An ordinance providing for the admission of adjoining territory to the corporate limits of the City of Fort Worth into the city and providing for the manner of holding elections in such territory for said purposee and for expenditure of meney on streets in said territory. BE IT ORDAINID BY THE BOA W QF CO?MGISSI0NER5 OF MIS CITY t. OF TORT WORTH. Sec. 1. That whenever a majority of the inhabitants quali- fied to vote for members of the Legislature of any territory adjoi- ning the limits of the City of fort Worth to the extent of one,-half mile square or of a territory so adjoining equal in size to or greater than one-half mile square whether said territory be in a IF square or rectangle or any other shape, shall vote in favor of it becoming a ;part of the said city and any three of such inhabitants make affidavit to that f zct and - file the same with the mayor he shall certify the same to the Board of Commissioners of said city and upon filing the said affidavit and the said certificate with the Board of Commissioners and the said Board shall have satisfied itself from said affidavit or otherwise that it is the desire of the majority of the voters of such territory to have the same be- come a part of the said city then the said Board may byordinance receive such territory into and include the same within the corpor- 7.ate limits of the said city; and upon doing so the inhabitants- of such territory shall thereafter- be entitled to all the rights and priveleges and immunities of other citizens and be bound by the acts, ordinances, rules and regulations governing the other citizens of said city. Sec. 2. That whenever as many as ten qualified voters resid- ing within any territory as described in Section 1 of this ordinance shall petition the Board of Commissioners or the Mayor to appoint :h parties to hold an election within any such territory and Shall in such petition prescribe and define the boundaries of the said territory then the said Board of Commissioners or the },Saylor shall be authorized to appoint a presiding officer and two or more judges -2- - and two or more clerks residing within and qualified voters within said territory to hold an election for the purpose of determin*ng whether the said territory shall seek admission into the corpora limits of the City, of Fort Worth and when said presiding officer and judges and clerks shall have been so appointed they shall have the power and it shall be their duty to post written or printed notices ,,t not less than four public places in said territory for a period of twenty days and also publith said notive* in the official news- paper of the City of Fort Worth .once a week for three consective weeks prior to the date of holding said election which said notices shall contain a statement of the territory within which said election i is to be held and the time and place of holding the same, zthich time shall be as much as twenty days and not exceeding thirty days from the date of posting said notices and the said presiding offic- er and judges and clerks or in their absence some qualified person or persons appointed by the voters present shall hold said election at said time and place and shall prepare the ballots to be used at r ' said election which ballots may read, "nor AI--As5tmr ,`ft%S: r,+r �rimdd sion", which ballots shall be used by striking out the one or the other of said expressions according as the voter may be in favor of or against such admission. The said presiding officer and clerks and judges shall before entering in to the said election take an oath before some officer qualified to adminster oaths that they will faith- fully and correctly hold said election and tabulate the returns and make correct certificate of the results thereof to the Board of Commissioners of the City of '!ort Worth and will return to said Board together with s =-id certificate the ballots voted at said election which returns FI-tall._ be made by delivering the same to the *payor or the City Secretary or the Board of Commissioners on the next day after the date of holding said election. After said returns shall have been made the same shall be examined by by %,Ott Board of Commissioners at its first meeting after said returnsNor as soon thereafter as pr cticable provided that the said election returns shall not take the place of but shall be considered . to- gether with the affidavit provided for in Section 1 of this ordinance -3- That the manner provided for in Section 2 hereof for the appointment of presiding officer and judges and clerks and for giving notice of an intention to hold such election and the time and place thereof in any, territory as he• ein mentioned and the manner of holding the same and the form of ballot, - etc., shall not be under- stood as being exclusive but the Board of Commissinners shall have a right to accept or recognize any report or certificate of an election held in such territory where the officers holding the same and the manner of giving notice thereof and the manner of holding the same and making return and certificate thereof shall have been appointed, prescribed and done in a different way from what is there in suggested provided that the same shall have been in some such manner as to show to the Board of Commissioners that it gave a full, free and fair oportunity to the voters residing in said territory to express their wishes and desires in respect to the admission or not of said territory into the corporate limits of the city of Fort Worth and provided further that the same siMM be accompiLined by the affidavit provided for in Sec. 1, of this ordinance. -4- Sec. 4. 4-Sec. 4. That the Board of Commissioners shall incorporate in any ordinance admiting any such territory into the corporate limits k of the City of Fort Worth an agreement and obligation upon the part of the City to apply to the improvement of the streets and public grounds in said territory all of the funds raised by taxation for street improvement for a period of not less than three and not exceeding five years in so far as said taxes ' may be collected fr the pro.erty situated in said territory and also to apply in each of said years a further sum from the revenues of said city of not less ,than thitty nor more than fifty per cent of the amount of said taxes so collected from the property of said territory. Sec. 5.. In the event of such admission the said taxes collected for street purposes from the said prerty situated within said territory shall be kept as a separate fund and the same shall together with such additional per cent of said sum as herein provid- ed be applied to the improvement of the streets within said territ- ory in the most judicious and advantageous manner '-o a ci , s pg within and property within said territory. Sec. �: That all ordinances and parts of ordinances in con- erewith be and the same are hereby- repealed and this ordin �e-. a in force from and after the date of its passage.
