ORDINANCE NO. ✓l Z23 ORDINANCE ACCEPTING IMPROVNTS ON A PORTION OF YEAGER STREET AND PORTIONS OF SUNDRY OTHER STRIMETTS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WaRTH, TEXAS; DECLARING THE CONTRACT WITH R. W. GIBBINS, INC. FOR THE CONSTRUCTION OF SAI IMPROV I4ENTS FULLY COMPLVETED AND PERFCRMEV, DIRECTING THE ISSUA FICIAL REETCORD EXECUTION AND DDELIVERY OF CERTIFICATES IN 77IDENCE OF SPECIAL A SSSS- SECRETARY MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEI+EIN AUTH AND ALLOWED AGAINST SOME OF SAID ASSESSKMS; DIP-riCTING THE CIT SECRMTARY TO ENGROSS AND ENROLL THIS OFDI?'ANCE BY COPYING THT C T. WORTH, TEX. TION OF SAME IN THE MINUTE BOON OF THE CITY COUNCIL OF 3MT WCRET , TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AND EFF?:CTIVE DATE. SBthe City of Fort Worth, Texas, has heretofore entered into a contract with NC for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit; 1. YEAGER STREET: From Lancaster Avenue to Beaty Street, known and designated as Unit No. 1. 2. YEAGER STREET: From Beaty Street to Greenlee Street, known and designated as Unit No. 2. 3. YEAGER STREET; From the South line, Lot 8, Block 1, Wildwood Estates to Neadowbrook Drive, known and designated as Unit No. 3. 4. BEATY STREET: From Yeager Street to Stark Street, known and designated as Unit go. 4. 5. STARK STREET: From Lancaster Avenue to the North line of Lot K, Brown-Harwood Addition, known and designated as Unit No. 5. 6. CRAIG STREET. From Lancaster Avenue to Stark Street, known and designated as Unit No. 6. 7. NORMO STREET: From the west line of Lot 16, Block 7, Forty Oaks Addition to Weiler Boulevard, known and designated as Unit No. 7. 8. LLOYD AVENUE: From Vinson Street to Panola Avenue, known and designated as Unit No. 8. J. PERKINS STREET: From Nit. Vernon Street to Meadowbrook Drive, known and designated as Unit No. 9. 10. McGEE STREET: From the North line of Lot K, Mamie Wolfe Addition to Meadowbrook Drive, known and designated as Unit 10. W14MEAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 5020 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHM2AS, the City Council of the City of Fort Worth, Texas, has, upon re- view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5020 , and 'SEAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; 01W, TH-M-EFOHE, BE IT ORDkV73D BY THF CITY COUNCIL OF TET CITY OF FORT WORTH, TVMS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re- ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, to ether with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: lit. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as .;art payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Contractor: R. W. Gibbins, Inc. Contract Awarded: September 5, 1963 (M&C G-530). Work Order Issued: October 17, 1963. Date of Final Inspection and Approval : March 31, 1964. After the construction on all units had been completed and the final inspection made, it was discovered that a section of curb and gutter on .Lloyd Street, Unit No. 8, had settled and needed to be removed and replaced to the proper grade. The final payment was withheld until the Contractor made the necessary repairs . Working Time Bid: 56 Working Days Working Time Used: 54 Working Days Proiect Cost and Financing: Bid Price: $ 56,907.75 Final Contract Cost: $ 57,148.65 Partial Payments Previously Made: 6 Amount: $51,279.89 Final Payment Due: $ 5,868.76 Payment to be made from Project No. 097-24000-115 Deviation from Bid Price: Variation between estimated and measured quantities account for the difference between contract price and contract cost. Compliance With Specifications : Attached is a tabulation of paving test cores showing compliance with speci- fications within acceptable construction tolerances, except for one area in Unit 3 which was removed and replaced to specified plan thickness as shown on the tore tabulations: Tests made during construction of the sub-base, base, and pavement also show that the material used was in compliance with svecifications.
