OF LICENSES; PROVIDING PENALTIES; PROVIDING THAT EACH DAY A VIOLATION COINTINUES SHALL CONSTITUTE A SEPARATE OFFENSE; MAKING THIS ORDINANCE CUMULATIVE OF ALL PRIOR ORDINANCES REGULATING THE INSTALLATION OF ELECTRICAL WIRING AND APPARATUS; PROVIDING A SEVMABILITY CLAUSE; MAKING THE. ENFORCE- MENT HEREOF GOVERNMENTAL; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Articles 1 and 2 of Section 7, of Ordinance No. 3658 are hereby amended, and after having been so amended, shall here- after read as follows: Article 1. Within the corporate limits of the City of Fort Worth, no electrical equipment shall be installed within or on any building, structure or premises publicly or privately owned, nor shall any alteration or addition by made to any such existing equipment without application having first been made to the Chief Electrical Inspector for a permit and his approval having been given to proceed with such work. Article 2. Application for permit, describing the work to be done, shall be made to the Chief Electrical Inspector by the licensed Master Electrician installing the work. When required by the Chief Electrical Inspector, the application shall be accompanied by such plans, specifications, and schedules as may be necessary to determine whether the installation as described will be in conformity with the requirements of this Ordinance. Such plans, if required by the Chief Electrical Inspector, shall be signed by a Registered Electrical Engineer. If it shall be found that the installation as described will conform with all legal requirements, and if the licensed Master Electrician has complied with all provisions of this Ordinance, the Chief Electrical Inspector may authorize the applicant to proceed with the work. No permit shall be issued for electrical fences. SECTION 2. That Article 1 of Section 8, of Ordinance No. 3658 is hereby amended and after having been so amended shall hereafter read as follows: Article 1. The licensed Master Electrician who has made application for permit, as described under Section 8, shall pay to the City of Fort Worth at the Electrical Inspector's office inspection fees in such amounts as are specified below: (1) For the first ten (10) outlets for lighting fixtures, switches, or receptacles-one dollar and fifty cents ($1.50) minimum; for each additional outlet for lighting fi:ctures, switches, or receptacles-ten cents (10¢). (2) For the first ten (10) lighting fixtures-one dollar and fifty cents ($1.50) minimum; for each additional lighting fixture- ten cents (10¢). (3) For each ceiling fan-twenty-five cents (25¢). (4) For each motor, including motor controls, up to and including three-fourth (3/4) horsepower-seventy-five cents (75¢1; over three-fourth (3/4) and less than five (5) horsepower-one dollar and fifty cents ($1.50); five horsepower and less than fifteen (15) horsepower-three dollars (4$."3.00); fifteen (15) horsepower and less than fifty (50) horsepower-four dollars ($4.00); fifty (50) horsepower and less than one hundred (100) horsepower- five dollars ($5.00); one hundred (100) horsepower and over-ten dollars ($10.00). (5) For each electric generator up to and including ten (10) kilowatts-five dollars ($5.00); over ten (10) kilowatts-ten dollars ($10.00). (6) For billboard lighting-fees as provided herein, according to the number of openings and the number of fixtures and according to the size of the service. (7) For primary wiring to each sign-one dollar ($1.00) for the first circuit, and fifty cents (50¢) for each additional circuit. (8) For each sign connection-one dollar ($1.00). (9) For connection of sign to existing circuit-one dollar ($1.00). (10) For each X-ray machine-ten dollars ($10.00). (11) For each motion picture projection machine-five dollars ($5.00). (12) For each complete unit of motion picture sound equip- ment, including circuit, pick--up devices, sound panel, and speakers within the building-five dollars ($5.00), and twenty-five cents (251) for each additional speaker outside of the building. (13) For each rectifier-one dollar and fifty cents ($1.50). (14) For each domestic electric range-one dollar and fifty cents ($1.50). (15) For each commercial electric range-three dollars ($3.00). (16) For each transformer type welder installation-one dollar and fifty cents ($1.50). (17) For generator type welders-according to size of motor as provided herein. (18) For each service, not exceeding thirty (30) amperes- one dollar ($1.00); over thirty (30) amperes but not exceeding sixty (60) amperes-one dollar and fifty cents ($1.50); over sixty amperes, but not exceeding one hundred (100) amperes-two dollars ($2.00); over 100 amperes-five dollars ($5.00). (19) For each power transformer-two dollars ($2.00). (20) For each bell-type transformer-twenty-five cents (25f). (21) For temporary service-two dollars ($2.00). (22) For festoon lighting-one dollar ($1.00) for each circuit. (23) For each kiln--one dollar and fifty cents (,',1-50)- (24) For each mobile-home trailer-one dollar ($1.00) in addition to service fee. (25) For each room heater-fifty cents (50¢). (26) For each dryer-one dollar 01.00). (27) For each domestic precipitator-two dollars ($2.00). (28) For each low voltage switch-fees as provided herein for similar equipment of high voltage rating. (29) For each commercial or industrial precipitator-five dollars ($5.00). (30) For each window-type air conditioner-seventy-five cents (750. (31) For each set of boiler controls-two dollars ($2.00). (32) For each set of central air conditioning controls- twenty-five cents (25¢)- (33) For each electric hot water heater-one dollar ($1.00). (34) For each commercial dimmer-one dollar ($1.00). (35) For each floor furnace-one dollar ($1.00). (36) For each computing machine-two dollars ($2.00). (37) For minor repairs involving neither new installations nor relocating existing equipment-two dollars ($2.00). (38) For installation of electrical equipment not herein specified-two dollars ($2.00). (39) For built-in electric coffee maker-seventy-five cents (751). (40) For built-in range top-one dollar ($1.00). (41) For built-in oven-one dollar ($1.00). (42) For electric heat strips each-one dollar ($1.00). (43) For service center in kitchen-seventy-five cents (75¢)• (44) For vent fans-twenty-five cents (25¢). (45) For central heater-one dollar and twenty-five cents ($1.25)- (46) For coin operator dry cleaning machines-two dollars ($2.00). (47) For yard post light-one dollar and fifty cents ($1.50). (48) For residential dimmers-fifty cents (50¢). (49) For electric deep fat fryer-one dollar ($1.00). (50) For dental X-ray-one dollar and fifty cents ($1.50). (51) For electric griddle-seventy-five cents (75¢). (52) For automatic washing machine-seventy-five cents (75¢). (53) For disposal unit-seventy-five cents (75¢). (54) For dishwasher, residential-seventy-five cents (75¢). (55) For dishwasher, commercial-one dollar ($1.00). (56) For telephone booths-one dollar ($1.00). SEC`T'ION 3. That there shall be added to Section 8 of Ordinance No. 3658 a new paragraph, to be known as Article 1-A, which shall be and read as follows: Article 1-A. The Building Official may make and issue, in writing, such regulations in connection with the filing of applications for permits by phone as he may deem necessary for the collection of inspection fees and the proper enforcement of the Electrical Ordinance. SECTION 4. That ?sticle 4 of Section 8 of Ordinance No. 3658 is hereby amended and after having been so amended shall hereafter read as follows: Article 4. When work is found to be in progress or completed for which no application for permit has been made or authori- zation to proceed with the work granted by the Chief Electrical Inspector, an investigation fee of double the amount of the inspection fee shall be added to the inspection fee, the total amount of which shall be paid by the person, firm or corporation doing such work, except that work done by licensed Journeyman Electricians under the supervision of licensed Master Electricians at night and on Saturday, Sunday and holidays for which application for permit is made between 8.00 A. M. and 9:00 A. M. on the first regular working day after which work has been done shall not be charged with an investigation fee. Pay- ment of such investigation fee shall in no way excuse such person, firm or corporation from the penalty set forth in Section 17 for any violation of this Ordinance. SECTION 5. That Articles 7 and 8, Section 13 of Ordinance No. 3658 are hereby amended and after having been so amended shall hereafter read as follows: Article 7. The City Council upon the recommendation of the Electrical Board, City of Fort Worth, may revoke and cancel any license issued or renewed under the terms of this Ordinance if and when it has evidence that the holder of any license is incompetent or otherwise unfit to install in a safe manner electrical wiring or equipment as provided herein, or if and when it determines that the holder of any such license is not of good moral character, and upon such revocation and cancellation such license shall be and become null and void, and cannot be renewed. thereafter. Article 8. The Electrical Board of the City of Fort Worth may on its own motion or upon recommendation by the Chief Electrical Inspector, after hearing, suspend the license of any holder of a license under this Ordinance where such holder has been convicted more than once during any one calendar year in any Court having ,jurisdiction for violation of any of the provisions of this Ordinance. Such suspension of license may be for a period not to exceed six (6) months. After termination of the period of suspension such license shall again be valid and effective, provided the renewal fees, which may have become due thereon, were paid when due. The City Council of the City of Fort Worth may revoke and cancel the license of any license holder under this Ordinance for reason of conviction of any felony or refusal to comply with the provisions of this Ordinance. SECTION 6. That any person, firm, corporation, or any agent or employee thereof, who violates any other provision of this Ordinance shall be fined not to exceed Two Hundred ($200) Dollars for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 7. That this Ordinance shall be and is hereby declared to be cumulative of all other Ordinances of the City of Fort Worth regulating the installation of electrical wiring and apparatus; and this Ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this Ordinance, in which event such conflicting provisions, if any, in such other ordinance or ordinances are hereby repealed. SECTION 8. If any subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such holding shall not affect the validity of the remaining portions of this ordinance; and all of the remainder of this ordinance not so held to be unconstitutional shall continue to be in full force and effect. SECTION 9. That all of the regulations provided in this ordinance are hereby declared to be governmental and for the health, safety, and welfare of the general public. Any member of the City Council, any city official or employee charged with the infringe- ment of this ordinance acting for the City of Fort Worth in the discharge of his duties is not thereby rendering himself personally liable; and he is hereby relieved from all personal liability for any damage that might accrue to persons or property as a result of any act required or permitted in the discharge of his said duties. SECTION 10. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. The following is a summary of proposed amendments to the Electrical Code Ordinance No. 3658, which up-date the procedure for making permit applications, the items for which inspection fees are charged, the handling of fee collec- tion, and the basis for revoking and cancelling licenses. Section I Articles 1 and 2 of Section 7. These articles are amended from the requirements of the present ordinance that applications for permits shall be made in writing, permitting them, under some conditions, to be made by telephone, and it also allows the Chief Electrical Inspector to authorize the applicant to proceed with the work when the Inspector's investigation shows that it will be in accordance with ordinance require- ments. Section II Article 1 of Section 8. This article is amended by adding to the items of electrical installations for which inspection fees are charged. The great number of new special electrical appliances that have come into use since Ordinance No. 3658 was adopted makes this desirable. Section III Article 1-A. This gives the Building Official authority to make regulations necessary for the collection of inspection fees where application for permits are filed by phone. Section IV Article 4 of Section 8. The change in this article permits emergency electrical work to be done on Saturday, Sunday, and Botidays, provided that application for permit is made at the beginning of the first regular working day thereafter. Section V Articles 7 and 8 of Section 13. These articles of Ordinance No. 3658 now provide for automatic suspension of licenses whenever a license holder is convicted of ordinance violation in any court of jurisdiction. Board to suspend licenses for a period not to exceed six months if a license holder is convicted more than once in any one calendar year. Only the City Council will have the authority to permanently revoke and cancel a license. This change will result in misdemeanor cases being filed against license holders for ordinance violations which action has heretofore 'been avoided by the electrical inspectors because of the severe penalty which would automatically result from conviction. Both the old and new Electrical Sga%*have reviewed the proposed amendments and recommend that the City Council adopt an ordinance enacting the changes outlined above.
