'7 G 2 3 AN ORDINANCE VACATING, ABANDONING AND CLOSING MAXINE STREET IN THE 1000 BLOCK A WIDTH OF 50' AND A LENGTH OF 395' FROM MARSALIS STREET SOUTH TO C. R. I. & G. RAILROAD RIGHT-OF-WAY AND TO VACATE, ABANDON AND CLOSE ETSIE STREET IN THE 5000 BLOCK A WIDTH OF 50' AND A LENGTH OF 205' WESTWARD FROM THAT PORTION OF ETSIE STREET PRE- VIOUSLY CLOSED BY ORDINANCE NO. 5909 AND ABUTTING LOTS 3, 4, 5, 11, 12, 13 AND THE WESTERN PORTION OF LOTS 6 AND 10, BLOCK 2, BAKER-THOMASON ADDITION TO THE CITY OF FORT WORTH; PROVIDING FOR THE RE- VERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Maxine Street in the 1000 Block a width of 50' and a length of 395' from Marsalis Street south to C. R. I. & G. Railroad right-of-way and Etsie Street in the 5000 Block a width of 50' and a length of 205' westward from that portion of Etsie Street previously closed by Ordinance No. 5909 and abutting Lots 3, 4, 5, 11, 12, 13 and the western portion of Lots 6 and 10, Block 2, Baker-Thomason Addition to the City of Fort Worth, be and the same are hereby vacated, closed and permanently abandoned as rights-of-way for street purposes. SECTION 2. That the fee to the land in the above described vacated street rights-of-way is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that ease- ments are reserved for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. I. & G. Railroad right-of-way and to vacate Etsie Street in the 5000 block a width of 50 feet and a length of 205 feet westward from that portion of Etsie Street previously closed by Ordinance No. 5909 and abutting Lots 3, 4, 5, 11, 12, 13 and the western portion of Lots 6 & 10, Block 2, Baker-Thomason Addition as shown on the attached maps. Subject rights-of-way, acquired by dedication, are open, paved and partially curbed and guttered. Public and private utility facilities are contained within both rights-of-way. Reviewing City Departments and private utility companies have reviewed this request and recommended that the subject rights-of-way be vacated, provided satisfactory easements are retained for existing utilities. All requirements have been met and a satisfactory replat has been submitted to City staff. The City Plan Commission has reviewed these requests and recommends vacation of subject rights-of-way, as requested. Recommendation It is recommended that an ordinance be adopted vacating subject rights-of-way as requested.
