ORDINANCE NO. ,341.30 AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COSTS OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMNTS ON PORTIONS OF HUNTER STREET, TERRELL AVENUE, NCRTHWEST TWENTY- FOURTH STREET AND SEMINARY DRIVE, IN THE CITY OF FORT WORTH, TEXAS, FIXING TDAE AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED, AND DIRECTING THE CITY SECRETARY TO GIVE NOTICE. WHEREAS, the City Council of the City of Fort Worth, has heretofore ordered that the hereinbelow mentioned portions of Hunter Street, Terrell Avenue, Northwest Twenty fourth Street and Seminary Drive, in the City of Fort Worth, Texas, be improved by raising, grading and filling same by constructing thereon a 11 inch Hot Mix Asphalt Concrete Surface on a 7 inch Flexible Base, together with combined concrete curbs and gutters where same are not already constructed on proper grade and line, together with incidentals and appurtenances indluding drains where necessary, all as provided by the Plans and Specifications for such improvements, and contract therefore has been made and entered into with GENERAL CONSTRUCTION COMPANY; and, WHEREAS, The City Council of the said City has caused the Director of Public Works to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION ONE. That such estimates be, and they are, adopted and approved. SECTION TWO That it is hereby found and determined that the cost of improvements on such portions of Hunter Street, Terrell Avenue, Northwest Twenty-fourth Street and Seminary Drive, with the amounts per front foot proposed to be assessed for such improvements against the abutting property and the owners thereof, are as follows, to uit: On HUNTER STREET, from the northerly line of Draig Shreet to the southerly line of Beaty Street, known and designated as Unit No l; the estimated cost of the improvements is $ 20,364.70 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.87; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $3.63; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $5.50. On TERRELL AVENUE, from the westerly line of Missouri Avenue to the easterly line of the North-South Freeway, known and designated as Unit No 2; the estimated cost of the improvements is b 3,016-80 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.87; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $3.63; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $5.50. On NORTHWEST TWENTY-FOURTH STREET, from the northwesterly line off Robinson Street to the southeasterly line of Titus Street, known and designated as Unit No 3; the estimated cost of the improvements is $ 23,998.00 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.87; the estimated -1- amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is 43.63; total estimated amount per front foot to be assessed against abutting property and the owners thereof is 05.50. On SEMINARY DRIVE, from the easterly line of Travis Avenue to the westerly line of Hemphill Street, known and designated as Unit No 4; the estimated cost of the improvements is $ 6,277.50 ; the estimated amount per front foot to be assessed age nst abutting property and the owners thereof for curb and gutter is $1.87; the estimated amount per front foot to be essessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $3.63; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $5.50. SECTION THREE That a hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of Hunter Street, Terrell Avenue, Northwest Twenty-fourth Street and Seminary Drive, and to all others owning or claiming any interest in ny such property. Such hearing shall be given and held on the day of IC4� .1195 , at /Q"�j o clock AJ_�d., in the Council Chamber in t City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of the Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 106 of the Acts of said Session, now shown as Article 1105b of Vernon's Texas Civil Statutes, which act has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least ten (10) days before the date of said hearing and said notice shall comply with and be in accordance with the terms and provisions of said Act. SECTION FOUR That this Ordinance shall take effect from and after its passage. SEMINARY DRIVE, from the easterly line of Travis Avenue to the westerly line of Hemphill Street, known and des' ted as Unit No 4; the estimated cost of the improvements is 9,277.50 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.87; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $3.63¢total estimated amount per front foot to be assessed against abutting property and the owners thereof is $5.50. "HELI , LIC -WORKS DIRECTOR E 0 T I C E TO ALL OWNING OR CLAIMING ANY PROPERTY ABUTTING UPON THB, HEREINAFTER MENTIONED PORTIONS OF HUNTER STREET, TERRELL AVENUE, NORTHWEST TWENTY-FOURTH STREET, AND SEMINARY DRIVE, IN THE CITY OF FORT WORTH, TEXAS, AND TO ALL OWNING OR CLAIMING ANY INTEREST IN ANY SUCH PROPERTY. The City Council of the City of Fort Worth, Texas, has heretofore ordered that the hereinbelow mentioned portions of Hunter Street, Terrell Avenue, North- west Twenty-fourth Street and Seminary Drive, be improved by raising, grading and filling same and by constructing thereon a 1i inch Hot Mix Asphalt Concrete Surface on a 7:� inch Flexible Base, together with combined concrete curbs and gutters where same are not already constructed on proper grade and line, together with incidentals and appurtenances including drains where necessary, all as provided by the Plans and Specifications for such improvements now on file with the City, and contract has been made and entered into with GENERAL CONSTRUCTION COMPANY, for the making and construction of such improvements, Estimates of the costs of such improvements for such portions of Hunter Otrewt, Terrell Avenue, Northwest Twenty-fourth Street and Seminary Drive have been prepared. The portions of Hunter Street, Terrell Avenue, Northwest Twenty-fourth Street and Seminary Drive, so to be improved, together with the estimated cost of the improvements and the amounts per front foot proposed to be assessed against the abutting property and the owners thereof are as follow: On HUNTER STREET, from the northerly line of Craig Street to the southerly line of Beaty Street, known and designated as Unit No 1; the estimated cost of the improvements is 6 20064.70 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.87; the estimated.-amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $3:63; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $5.50. On TERRELL AVENUE, from the westerly line of Missouri Avenue to the easterly line of the North-South Freeway, known and designated as Unit No 2; the estimated cost of the improve- ments is v 3,016.80 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.87; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is 43.63; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $5.50. On NORTHWEST TWENTY-FOURTH STREET, from the northwesterly line of Robinson Street to the southeasterly line of Titus Street, known and designated as Unit No 3; the estimated cost of the improvements is 6 23,998.00 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.87; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $3.63; total estimated amount per front foot to be assessed against abutting property and the owners thereof is 65.50. On SEMINARY DRIVE, from the easterly line of Travis Avenue to the westerly line of Hemphill Street, known and designatgd as Unit No 4; the estimated-cost of the improvements is 6 0,277.50; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is 41.87; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements ex- clusive of curb and gutter is $3.63; total estimated amount per front foot to be assessed against abutting property and the oimers thereof is $5.50. A hearing will be given and held by and bef the City Council of the City of Fort ++orth Texas, on the day of 1956, A.D., at Z6'092 o'clock M. in the ouncil Chamber in the City Hall in the City of Fort Worth, exas, to all owning or claiming any property abutting upon said portions of Hunter Street, Terrell Avenue, Northwest Twenty-fourth Street, and Seminary Drive, and to all owning or claiming any interest in any such property. At said time and place all owbi¢ng or claiming any such abutting property or any interest therein shall be and appear and will be fully heard 2 n concerning said improvements, the cost thereof, the amounts to be assessed therefor, the benefits to the respective parcels of abutting property by means of the improvements on the portions of Hunter Street, Terrell Avenue, North- west Twenty-fourth Street and Seminary Drive, upon which the property abuts and concerning the regularity, validity and sufficiency of the contract for, and all proceedings relating to such improvements and proposed assessments therefore, and concerning any matter as to which they are entitled to hearing under the law in force in the City of Fort worth under which these proceed- ings are taken and had and under the proceedings of the City reference to said matters. Following such hearing, assessments will be levied against abutting property and the owners thereof, and such assessments, when levied, shall be a personal liability of the owners of such property and a first and prior lien upon the property as provided by the law under which these pro- ceedings are taken and had, being the Act passed at the First Celled Session of the Fortieth Legislature of the State of Texas, known as Chapter 106 of the Acts of said Session, now shown as Article 1105b of Vernon's Texas Civil Statutes, which Act has been adopted as an amendment to and made a part of the Charter of the City of Fort worth, Texas. Of all said matters and things, all owning or claiming any such property or any interest therein, as well as all others in anywise interested or affected will take notice.
